The results of our services are presented below. PROJECT BACKGROUND TEC was contracted by Dogwood LD to perform a jurisdictional delineation to identify potential Waters of the US (WOTUS) including wetlands and streams. The overall property is identified as Lenoir County PIN 3596-02-8308 totaling approximately 110 acres. It is our understanding that the property owner intends to construct a sand mine on a portion the property on the southwest side of Falling Creek Road, and that our delineation will be used to help determine the footprint of the sand mine. A site plan prepared by Dogwood LD was provided to us which identified this portion of the property as totaling approximately 80 acres and contains portions of an agricultural field and undeveloped woodland along Cabin Branch and Falling Creek (Figure 1). METHODOLOGY We reviewed the site for the presence of potential Waters of the US (WOTUS), including jurisdictional wetland, non-jurisdictional wetland and streams using the U.S. Army Corps of Engineers (USAGE) 1987 Wetland Delineation Manual and appropriate Regional Supplement, 2023 WOTUS definition, USACE Regulatory Guidance Letter 05-05 Ordinary High Water Mark (OHWM) Identification, and North Carolina Division of Water Resources (NCDWR) Stream ID Manual. Wetland boundaries were marked with blue and white striped flagging and those flags were located with non-survey grade, sub-meter accurate global positioning system (GPS) equipment. A General WQC follows the same review period as the corresponding NWP. NCDWR has 180-days to issue an Individual WQC. The project site is located in the Neuse River basin which has riparian buffer protection rules that apply to any stream feature that appears approximately on a county soil survey map, United States Geological Service (USGS)topographic map, or other approved hydrography maps. Based on this, we expect the buffer rules to apply to SA (Cabin Branch) and SB (Falling Creek). The riparian buffer extends 50 feet from the top of bank of such streams and development activities within the buffer are limited. For mining activities, the following guidance is provided in 15A NCAC 02B.0714 (11)Table of Uses: • Mining activities that are covered by the Mining Act are deemed allowable upon authorization provided that new riparian buffers that meet the requirements of Items (8)and (9) of this Rule are established adjacent to any relocated channels. Item 8 details the two zones within the buffer and Item 9 pertains to diffuse stormwater flow through the buffer; • Mining activities that are not covered by the Mining Act OR where new riparian buffers that meet the requirements of Items (8) and (9) of this Rule are not established are deemed allowed with mitigation upon authorization; and • Wastewater or mining dewatering wells with approved NPDES permit is deemed allowable. If encroachment into the 50-foot buffer of either SA or SB is proposed,then coordination with NC Division of Water Resources for buffer protection permitting may be required. Water is pumped from onsite pits to other onsite pits or either pumped directly into the dewatering infiltration basin that is designed and constructed at the point of discharge. There is only one basin for the entire mine permit and it is used intermittently throughout the year. The pumping operations will consist of a 2,000 gpm mobile sump pump. Any dewatering groundwater over 100,000 gaUday is required to maintain records with the NC Coastal Plain Capacity Use Area monthly reporting in which this permit applies. There are no residences within 500-ft of the property so no private wells will be affected. There are wetlands downstream but the depth of the water will not be drawdown deep or permanently. The intent of the dewatering basin to be used as a waterfowl impoundment. The discharge outlet is a spillway shown per the plans that will surface dewater only during rainfall events and some intermittent pumping. The property is along Cabin Branch of Falling Creek off the Neuse River(C;Sw; NSW 27-77). Any discharges that leave the settling basin flow in a non-erosive manner through rip-rap prior to entering the existing wetlands and stream downstream.
