Dear Mr. Whitt:
This letter is in response to your October 12, 2018 letter notifying the Division of the anticipated
bypass of Martin Marietta's wastewater treatment systems at the Rocky Point Quarry due to river
flooding from Hurricane Florence. NPDES Industrial General Permit NCG020000 allows for
anticipated bypasses when:
• Bypass is unavoidable to prevent loss of life, personal injury or severe property damage,
• There are no feasible alternatives to the bypass, such as the use of auxiliary treatment
facilities, retention of untreated wastes or maintenance during normal period of
equipment downtime or preventive maintenance, and
• The permittee has submitted notices as required by the permit.
Based on the information provided in your notification, the Division concludes the following:
1. The anticipated bypass is unavoidable to prevent severe property damage due to the
prolonged flooding of the quarry and the equipment located therein.
2. There is no feasible alternative to the bypass because it is not possible to process the large
volume of water in the quarry (up to 1.5 billion gallons) through the normal treatment
protocol in a practical timeframe.
3. The extended submersion of the site that would be required to process the water through
the normal treatment protocol would severely damage or destroy the equipment in the
quant' pit. In addition, the volume of water is in excess of what the pumps can handle.

4. Based on quarry water sample results collected on October 4, 2018 showing pH, Total
Suspended Solids and Turbidity well within and below permit benchmarks, there should
be minimal to no adverse effects from the bypass.
5. Proper notice of the anticipated bypass was submitted per NCG020000 permit
requirements.
Therefore, the Division is approving, on an emergency and temporary basis, the staging of
multiple pumps around the quarry when conditions allow, and discharge of the flood
waters directly from the quarry to the Northeast Cape Fear River until normal water levels
are observed in the quarry.
As part of this approval, Martin Marietta shall submit to the Division bimonthly updates on
progress towards resumption of normal treatment systems, until and including when normal
water levels are observed in the quarry and the bypass has concluded. Updates may be sent via
email directly to Annette.Lucas(a ncdenr.gov.
