As noted by AIA personnel, manholes belonging to the County and damaged in the course of mowing were identified as major inflow points. Repairs to these locations have been completed. A Notice of Violation and Assessment of Civil Penalty, dated October 9, 2025, was sent to the Town regarding a review of the Discharge Monitoring Report submitted by the Town in March 2025. The details of the violation which relate to the pulling of samples of Nitrogen and Phosphorus, and the Town's Response, dated October 22, 2025 are attached. Once we were advised that the Nitrogen, Total — Concentration and the Phosphorus, Total — concentration had not been sampled during the first quarter we reached out to Waypoint Analytical to make sure that they were sending the correct sampling requirements per our permit and to make sure that Nitrogen, Total — Concentration and the Phosphorus, Total — concentration were added for the second quarter and so. Please see the attached sampling reports that show that the required samples are being done each quarter. The schedule for the quarterly samples are February, May, August, and November of each year. This assessment is based upon the following facts: a review has been conducted of the Discharge Monitoring Report (DMR) submitted by Town of Righ Square for the month of March 2025. This review has shown the subject facility to be in violation of the discharge limitations and/or monitoring requirements found in NPDES W W Permit No. NC0025437. The violations, which occurred in March 2025, are summarized in Attachment A to this letter. Based upon the above facts, I conclude as a matter of law that Town of Rich Square violated the terms, conditions or requirements of NPDES W W Permit No. NCO025437 and G.S. 143-215.1(a)(6) in the manner and extent shown in Attachment A. Manuel, Assistant Regional Supervisor, Raleigh Regional Office hereby make the following civil penalty assessment against Town of Rich Square: $26.00 for 1 of the I failures to properly monitor Nitrogen, Total - Concentration in violation of Permit No. NC0025437. 26.00 for 1 of the 1 failures to properly monitor Phosphorus, Total (as P) - Concentration in violation of Permit No. NC0025437. 52.00 TOTAL CIVIL PENALTY 104.21 Enforcement Costs 156.21 TOTAL AMOUNT DUE Pursuant to G.S. 143-215.6A(c), in determining the amount of the penalty I have taken into account the Findings of Fact and Conclusions of Law and the factors set forth at G.S. 143B-282.1(b), which are: (1) The degree and extent of harm to the natural resources of the State, to the public health, or to private property resulting from the violation; (2) The duration and gravity of the violation; (3) The effect on ground or surface water quantity or quality or on air quality; (4) The cost of rectifying the damage; (5) The amount of money saved by noncompliance; (6) Whether the violation was committed willfully or intentionally; (7) The prior record of the violator in complying or failing to comply with programs over which the Environmental Management Commission has regulatory authority; and (8) The cost to the State of the enforcement procedures. Within thirty (30) days of receipt of this notice, you must do one of the following: (1) Submit payment of the penalty, OR (2) Submit a written request for remission, OR (3) Submit a written request for an administrative hearing Option 1: Submit payment of the penalty: Payment should be made directly to the order of the Department of Environmental Quality (do not include waiver form). Payment of the penalty will not foreclose further enforcement action for any continuing or new violation(s). Requesting remission is not the proper procedure for contesting whether the violation(s) occurred or the accuracy of any of the factual statements contained in the civil penalty assessment document. Because a remission request forecloses the option of an administrative hearing, such a request must be accompanied by a waiver of your right to an administrative hearing and a stipulation and agreement that no factual or legal issues are in dispute. Please prepare a detailed statement that establishes why you believe the civil penalty should be remitted, and submit it to the Division of Water Resources at the address listed below. In determining whether a remission request will be approved, the following factors shall be considered: (1) whether one or more of the civil penalty assessment factors in NCGS 143B-282.1(b) was wrongfully applied to the detriment of the petitioner; (2) whether the violator promptly abated continuing environmental damage resulting from the violation; (3) whether the violation was inadvertent or a result of an accident; (4) whether the violator had been assessed civil penalties for any previous violations; or (5) whether payment of the civil penalty will prevent payment for the remaining necessary remedial actions. Please note that all evidence presented in support of your request for remission must be submitted in writing. The Director of the Division of Water Resources will review your evidence and inform you of his decision in the matter of your remission request. The response will provide details regarding the case status, directions for payment, and provision for further appeal of the penalty to the Environmental Management Commission's Committee on Civil Penalty Remissions (Committee). Please be advised that the Committee cannot consider information that was not part of the original remission request considered by the Director. Therefore, it is very important that you prepare a complete and thorough statement in support of your request for remission. The town entered a Special Order by Consent (SOC) with the Environmental Management Commission on March 26, 2025, to address issues associated with the noncompliance with permitted limits. As required by the conditions of the SOC, the Town is hereby submitting a required 180-day treatment unit investigation to provide the Department of Environmental Quality and the Environmental Management Commission of an evaluation of improvements made to the treatment facility. This information was formulated by the Wastewater Training & Technical Assistance division of the North Carolina Rural Water Association, with the assistance of