Dear Ms. Lucas:
On behalf of Orbit Energy Charlotte, LLC, Hart & Hickman, P.C. (H&H) is submitting the
enclosed Notice of Intent for coverage under the General Permit NCG060000 for the food waste -
to -energy site referenced above. The facility formerly obtained a No Exposure Exclusion
(NCGNE1102), but no longer qualifies for the exclusion and requests coverage under the
General Permit NCG060000. H&H understands that food waste -to -energy facilities have
previously obtained coverage under this General Permit. Waste is handled in the reception
building and is contained in tanks and piping after that point.

processed, digested and converted to biogas used to run generators which produce electricity that is sold to
the power grid. Wastewater is pre-treated onsite prior to being discharged to the sanitary sewer system.
Digestate is dned onsite and transferred offslte to be used as a soil amendment.
