(S&ME) is submitting this response letter on behalf of CRTS, Inc. (CRTS). CRTS is currently permitted to discharge stonnwater consistent with General Permit No. NCGO80000 and Certificate of Coverage No. NCG080289. On December 11, 2012 Cheng Zhang of the North Carolina Department of Environment and Natural Resources (NCDENR) Raleigh Regional Office (RRO) conducted a stormwater compliance evaluation inspection of the subject facility. Mr. Zhang documented the findings of his inspection in a Notice of Deficiency letter dated January 3, 2013. The five items noted in the letter were: Certificate of Coverage (COC) No. NCGO80289 of NPDES General Permit NCG030000 was issued to CRTS, Inc. to discharge storm water runoff to an unnamed tributary to Big Branch, a Class-C NSW stream in the Neuse River Basin. (Note: S&ME believes NCG030000 is a typo and it should be NCG080000.) 2. The COC was originally issued on October 14, 1994 and recently renewed on December 1, 2012. The facility was found to have violated Part I1 Section A of the General Permit for failure to develop and implement a Stonnwater Pollution Prevention Plan (SPPP). 3. At the time of inspection, the facility was also found to have violated Part II Sections B and D for failure to conduct qualitative and analytical monitoring. 4. All stormwater appeared to be collected to the onsite retention pond. The lone stonnwater outfall was observed during the inspection and no discharge was noted. The main industrial activity — trailer repair — was conducted in the shop and not exposed to stonnwater. Large number of used trailer brake shoes, wood pallets, metal parts, and some oil drums were stored in the yard exposed to stony► water. The facility is considering applying for a No Exposure Exclusion Certificate. Should the application be approved by the Division, the current COC should be rescinded; otherwise, the facility must conduct monitoring, develop and implement a SPPP, as required by the General Permit. In response to the December 11, 2012 inspection CRTS placed the brake shoes in an enclosed onsite trailer and sent the majority of the pallets offsite. On February 13, 2013 staff from the NCDENR re -inspected the site in response to CRTSs request for No Exposure Certification. A letter dated February 25, 2013 in response to the site inspection and No Exposure Certification request, stated that NCDENR was unable to concur with a No Exposure Certification for the facility since numerous materials, including brake shoes, pallets and dumpsters containing metals, on the site were still exposed to stormwater, either from precipitation or as stormwater that flows across the surface of the facility. NCDENR noted that CRTS should make arrangements to fully implement all aspects of their NPDES Stormwater Permit and after a period of carrying out the permit and being in compliance with the pennit, they may reapply for a No Exposure Certification for Exclusion from NPDES Stonnwater Pennitting. CRTS has hired the services of S&ME, Inc. to prepare a SPPP (Item 2 of the January 3, 2013 NCDENR letter), to conduct the annual non-stormwater discharge certification, and to prepare and to perform annual stormwater training for CRTS personnel. Qualitative and quantitative sampling will be conducted by trained CRTS staff or by S&ME personnel prior to the Year 1 — Period 1 deadline of June 30, 2013 (Item 3 of the January 3, 2013 NCDENR letter). CRTS would still like to consider applying for No -Exposure Certification in the future, but understands that they need to show compliance with the existing pen -nit (Item 5 of the January 3, 2013 NCDENR letter). S., Inc. is hereby authorized to continue operation of an oil water separator and discharge stormwater from a facility located at 3116 Capital Boulevard Raleigh Wake County to receiving waters designated as the City of Raleigh Storm Sewer System and Marsh Creek in the Neuse River Basin in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts I, II, 1II and IV of General Permit No. NCGO80000 as attached.
