VAN DER VAART Secretary TRACY DAVIS Director Subject: NPDES Stormwater Permit Permit No. NCS000546 Minor Revision Allen Steam Station Gaston County Dear Mr. Dueitt: The Division of Energy, Mineral, and Land Resources' Stormwater Program received your request to revise permit no. NCS000546. The Division has reviewed and approved your request. This modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This modification includes the following changes from your current permit: A minor modification to the permit, pages 6 of 16, 7 of 16, and 8 of 16, to indicate that aoutfall SWO13-03 will remain, but the area that feeds it is no longer industrial. For the other outfalls I mentioned below a portion of their inlets will be removed, and the remaining pipe will have a concrete plug to prevent any water from entering the pipe." Since Allen Steam Station has not had any detections of PCB's since the issuance of the permit, DEQ has removed the requirement to test for PCBs. If any parts, measurement frequencies, or sampling requirements contained in this modification are unacceptable to you, then you have the right to file a petition for a contested case with the Office of Administrative Hearings within thirty (30) days following receipt of this letter. This petition must conform to the requirements of Chapter 150B of the North Carolina General Statutes. Petitions must be timely filed with the Office of Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 27604. If you do not file a petition within the required time, the agency decision shall be final and binding. This permit is not transferable except after notice to the Division. Part III, B.2. addresses the requirements to be followed in case of change in ownership or control of this discharge. This permit modification does not affect the legal requirements to obtain other permits which may be required by this Division, or permits required by the Division of Water Resources, Coastal Area Management Act, or any other federal or local governmental permit that may be required.
