Hey James,
Attached is the Notice of Requirement letter we issued Triangle Auto Recyclers from our first inspection on 5/17/2013.
We conducted a follow up inspection on 6/24/2013 and all corrective items, including application for NPDES permit
(NCG100000), had been completed.
As of 8/1/2013 (our last inspection), the facility still requires additional BMPs but we are waiting to determine what
must be implemented depending on the results of the first runoff sampling conducted. They are due for another
inspection by April so I'll let you know how things are progressing.

Dear Mr. Alberto Diaz,
A Stormwater Inspection (13-ISWI-057 ) of your operation/property was conducted
by Jim Azareio on 511712013 , as allowed by the City of Durham Code
of Ordinances Chapter 70, Article V (the "Ordinance") § 70-525. You have been
identified as a party responsible for the operation/property. According to the
Ordinance, responsibility includes, but is not limited to: the ability to control what
occurs on property through ownership of the property or through ownership, control,
or management of a business, organization, or other entity whose activities occur on
property, and also as provided in § 70-539(c). Violations of the Ordinance may be
committed through deliberate action, negligence, omission, or inattention.
Reauired Stormwater Pollution Prevention Practices
According to § 70-511(c)(1) of the Ordinance, Stormwater & GIS Services has the
authority to require you to develop and maintain Best Management Practices (BMPs)
because the "location or manner of storage of pollutants on property may cause a
significant illicit discharge, or where an illicit discharge has previously occurred on
property ..."
The Best Management Practices listed and described below are REQUIRED
actions. Failure to implement a required practice (or alternatives, as allowed by
Stormwater Services) will constitute a violation of the Ordinance.

Description of Best Management Practices
Immediately:
1. Cease use of the large metal waste oil tank. The condition of this tank is
unacceptable for waste storage. If possible, move the tank to an indoor or under cover
location or away from its current spot over the unidentified hole in the ground.
2. The multiple small containers and large drums (and your large fuel cube) of oil or
other non -rainwater fluids that are stored outside must be properly disposed of or
stored in a location with secondary containment and cover (ie. something underneath
to catch drips/spills and a cover or roof over top to protect it from the rain). If the
containers are indoors well a\Aey from doorways or exits, then we do not require
secondary containment and cover.
3. All containers must be properly labeled and tightly closed when not in use.
No later than 6/26/2013 (3 weeks):
1. The contents of the waste oil tank must be properly disposed of through a licensed
waste disposal company. Provide a receipt of the disposal for Stormwater Services.
2. The floor of the work area under the roof must be cleaned of oily residue. Use a dry
method such as a scraper, broom, and oil absorbent. Some staining will remain in the
concrete and is not expected to be removed. The end result we are looking for is that
residue cannot be easily scraped or tracked off of the floor. If a dry method does not
work adequately, call us to discuss set up for using water and/or soaps. Once the floor
is cleaned, be sure to maintain if routinely so that the residue does not build up again.
3. At all times, you must have no less than eighty (80) pounds of granular oil
absorbent (sawdust will not satisfy this requirement) for cleaning up oil spills and
twelve (12) oil absorbent socks/booms (such as seen here: http;l/goo.gI/WFWN8) for
containing large spills from spreading.
No later than 7/31/2013 (2 months):
1. Install a lip (or berm) around the concrete work area (under the roof) to prevent
leaked, dripped, and spilled fluids from escaping to the soil. If you cannot or may not
install a permanent lip, then obtain large pans or spill containment pallets on which to
store parts. The pallets may be placed at floor level in the shelving units to catch leaks
from upper shelves.
2. Apply for a National Pollutant Discharge Elimination System Stormwater Permit
through the State Division of Water Quality (DWQ). The State DWQ requires that all
motor vehide scrap and used parts sales businesses must apply for permit
NCG100000. This is a link to the permit requirements: hftp_://goo.gl/MhSEN. This is a

upon request. Read over the permit requirements. Among other things, you will be
required to write a Stormwater Pollution Prevention Plan and tolled samples of your
runoff twice per year to submit to a laboratory for analysis for pollutants.
The State Division of Waste Management section has been notified that an
unknown amount of petroleum has leaked into a hole in the concrete and soil
where the large oil tank has been stationed. The staff of the DWM are experts on
procedures to follow in case of petroleum releases. Follow their instructions
and requirements on this issue and you will be deemed in compliance with City
re uirements as well.

Potential Penalties and Remedies
City Ordinance § 70-540(2) states that first-time violators are subject to limited civil
penalties. The base penalty for each violation may be up to: $500 for residential use
properties, $2,000 for"non-residential use, and $10,000 for NPDES facilities. After the
first offense, violators may be subject to increased penalties.
To determine the amount of a penalty, the City considers factors such as harm to the
environment and property, duration, and the cost of reversing the damage. Also
considered are: money saved through noncompliance, prior knowledge of
requirements, prior violations, actions taken to remediate impacts, and actions taken
to prevent future violations.
The City may also use other administrative remedies as allowed in § 70-540(1) and/or
judicial actions as allowed in § 70-540(3) such as injunction, abatement, or
prosecution as a criminal misdemeanor. In situations where water and/or sewer
service may contribute to a violation, utility services may. be terminated.
The City will issue you a written Notice if one or more violations are observed,
or if assessing a civil penalty, terminating utility service, or using any other
remedy.
In situations where there is an unreasonable delay in compliance, an emergency, or a
public nuisance, the City may take actions to remediate a violation (see § 70-542.)
Under such circumstances, the City may bill the violator or lien the costs against the
property.

You may request a meeting with Stormwater & GIS Services to discuss and provide
additional information, in writing or orally, about your responsibility or the required
BMP(s). Meeting requests must be. made within ten (10) business days of receipt of this
Notice. Requests must be made in writing. Delivery options include:

don't really know if this is the correct office to report this but I figured someone needs to know. There is a recycling
business Triangle Aut ��LLC at 4502 Denfield St, Durham, NC, 27704 with mounds of old tires and wheels
behind the business not only on the ground but in a creek that feeds into the Eno river or Falls lake. If someone from
your office could stop by and look behind the property going towards Todd St there are at least a couple of hundred `

No, I think they need our permit now, but with the knowledge that they have had issues with storage of barrels and
some petroleum in the soil. They are moving in the right direction with the City. We can issue and schedule them for an
inspection next quarter to propel them in the right direction.

The City of Durham Stormwater Office issued an NOV to Triangle Auto Recyclers on 6,13.13. A follow-up inspection
indicated improvement but not yet in compliance. They have been in Durham's database since 2011.

Please review the attached N01 application with the objective of responding to me with a recommendation to issue the
permit. I recognize that you may not visit each new permittee during this NOI review, but it affords you the opportunity
to log the permit into your regional database and add the facility to a future monitoring and compliance visit schedule.
Therefore, your recommendation now to issue the permit serves as your acknowledgement that (1) the facility is located
in your region, (2) that there are no current complaints outstanding about the facility that have not been dealt with, and
(3) that the facility may ultimately be inspected by the regional staff. I've also attached a scanned copy of the N01 and a
location map for your review.
