In response to your renewal application for continued coverage under stormwater General Permit NCG060000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCGO60000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, Z013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.oWweb/wq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the stormwater Permitting Unit's website with the new General Permit. Please visit

Some of the changes include:
Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections 8, C. Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections 8, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections 8, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections 8 C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections 8, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

Enclosed please find a copy of the Compliance Evaluation Inspection Report for the
Stormwater inspection conducted at the subject facility on February 23, 2007, by Ms. Marcia
Allocco of this Office and Mr. John McCullouch of the Mecklenburg County Water Quality
Program.
This report is being issued as a Notice of Violation (NOV) due to the permit condition
violation of the subject NPDES permit and the North Carolina General Statute (G.S.) 143-215.1
as detailed in the Permit and Outfalls section of the attached report. The Division of Water
Quality may pursue enforcement actions for this and any additional violations.
Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand
dollars ($25, 000.00) per violation, per day may be assessed against any person who violates or
fails to act in accordance with the terms, conditions, or requirements of any permit issued
pursuant to G. S. 143-215.1.
It is requested that a written response be submitted to this Office by April 20, 2007,
addressing the violation and deficiencies noted in the Summary, Stormwater Pollution
Prevention Plan, and Permit and Outfalls sections of the report. Your response should include
an updated copy of your Stormwater Pollution Prevention Plan (SPPP) addressing the issues

Inspection Summary:
This stormwater inspection was completed as a follow-up to NC State Incident # 200700650 which occurred at the Frito
Lay facility on January 11, 2007. Mecklenburg County Water Quality Program (MCWQP) personnel provided the initial
response to the incident.
During the response MCWQP personnel observed impacts to two separate stormwater outfalls by non-stormwater
discharges. In addition, it was unclear to the MCWQP personnel whether facility staff understood the drainage areas for
each outfali [required by NCG060000, Part 11, Section A, 1(c)], those activities on site that could impact each outfall
[required by NCG060000, Part 11, Section A, 1(c)], and whether the appropriate personnel had been trained in spill
response and clean up activities [required by NCG060000, part 11, Section A, 3 and 51.

concrete culvert that leads to Outfall 002. As required by the NCG060175, Part II;

Comment: The facility has been sampling/monitoring Outfall 003 after the confluence
with Outfall 002; this does not allow for accurate determination of the discharge from
Outfall 003 and is in violation of NCG060175. As required in part by NCG060175
Section D, Item #1, "All samples shall be taken before the discharge joins or is diluted
by any other waste stream, body of water, or substance". Please relocate the
sampling/monitoring of Outfall 003 as discussed in the inspection to the area where
discharge from this outfall first appears from under the parking area in the SW corner of
the facility and as noted on the attached map.
During the inspection it was noted that vehicle maintenance activities occurred on -site.
If these activities use > 55-gal. of new motor oil per month when averaged over the
calendar year. then Frito Lay will be subject to the monitoring and reporting
requirements at Outfall 001 as required by Section D of NCG060175 in addition to any
other requirements as detailed in Section B.

Chapter 143, Article 21 of the North Carolina General Statutes (G.S.) authorizes and
directs the Environmental Management Commission of the Department of Environment &
Natural Resources to protect and preserve the water resources of the State. The Division of
Water Quality (DWQ) has the delegated authority to enforce adopted pollution control rules and
regulations.
On January 11, 2007, Mr. John McCulloch of the Mecklenburg County Water Quality
Program (MCWQP) conducted an investigation of your property located at 2911 Nevada Blvd.
This investigation was conducted as part of a cooperative working agreement between
Mecklenburg County and the Division of Water Quality. As a result of this investigation; the
following condition was found on the property in violation of G.S. 143-215.1(a):
Illegal discharge of wastewater to an unnamed tributary to Steele Creek, a Class C
surface water in the Catawba River Watershed,

Cause/Observation:
Facility personnel reported a wastewater, discharge from the
facility's pretreatment plant. Pumps contained in a sump
associated with the pretreatment works had failed resulting in the
sump overflowing. The discharge was entering. a storm water
drainage feature and flowing to an unnamed tributary to Steele
Creek. Ms. Toole stated that the wastewater was comprised of
process water including NaOH (from Chembrite and Powerfoam)
used in the cleaning of stainless steel fryers in the facility. Total
volume initially estimated at 650 gallons. Spill was ongoing at
17:00 when MCWQP arrived on site but had ceased by the end
of the site visit. While inspecting the receiving stream the
MCWQP personnel noticed another tributarylstormwater oulfall
that appeared to be impacted by wastewater.
Action Taken:
A vacuum truck arrived on -site the afternoon of 1/11 /07 and
pumped out wastewater sump. MCWQP personnel instructed
that the vacuum truck clean the stream as far as the truck hose
could reach. Follow-up on 1112I07 found the clean-up to be
ongoing. The second impacted stormwaler outfall discovered
during the previous inspection still appeared to be impacted with
wastewater but not associated with the original spill. Source of
discharge not apparent and MCWQP plans to visit site again in 2
weeks

