Dear Sir/Madam:
On behalf of Graham County, Municipal Engineering Services Company, P.A. requests that the subject Permit be
rescinded because the Permit is not applicable to activities performed at this facility. The facility is primarily a non-
hazardous solid waste transfer station that has small areas that temporarily stores metals that are recycled by others
off-site. The metals that are stored consist primarily of white goods and aluminum cans which are by NC Law and
conditions of the transfer station Permit banned to be disposed of in landfills. This small facility is not "primarily"
engaged in the "trade" of assembling, breaking up, sorting, and wholesale trade of scrap metal. Rather the storage
of metals is a not for profit endeavor that is necessary to comply with State and NCDEQ laws/regulations. This
facility categorically falls under SIC Code 562111 (Non -hazardous sold waste transfer station) and not SIC 5093
(Wholesale trade of scrap and metal waste) for which the Permit is applicable.
We understand that a follow up field inspection is scheduled at the facility on September 23, 2018; therefore, an
expedited determination would be beneficial for all.
