REGAN Secretary S JAY ZIMMERMAN Director May 25, 2017 Mr. Shannon Langley EHS CCP Environmental Programs Duke Energy 410 South Wilmington St. Raleigh, North Carolina 27601 Subject: Alternate Outfall Locations #2 NPDES Permit NC0004774 Buck Combined Cycle Station Rowan County Dear Mr. Langley: In response to our recent discussions and your letter of March 29, I am writing to confirm that the Division fully intends to include provisions in the draft Buck permit that authorize the discharge of treated ash pond waters to the Yadkin River at the existing Outfall 002 and to the mainstem of the river at a new Outfall 007 to be installed at a point approximately due north of Outfall 002. Permit conditions for the outfalls will set forth necessary limitations and other requirements to ensure the protection of water quality and conformance with applicable regulations. The draft permit will be subject to public review and could be revised in response to comments received. However, we believe that the discharge will have less environmental impact at the new outfall locations than at the existing Outfall 002 due to the increased dilution available in the mainstem of the river.