1/1 1/07 (16:15). MCWQP received a call from Ms. Lindsey Toole (Regulatory
Compliance Manager) at Frito Lay. The facility is located at 2911 Nevada Boulevard in
Charlotte. Ms. Toole reported a wastewater discharge from the facility's pre-treatment
plant. The discharge was discovered early in the morning on 1/11/07 and was reported to
have been stopped between 0800 and 0900. John McCulloch responded.
McCulloch arrived onsite at approximately 16:50. Met with Lindsey Toole who escorted
me to the spill location at the rear of the Frito Lay Facility (see attached aerial map). The
discharge was continuing at 17:00 and had not been stopped as reported. According to
Ms. Toole, pumps in a sump associated with the pretreatment works had failed resulting
in the sump overflowing. The discharge was entering a storm water drainage feature and
flowing to an unnamed tributary to Steele Creek (Class C). Ms. Toole stated that the
wastewater was comprised of process water including NAOH used in the cleaning of
stainless steel fryers in the plant. The total volume of wastewater discharged was
unknown.
While inspecting the receiving stream, I noticed another tributary/storm water outfall that
appeared to be impacted by wastewater.
By the time I had completed my investigation, a vacuum truck had arrived to pump out
the sump and the discharge had ceased. l instructed Ms. Toole to have the pump truck
clean the stream as far as the vacuum truck could reach. The facility requested that I not
take photos but they would provide me the photos they took.
I collected the following field measurements:

John McCulloch and Olivia Hutchins returned to the Frito Lay facility to reinspect in
daylight. Cleanup was ongoing.
The storm water outfall discovered during the previous inspection still appeared to be
impacted with wastewater but not associated with the original spill. We began looking
for the source of the discharge along with Frito Lay personnel. The discharge was
originating from an underground storm pipe so we got the infrastructure plans for the
facility. We searched for a couple of hours but could not determine where the discharge
was coming from. The storm maps were not of much help because they were not
accurate. We instructed the facility to continue looking for the source of the discharge
and we would reinspect in about 2 weeks. Olivia and John left the facility at around
12:00.

After being told they could not provide the photos, i went ahead and drafted an NOV for
discharge without a permit.
Draft was forwarded to Meredith for review and submittal to MRO.

A Notice of Violation was issued to Frito Lay, dated March 16, 2007, in relation to a spill that
occurred onsite at the waste water treatment facility. In response to that situation, a large
clean-up took place of the immediate and surrounding areas equaling $37,000. Other
corrective measures were identified and completed, as stated in the January 30, 2007
response provided by Frito Lay.
In response to the Notice of Violation issued to Frito Lay on March 16, 2007, detailed
corrective measures have been completed and/or currently taking place to ensure that the
identified regulatory compliance issues are addressed in a manner to prevent recurrence.
Each paragraph below is relative to the findings noted in the NOV inspection follow-up based
on the February 23, 2007 inspection.
Inspection Summary Response: During the above mentioned inspection, it was unsure
what was impacting each of the stormwater outfalls. In response to the raised concern,
stormwater pipes throughout the facility were identified, as well as, other potential non-
stormwater discharges. Current stormwater and spill prevention trained employees have
also been identified to ensure the proper awareness and/or specific training is understood.
Annual stormwater and spill prevention training is conducted, with 2007 training to take
place in July. This training will include what Charlotte's potential sources to each
stormwater outfall are and what are the impacts of each.
Stormwater Pollution Prevention Plan Response: A coal boiler is located on the facility, and
it was observed during the February 23, 2007 inspection that coal ash was present in and
upstream of the stormwater outfall #2. A $165,000 capital project was approved and
implemented for updating the coal boiler ash loading/unloading system. This system will
prevent the ash from getting into the outfall and was completed March 17, 2007-.
Additional cleaning in the immediate surroundings, the concrete culvert, and discharge area
is scheduled for clean up May 25, 2007. Regular inspections of the area have been added
as requirement to the operator Preventive Maintenance process.
Permit and Outfalls Response: All stormwater discharge areas were assessed and reviewed
during the February 23, 2007 inspection to determine the most appropriate outfall sampling
points. Based upon the inspection review, as well as, further assessments of the area,
stormwater outfall sampling points #3 has been relocated. The relocation will ensure that

