B. of the September 29, 2015 Settlement Agreement between Duke Energy and the North Carolina Department of Environmental Quality, Duke Energy is required to implement accelerated groundwater remediation at the Asheville and Belews Creek stations. Plans have been developed and work is underway to comply with this requirement. Duke anticipates a need to begin groundwater extraction in support of accelerated remediation in the fourth quarter of 2017 in order to comply with the agreement. It currently appears that this may occur before renewed NPDES permits will be finalized for either site Until NPDES permits can be finalized, Duke Energy request written concurrence of our previously discussed understanding that groundwater extracted for the purpose of complying with the terms of the subject agreement, can be routed to the ash basin system and/or released through permitted outfalls under existing NPDES permit coverage. This follows the approach in the Settlement Agreement, where discharge to either the ash basin or a permitted outfall is explicitly authorized/recognized at Sutton. The release of this water will not significantly change the characteristics of the discharge and will not result in flow volumes in excess of volumes previously released. Maximum Design flows for extracted groundwater at Asheville are 0.1296 MGD. The well data that is most applicable for evaluation of what is to be extracted at Asheville is found in well EXT-Olon the attached The design flows for the groundwater extraction system at Belews Creek are 0.072 MGD. The well data that is most applicable for evaluation of what is to be extracted at Belews is found in well cluster GWA-20 on the attached. Both the Asheville and Belews Creek systems can operate in a variable mode and will not operate if there is no yield in the well. If no permitting pathway for the release of extracted groundwater is allowed, Duke Energy's ability to implement expedited groundwater remediation at these sites will be materially impaired Thank you for your attention to this request.
