Upon review of the SIC Code's designation and OSHA's SIC Manual, this code is more appropriate for operations that provide transportation services "to the general public or other business enterprises." Frito-Lay operates a private fleet and does not provide transportation services to other business enterprises or the general public. Rather, at the facilities, Frito-Lay is engaged in the wholesale distribution of its own products, which include potato chips, corn chips, and popcorn. Therefore, SIC Code 5145 and NAIC-S Code 424450 more accurately describe the primary business purpose of this facility. These codes apply to "establishments primarily engaged in the wholesale distribution of confectionery and related products, such as . . . popcorn . . .potato,corn, and similar chips." Therefore,we are writing to inform you that we are changing the primary SIC Code for the facilities below to 5145/NAICS Code 424450.As the state of North Carolina's NPDES industrial stormwater program does not include SIC Code 5145 in the list of covered industrial activities, we will not be renewing the below- referenced stormwater permits. Please know that Frito-Lay takes its environmental compliance obligations seriously and will continue to implement stormwater best management and maintenance practices at the facility.