the sampling is representative of Frito Lay, Charlotte's discharge is accurate. Vehicle
Maintenance is conducted on -site in the Traffic Center. The traffic department was
contacted to determine what amounts of motor oil was used on a monthly basis. When
averaged over a 12 month period, more than 55 gal/month was used during 2006. Based
on that determination, further monitoring requirements are necessary for stormwater outfall
#1.
In closing, please note that both Charlotte's Spill Prevention Control and Countermeasures
(SPCC) Plan and Stormwater Pollution Prevention Plan are currently being updated by an
outside consultant. Completion is scheduled for July 2007; therefore an updated SWPPP is
not included in this file. Upon completion, we will follow up with your office to provide any
further needed information.

GENERAL:
The Mecklenburg County Water Quality Program (MCWQP) has conducted no previous
NPDES inspections of the Frito-Lay, Inc. facility.
PERMIT:
Frito-Lay, Inc. holds a general NPDES Stormwater Permit, NCG06000, Certificate of
Coverage No. NCG060175. The permit became effective on September 1, 2002 and will expire
on August 31, 2007. The permit authorizes the permittee to discharge stormwater associated
with industrial activities, to the surface waters of the State or to the Municipal Separate Storm
Sewer System, providing that the permittee treats, controls, limits and monitors the discharge as
specified in the permit.
RECORDS/REPORTS:
All documents maintained by Frito-Lay were organized and available for inspection upon
request. It was noted that the Stormwater Pollution Prevention Plan (SPPP) was current,
included updated employee training records, and also included updated Qualitative Monitoring
Reports. The documentation maintained by Frito-Lay in accordance with permit conditions.
FACILITY SITE REVIEW:
Frito-Lay, Inc, is located south of the intersection of Nevada Boulevard and Cordage
Street in Charlotte, NC,
The SPPP Site Plan - Narrative Description and Site Map, as required in Part II,
Sections A. 1'. (b) and (c) of the permit describes the Frito-Lay facility as a manufacturing plant
of corn and potato food products, warehouse, and traffic center. The outdoor operations observed
during the inspection included the unloading of bulk liquid materials from railcar tankers;
unloading of bulk material from semi -trucks via hydraulic lifts, and material transfer from above
ground storage tanks (AST) via pumps and hoses. Materials transported and/or stored outdoors
include, but not limited to, vegetable oil (AST), fuel oil (AST and UST), waste oil (AST),
hydraulic oil (AST), and process waste (WWTP).
The structural spill basin / stormwater control system employed at the facility appeared to
be effective. Also, the facility's outdoor housekeeping observed during the inspection appeared
to be excellent. Stored materials were out of the path of traffic and containers were closed or
covered where,possible.
Three (3) stormwater outfalls are located on the property.
Outfall 1: This outfall is located on the northwestern corner of the property and discharges to a
drainage ditch, before being directed to Steele Creek. The outfall drains the traffic center and
adjacent parking areas. The traffic center is comprised of a fuel oil storage and refueling area. In

the event of a spill, spillage would flow to the stormwater system or to the drainage ditch via
overland flow.
Outfall 2: This point is located on the southern corner of the property and discharges to a
drainage ditch, before being directed to Steele Creek. This outfall drains the fuel oil storage area.
If a spill occurred, spillage would flow to the drainage ditch.
Outfall 3: This point is located on the southern corner of the property and discharges to an
unnamed tributary of Steele Creek. The outfall drains the roofs, vegetable oil storage area,
unloading area, and adjacent parking areas. The storage area is equipped with an emergency
shut-off valve. Stormwater drains in the unloading area are controlled by two valves that can be
closed should a spill occur.
EFFLUENTIRECEIVING WATERS:
This inspection was conducted during clear, dry weather conditions. No discharge was
observed at any of the 3 identified outfalls during the inspection.
Steele Creek was not evaluated during this inspection.
SELF -MONITORING PROGRAM:
The facility's permit requires that qualitative monitoring be conducted twice per year.
The records indicate that monitoring has been conducted per permit guidelines.
OPERATIONS & MAINTENANCE:
The overall operation and maintenance strategy for this facility appears to be appropriate.
Good housekeeping practices were evident in the appearance of the buildings and grounds
during the inspection. Periodic inspections of the secondary containment structures (dike drain
logs) and employee training were documented.
STORMWATERIPOLLUTION PREVENTION:
The permittee has successfully developed and implemented a plan that is adequate and
innovative. Documentation appeared accurate and up-to-date.

