The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater
Management Permit Application for the subject project on October 19, 2017. A preliminary
review of that information has determined that the application is not complete. The following
information is needed to continue the stormwater review:
The DA and total impervious is not consistently shown between the application form
(Storm -EZ) and the calcs. The pond DA on storm-ez is showing around 2x the DA
shown in the calcs. Storm -EZ has not been updated to be consistent with the new
Minimum Design Criteria (MDC) for SCM design. Please instead use the SWU-101
application form and supplement form. Doing so should help resolve the inconsistency

2. Provide a completed pond supplement using the new Supplement EZ form available from
our website ht tps:Hdeq.nc.gov/about/divisions/energy-mineral-land-resources/energy-
mineral-land-permit-guidance/stormwater-bmp-manual
3. Provide supporting calcs for the WQv shown.
4. C2.5: Revise the notes and list to specify that trees and woody shrubs are not allowed per
the MDC's on the dam section. A revised plan list is provided in C-3 of the manual.
5. Revise the references in the calcs and plans to be consistent with the new rules in the
NCAC and the new SCM Design Manual. Many of these were re -numbered as of
1/1/2017.

6. Note that the pond average depth calculation options have been revised in the rules and
manual.
7. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other
documents. Pdfs must be uploaded using the form at:
htips:Hedoes.deg.nc.gov/ForTns/SW ProjectSubmittal
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to December 9, 2017, or
the application will be returned as incomplete. The return of a project will necessitate
resubmittal of all required items, including the application fee.
If you need additional time to submit the information, please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
