(GTA) is submitting this notification of benchmark exceedance for the fourth consecutive sampling event at the Select Stainless Products, LLC (SSP) facility located at 11145 Monroe Road, Matthews, North Carolina, 28105. GTA has assisted SSP with the monthly stormwater sampling at SSP facility outfalls SW-1 and SW-2. During stormwater collection, no evidence was found of an impact to stormwater around the trash bins, metal scrap waste bins, wood waste pile, or trash compactor bin. The loading lock areas were clean and not stained. Additionally, in July and August., GTA collected two additional stormwater samples from two different offsite sources in an attempt to confirm the presence of offsite impacts. The offsite sample locations are illustrated on the attached figure. The sample results from the four previous sampling events with the offsite data is summarized on the attached table. A possible likely source may be runoff from the corrugated galvanized steel manufacturing building, galvanized roof drains, or the galvanized fencing. No other sources were suspected to elevate the zinc to exceed the range was found during the inspection. During sample collection, the stormwater discharge outfalls were inspected. No evidence was identified of any non-stormwater impacts at the outfall locations. GTA and SSP recommend to continue with monthly sampling in order to monitor the zinc levels at the outfalls. If elevated levels of zinc continue to be present, additional best management practices will be fulfilled. This letter transmits GTA's findings. I see from our database that we issued the permit coverage in August of 2015, and so I assume that the October 27, 2015 event was your first semi-annual sampling event. Thank you for the pro -active response of the four additional, voluntary, samples. - Although your letter doesn't specifically report it, I assume that you filled out the required Discharge Monitoring Report form (DMR) for just the two samples and sent it to the address listed both in the permit and on the DMR itself. Please note that the permit only requires you to submit the filled out DMR: you are not required to provide a commentary letter.. We will file your December 7 letter separately from the DMR, in an abbreviated permit file that we keep for ready access. It may be a useful record in the future. Concerning vour neighbor Stronghaven referenced in vour letter, and other surrounding conditions reported to me b Mr. Gilbert: • First, we observe this underlying principle with all of our permittees: we do not seek to make you responsible for your neighbor's polluted runoff. It may be that Stronghaven is the source of the metals exceedances as you have suggested. Mr. Gilbert also reported that your property is the lowest in the immediately surrounding developed area, and that runoff from the street and driveway flows down to your property. For both of these potential other sources, we do not seek to make you responsible for anything other than the pollutants generated or potentially generated on your facility. It may be exactly as your letter suggests that Stronghaven is primarily responsible for the metals exceedances. However, from our perspective we are not yet prepared to agree with that conclusion. We may eventually agree with it, but we consider that the evidence presented to us so far is not sufficient for us to reach that conclusion. Our difficulty in agreeing immediately is based on the following: o Consider the general industrial activity at the two facilities: Stronghaven is a packaging company. You are a metal fabrication company. It seems to us more likely that copper and zinc pollutants could be generated at your facility than at Stronghaven. We could be wrong, of course, based on the particulars of the processes and materials at each facility. But, no evidence or explanation has been advanced to contradict our expectation, yet. o Consider the data set provided to us: A single set of points from two separate events. From our perspective this is not a data set that we can take by itself and extrapolate to any conclusion. Typically we see stormwater analytical results that can vary a great deal, with the consequence that multiple samples are necessary to understand the broader picture of stormwater pollution. o We do not yet understand the stormwater subdrainage areas feeding the two outfall points; we do not understand the features of the stormwater conveyances; we do not understand the industrial processes inside your facility. A. o From the Google Maps aerial photo I note air pollution control equipment at both facilities. In our perspective these units can be suspected as stormwater pollution sources if the maintenance or operation of them results in spillage on the ground. But, the fact that we are not ready to agree today should not be discouraging. The permit provides for recurring samples every six -months, with the potential for additional monthly sampling if those results are not what we hope. Our sampling requirements are intended to gather data to help us reach a conclusion: maybe to identify a source, or the magnitude of the problem, or an easy remedy. We do not anticipate continuing monthly sampling without a specific purpose behind that sampling. We have the authority to release you from monthly sampling after an initial data set is established and once it becomes clear that there is no benefit from the continued sampling. My point is that the monthly sampling requirement is not intended to be an on -going condition of the permit. We hope to reach some other resolution. Based on the copper and zinc benchmark exceedances you are now in Tier 1 at both outfalls. Please review the required response actions as outlined in the Tier 1 box in your permit and follow through with them. Presumably your next sampling event will be sometime in the period of Jan 2016 —June 2016. One last explanation about the benchmark exceedances. It is important in our program that our permittees understand that the exceedance of a numerical benchmark is not, in and of itself, a permit violation. We state this clearly in the text of the General Permit. A benchmark exceedance alone is not a valid basis for any enforcement action on our part. A benchmark is sort of an 'action level' flag for site management. We want you to make a feasible response as per the Tier structure when a benchmark exceedance occurs. That's it. However, what would be a permit violation is the failure to step through the Tiered structure as outlined in the permit text. Please continue to abide by the conditions of the permit. (GTA) to assjsL4A4e semi-annual stormwater sampling at our Matthews, NC facility. The sampling is required er the Div 'on of Water Quality General Permit No. NCG030000. SSP's Certificate of Coverage No NCG030663. GTA collected samples at the facility from the two permitted outfalls (SW-1 W-2, sh as permit outfalls in attached Site Drainage Map) on October 27, 2015. The results of this sampling event (summarized in Table 1) indicate that S W-1 was in exceedance of the DEQ benchmarks for both copper and zinc, with levels of 0.134 mg/L and 1.38 mg1L respectively. SW-2 was in exceedance of the DEQ benchmark for zinc with a concentration of 8.24 mg/L. Tier 1 tasks, as outlined in NCG03000, were subsequently completed by SSP/GTA. GTA also collected additional stormwater samples on November 18, 2015 in an effort to determine the source of the exceedances. Four (4) samples were collected and analyzed for copper and zinc. The locations of the additional sampling sites (SW-1 through SW-4) are displayed in the attached Site Drainage Map, (the labeling of these sampling sites does not correspond with the original permitted SW-1 and SW-2). Sampling point SW-1 was selected because of its location immediately down gradient of SSP's neighboring facility, Stronghaven Containers Company (SCC). Locations SW-2, SW-3, and SW-4 were chosen to track the metal concentrations along the southern and eastern sides of the SSP facility. The results of the additional sampling are summarized in Table 2. The stormwater collected from SW-1 (immediately down gradient from SCC) registered the highest concentrations of both copper and zinc, with readings of 0.034 mg/L and 1.13 mg/L respectively. After analyzing the sampling results and inspecting the surrounding topography, it is SSP's opinion that the neighboring SCC facility appears to be the primary contributor to the excessive metal concentrations detected in the stormwater runoff. SSP intends to continue in 2016 with its semi-annual stormwater sampling and will advise DEQ of subsequent sampling results.