Cause/Observation:
Facility personnel reported a wastewater discharge from the
facility's pretreatment plant. Pumps contained in a sump
associated with the pretreatment works had failed resulting in the
sump overflowing. The discharge was entering. a storm water
drainage feature and flowing to an unnamed tributary to Steele
Creek. Frito Lay personnel stated that the wastewater was
comprised of process water including NaOH and KOH (from
Chembrite and Powerfoam) used in the cleaning of stainless
steel fryers in the facility.
Spill was ongoing at 17:00 when MCWQP arrived on site but had
ceased by the and of the site visit While inspecting the
receiving stream the MCWQP personnel noticed another
thbutarylstormwater outfall that appeared to be impacted by
wastewater.
Action Taken:
A vacuum truck arrived on -site the afternoon of 1111/07 and
pumped out wastewater sump. MCWQP personnel instructed
that the vacuum truck clean the stream as far as the truck hose
could reach.
Follow-up on 1112/07 found the clean-up to be ongoing. The
second impacted stormwater outfall discovered during the
previous inspection still appeared to be impacted with
wastewater but not associated with the original spill. Source of
discharge not apparent and MCWQP plans to visit site again in 2
weeks

Incident Notification: On January 11, 2007 at 6:45am, it was identified that the PC/Corn
Sump, located outside of the Waste Water Facility, was overflowing. The potato pump had
tripped out and was back in operation within 5 minutes. At that time, no flow was lost to
the storm drain, as it remained puddled in the area. At 7:30am, the sump began
overflowing again because of a second pump failure. The overflow continued until 8:30am,
when the pump regained function. Due to the amount of overflow, the process water was
being released to the storm drains and then, to off the property into Steele Creek. Based
on the flow rate of incoming process water to the sumps, the efficiency of the pump, and
the length of time of the spill, it was determined that 4500 gal of process water was lost to
the storm drain. During the one hour period, Sunbelt was contacted and a small pump was
rented to assist in the sumps operation. The pump arrived on site at 10:00am. A large
diesel pump was also ordered, however it did not arrive on site until 6:30pm. At appx.
2:00pm, it was identified that the sumps were slowly overflowing again. The pump that had
faulted previously, faulted again, and the small pump was not able to maintain the incoming
water flow. From 2:00pm -- 4:00pm, the faulty pump came in and out of service due to
improper seating. Again, based on pump efficiency and flow rate, it was determined that
appx. 5,250 gal of process water was lost. From 4:00pm - 5;30pm the faulty pump was
completely out of service, therefore the overflow continued, with an estimated loss of 6,562
gal. Mecklenburg County and the NCDENR were contacted around 4:20pm. Haz Mat was
also contacted to conduct a clean up. The Mecklenburg County official arrived on site at
5:00pm, where he witnessed the overflow. Upon Haz Mats arrival at 5:30pm, they were
able to prevent further release to the storm drain. At 6:30pm, the overflow began reaching
the storm drain due to Haz Mat having filled up their truck and not has the diesel pump in
operation. This flow off -site continued for appx. 30min, until Haz Mat delivered a second
truck. The assumed water loss during that time was 2,625 gal. Haz Mat was able to stop
flow from leaving the facility, however the water overflow from the sump was continuing.
At 8:30pm, the diesel pump was in operation all overflowing from the sump was stopped.
Haz Mat then cleaned up what water was left in the area. A total of 18,937 gal. was
estimated to have reached the storm drain. The contents of the lost process water and the
respective times of loss are described below.

7:30am - 8:30am: 4500 gal Process Water - 80 gal of a Sanitation chemical containing
44% NaOH, 25 gal foam containing 10-15% NaOH and 10-15% KOH, potato/corn dirt, trace
vegetable oil amounts, and water.
2:00pm - 4:00pm: 5250 gal Process Water - Potato/corn dirt, trace vegetable oil amounts,
and water.
4:00pm - 5,30pm: 6562 gal Process Water - Potato/corn dirt, trace vegetable oil amounts,
and water.
6:30pm - 7:00pm: 2625 gal Process Water - Potato/corn dirt, trace vegetable oil amounts,
and water.
Root Cause: 1, The biotower sump had a buildup of solids, which allowed potato dirt to clog
the overflow line. Process error, miscommunication, and the lack of needed repair in the
affected area were the contributing factors to this spill event. 2. Potato pump failure due to
improper seating. 3. It was identified that the corn pump in this sump was clogged and had
not been operational.
Corrective Actions: Containment Actions: Potato pump was re -seated properly 1/12/07.
Corn line was unclogged 1/12/07. Roto-Rooter to clean overflow line 2/18/07.
Preventive Measures: Level control upgrade to be completed. A quarterly PM has been
added to ensuring the Biotower sump remains free from blockage.

