This COC is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.) The General Permit authorizes discharges of stormwater and specifies your obligations for discharge controls, management, monitoring, reporting, and record keeping. Please review the new permit to familiarize yourself with all of the changes. Parts III and IV contain the Standard Conditions, including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and Maintenance obligations; and Definitions. Your facility has six months from receipt of the COC to update its Stormwater Pollution Prevention Plan (SPPP) to comply with changes in SPPP requirements. Other changes are effective immediately. Please note that Tier 3 Actions (if applicable) are triggered by four benchmark exceedances beginning on the effective date of the renewal permit and do not count prior exceedances. Barnhill Contracting — Lumberton Plant NPDES Stormwater General Permit-NCG160046 Robeson County Dear Mr. Glover: On September 16, 2009, Mark Brantley, Environmental Chemist, and Paul Rawls, Environmental Program Consltant, from the Fayetteville Regional Office of the Division of Water Quality, conducted a site inspection at the Barnhill Contracting — Lumberton Plant facility located on Highway 74 Alternate ( west of Lumberton), in Robeson County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. Mike Smith and Tracey Wilson were also present during the inspection and their time and assistance is greatly appreciated. Stormwater from this facility drains to the Lumber River/Black Swamp, a Class C, SW water located in the Lumber River Basin. The site visit -and file review revealed that the subject facility is covered by NPDES Stormwater General Permit-NCG 160046. Verification from our Fayetteville Regional Office revealed that there is neither a point source nor significant discharges from either facility to warrant continued compliance with the above mentioned NPDES stormwater permits. Bennett, Mid -Atlantic Associates, P.A., I have finally visited the subject asphalt plant sites. On March 7, 1996, after a heavy rainstorm, I found the claims in his letter concerning the Lumberton plant to be very believable. I can't swear that the pond(s) would overflow only in a 25 year storm, but it is obvious that all drainage on the site goes into the various borrow pit ponds, none of which appears to have an outlet. Even after the rain, the water level in these ponds, now probably at the highest elevation of the year, continues to provide substantial storage (minimum of approx. 18"). It seems reasonable to delete the monitoring requirements (or the entire permit) from this site. Any evidence of runoff would have shown up readily in the adjacent swamp. None was observed. The Butters plant does not have any containment ponds associated with the site. As Mr. Smith indicated, it is located on a somewhat flat tract of land, with berms around parts of the perimeter to contain storm -water. Although rain water had accumulated in two huge puddles around the plant site, there was no evidence of storm runoff from the facility. A 25 year.storm would probably exit in sheet flow from the front and sides of the property. As with the Lumberton site, it seems reasonable to remove any monitoring requirements for this facility. Drainage patterns at each of these sites have been effectively altered to effect retention of storm water. With routine maintenance, the diversion swales should be expected to function in this capacity and minimize the possibility of point source runoff.
