Return #1318 Harnett County Dear Mr. Schall: We received your application for an NPDES discharge permit on June 25, 2018. On July 30, 2018, Mike Lawyer with the Fayetteville Regional Office conducted a site visit to determine whether or not coverage under Stormwater General Permit NCG200000 was necessary. It was concluded that the stormwater outfalls listed on your NOI application are not distinct point source discharges of stormwater. As Mr. Lawyer discussed in his follow-up letter, the areas were observed to be discrete sites of internal erosion/washes that were well within the property boundary and did not appear to convey stormwater discharges to waters of the state. With this letter, your application is being returned to you. Please be advised that if the State determines that discharges from this site contribute to a water quality standard violation or are a significant contributor of pollutants to waters of the U.S., the Department of Environmental Quality (DEQ) is authorized to require a discharge permit. If operations at your facility change such that an NPDES stormwater discharge permit is required, then you must submit an application and receive permit coverage prior to any discharge. The return of this application does not affect the legal requirements to obtain other permits which may be required by the Division of Energy, Mineral, and Land Resources, or permits required by the Division of Water Resources, Coastal Area Management Act, or any other federal or local governmental permit or approval that may be required.
