Please consider this our written response as requested. As you may ]lave heard through the news, both Allied Waste and Republic Services have completed the merger as of December 5, 2008. This facility will now fall under my area of responsibility as far as environmental compliance and reporting. The implementation of the semi-annual analytical and qualitative events will commence immediately under my direction. Our landfill, also located in Montgomery County , will provide trained personnel for collection of samples going forward as they have been collecting samples for several years now. All sampling results will be submitted on the DMR form as required and will be signed by our responsible company official. We attempted a collection event on December 1], 2008, but did not properly calibrate the pH meter and as a result had a pH reading slightly above the 9.0 limit. The results from the lab have not been received as of this date. We will obtain a new sample, with proper calibration, during the next qualifying event, and submit these results to DENR. Our company provides training on the SWPPP and SPCC plans as well as the requirements of the general Stormwater permit for all newly hired employees and provides refresher training on an annual basis or more frequently as needed. A cop), of the inspection report is enclosed for your review. Your time and assistance was greatly appreciated. The Storin water from this facility drains to Warner Creek; Class C waters located in the Yadkin/Pee Dee River Basin. Since this facility used more than an average of »-gallons of new oil per month, it was a requirement of the stormwater permit that this facility perform analytical monitoring on a semi-annual basis. In addition, the facility had an Oil/Water separator that received flow from the truck wash pit. Noble Oil Company periodically picked up the oil portion from the Oil/Water separator. The water portion drained from the Oil/Water separator to the City of Troy sanitary sewer collection system, "Phis facility's shortcoming for meeting the requirements of their stormwater permit was that their stormwater outfalI sample site had not been established because of their uncertainty that it would adequately represent the site. It follows that the semi-annual qualitative and the annual analytical monitoring had not been performed at this site. The analytical monitoring are analyses for pl-I, Total Suspended Solids, and Oil & Grease. After a site inspection, it appeared to this inspector that an adequate location for sampling for the semi-annual test parameters would be at the beginning of the ditch, at the point where discharge falls into the ditch from the pond's overflow discharge pipe. This would be representative of the flow that comes from approximately 30 to 50% of the property (including the flow from the truck parking lot, the car parking lot, and part of the maintenance shop area). The majority of the remaining flow from the site (including flow from the old dumpster area) flows as stormwater sheet flow to the ditch (that is stream fed, for the most part). It appeared to this inspector that it would not be required to sample stormwater sheet flow that comes from this area. Requested Response: Please send a written response to this Office by December 15, 2008 concerning the implementation of the semi-annual analytical and semi-annual qualitative sampling at the above mentioned sample site. This Office requires that the violation that involved missing analytical sampling and qualitative sampling be properly resolved. Thank you for your attention to this matter. Since more than an average of 55-gallons of new oil was used per month, analytical monitoring was required by the stormwater permit on a semi-annual basis. In addition, the facility had an Oil/Water separator that received flow from the truck wash pit. The oil portion of the Oil/Water separator was periodically picked up by Noble Oil Company. The water portion drained from the Oil/Water separator to the City of Troy sanitary sewer collection system. This facility's shortcoming for meeting the requirements of their stormwater permit was that their stormwater outfail sample site was not established due to uncertainty that it would adequately represent the site. It follows that the semi-annual qualitative and the annual analytical monitoring had not been performed at this site. The analytical monitoring included pH, Oil & Grease, and Total Suspended Solids. After an inspection at the site, it appeared to this inspector that an adequate Location for grabbing the semi-annual samples would be at the beginning of the ditch, at the point where discharge falls into the ditch from the pond's overflow discharge pipe. This would be representative of flow that came from approximately 30 to 50% of the property (including flow from the truck parking lot, the car parking lot, and part of the maintenance shop area). The majority of the remaining flow from the site (including flow from the old dumpster area) sheetflowed to the ditch (that was stream fed, for the most part). It appeared to this inspector that it would not be required to sample the stormwater sheet flow that comes from this area.