Cause/Observation:
Fryer at facility is rinsed out regularly after cleaning. The
facility's 2nd shift had rinsed the fryer but did not verify that valve
had been closed fully. 3rd shift proceeded to use fryer also not
verifying that the valve was shut. This resulted in a loss of the
entire contents of fryer. Containment around fryer had been
breached by the facility's maintenance crew cutting a hole in the
side, Vegetable oil left facility through nearby bay doors and
entered storm drain. Storm drain leads to a catch basin. Entire
spill contained between storm drain and catch basin and did not
reach surface waters. Facility estimated that —1166 gals of
vegetable oil or 12,500 lbs had been released.

Incident Notification: On December 6, 2006 at 7:45am, there was a spill of a vegetable
oil/water mixture at the Frito Lay, Inc. Charlotte Operations located at 2911 Nevada Blvd.,
Charlotte, NC 28273. This oil/water mixture exited the manufacturing building by the dock
doors located near the Receiving area and reached the primary on -site stormwater drain
located at the north west corner of the property. However, it appeared that there was no
release from the site or into any receiving streams.
Upon recognition of the spill, Haz-Mat, a company out of Charlotte, NC, was contacted for
emergency spill response. Clean-up procedures began taking place at 9:30am. Through a
very extensive investigation, it was determined that approximately 800-1000 gallons of
total liquid left the building, with 200 gallons being water. Based on the fact that there was
no visible runoff from the facility it is believed that all of the material was recovered by Haz-
Mat or was delivered to the on -site wastewater treatment plant. Note: these are only
estimations.
Initial notification of this event did occur on December 6, the date of the incident. The
National Response Center, NCDENR, Mecklenburg County, and the City of Charlotte were all
contacted. Due to the amount of oil released from the building, Frito-Lay was initially
uncertain if a reportable amount of oil had been released from the property into a receiving
stream. Proactive measures were thus taken with the communications. A representative
from Mecklenburg County, Meredith Moore, conducted a site inspection on December 7, and
verified that there was no visible evidence of a loss of any oil to a receiving body of water.
In follow-up to this incident, this further notification and summary of corrective measures
has been prepared to ensure that this will not occur in the future.
Incident Description: PC Fryer #2 was taken off-line around 9:00pm on December 5.
When this occurs, the fryer must be hot -rinsed. Once rinsed, valves must be opened to
allow the water to drain through the system. This hot -rinse was taking place during 2"d and
3rd shift exchange. It is standard procedure that all valves must be closed prior to fryer
start-up. The third shift operator was instructed to verify that all valves had been closed
upon completion of the hot rinse and before the restart, however, through investigation, it
appears that the valves were not verified. One valve had been left open. This does not
pose a concern during fryer operation as there are automatic valves that become engaged

during operation that would have not allowed any leakage. At around 7:15am, the same
fryer was taken off-line again for a changeover. Before a changeover occurs, the oil must
be cooled. When that happens, the automatic valves mentioned previously, will open back
up, allowing liquid flow through any manually operated valves that may be open. When this
fryer was turned off for cooling, a mass amount of vegetable oil, along with cooling water,
flowed into a containment area. Due to the drains not being able to withstand the flow of
that large amount of oil/water, and due to a section of the containment wall being removed,
the mixture flowed onto the floor and out of the dock doors located in the area onto the
parking lot leading to the stormwater drain.
Root Cause: Process error, miscommunication, and the lack of needed repair in the affected
area were the contributing factors to this spill event.
Preventive Measures: All employees were made aware of the incident immediately. A valve
checklist was created and added to the Standard Operating Procedures for any shut down
situations. This was implemented by December 15, 2006. The containment wall was
repaired December 9, 2006. An investigation for enhanced controls is currently in progress
to determine if a system can be developed to prevent oil cooling unless all valves are in the
closed position.

of Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit
is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency
dated December 6, 1983.
The following information is included with your permit package:
■ A copy of the stormwater general permit.
■ A Stormwater Pollution Prevention Plan Certification Form. This form certifies that you have
developed and implemented the Stormwater Pollution Prevention Plan (SPPP) required in your
permit. This form must be completed and returned to the Division within 30 days of receipt of
this letter. DO NOT send the SPPP with the signed form.
r Five copies of Analytical Monitoring forms.
■ Five copies of Qualitative Monitoring forms.
■ A copy of a Technical Bulletin on the stormwater program with outlines program components
and addresses frequently asked questions.
■ A corrected Certificate of Coverage if you indicated a name or address change on the Renewal
Form returned to the Division.
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area
Management Act or any other Federal or Local governmental permits that may be required.