representative Richard Davis, and is based on his continued visits to the facility along with discussions with the town staff. Additionally, this 180-day treatment unit investigation utilized information obtained from Engineering Sbrvices, PA of Garner, NC which serves as the town's consulting engineering representative. A review of construction progress information and a recent review of laboratory data for validation of permit compliance was also made. • Solids Management Plan. Solids removal efforts have been completed and measurements of sludge depths in the lagoon were made with a total of 148 dry tons of solids removed. It is estimated that this effort resulted in the removal of more than 10-15% of the lagoon solids. Measurements of the remaining lagoon depths have been made, and priority is being determined for plans for future sludge removal. The town continues to review sources and methods for future sludge removal and instituting a preliminary program to address solids inventory and removal. There was no evidence of solids flowthrough when inspection was made, and records indicate no overflow of solids have been present. • Headworks Improvements: Equipment identified as part of the headworks has been completed along with installation, start-up and testing and have resulted in acceptable operational demonstrations. Staff training in equipment operations and maintenance continues for the equipment currently installed and will follow-up with further development of refined standard operating procedures and related equipment maintenance service programs which is based on manufacturers manuals. • Floating Aerators: All surface aerators are operational and have been installed along with associated power cables and control equipment. Initial start-up testing and training has been completed with completion of initial service maintenance. The staff have participated in both operations strategies and maintenance procedures. Information obtained from the equipment maintenance documents continues to be utilized to develop a written planned program ensuring that maintenance and operations are provided for each aerator to ensure longevity and service life. Presently, additional on -site procedures specific to the controllers are in place for the removal of accumulation of fibers from the aerators, which is a major factor in extending the service life of aerators. Operational experience will be used to develop and improve reliability and operation of the floating aerators. • Chemical Feed Systems and Chemical Storage. Coverings to chemical storage tank site location and protective coverings have been made to provide for and mitigate climate effects. Strategies for chemical feed rates have been developed to provide for a more adequate feed of chemicals which will enhance permit compliance. These efforts will assist with purchase agreements that ensure continual chemical availability without degradation to chemical quality. Initial training and procedure development for the use of the chemical feed equipment continues and operations staff are actively involved in adjusting chemical feed rates to meet treatment goals of disinfection and pH control with flow changes. The town will continue to partner with the NC Rural Water Association for training in development of procedures to ensure a plan is created to address concerns related to safety, spill containment and adequate chemical storage are attained on a continual basis. Conclusion, this 180-day evaluation reflects the positive outcomes of construction planning and construction efforts, along with operational activities, needed to abate previous deficiencies that resulted in noncompliance with the NPDES permitted limited. Completion of the current contract is expected soon and will provide an expected improvement to treatment levels with a high level of confidence in meeting permitted performance. Fats, Oils, and Grease Program (FOGS) — Please find enclosed a copy of the Town of Rich Squae's website under the Water tab the information about F.O.G.S. and the paper notice that was disbursed to citizens at our August 7' and October 2nd Board Meetings. 3.Operations and Maintenance Plans — We are working with Richard Davis of NCRWA to assist the Town Public Works Department with creating a preventative maintenance schedule along with a spare parts inventory list, an Operation and Maintenance Plan for each pump station, and an Overflow Response Plan. 4. Pump Stations Inspected a. Pump Station #1 between Walnut and W Jackson Streets o The individual pump station capacity is 260 gpm at 61 ft TDH The Town is working diligently to verify the costs to replace and/or make repairs to the pumps in the sewer lift station. Due to the retirement of the long-time Finance Officer and the recent termination of the replacement Finance Officer the Town Board nor the ORC were not made aware of the declining financial issues that the Water/Sewer Department has been facing until after the recent change in Finance Officers and the completion of the 2022 fiscal year-end audit that was submitted September 2025. The Town has an AIA Project Grant that is currently being completed on the entire sewer system, the pump stations, lift stations, utility holes, sewer lines, force mains, and Wastewater Treatment Plant which will help establish several of the items needed for future inspections as well identify emergency needs and repairs. Pump #2 does meet the peak flow capacity to prevent an overflow from the collection system. The town has purchased En -Solt' a degreaser to assist with the high amounts of grease and debris build up on the walls of the wet -well. The Town Public Works staff will be making a schedule to clean the walls of the wet -well monthly. The Town is working diligently to verify the costs to replace and make repairs to the high-level alarm at the sewer lift station. b. Pump Station #2 Roberts Road e The individual pump station capacity is 425 gpm at 70 ft TDH. o Pump #1 does meet the peak flow capacity to prevent an overflow from the collection system. o The town has purchased En-Soly a degreaser to assist with the high amounts of grease and debris build up on the walls of the wet -well. The Town Public Works staff will be making a schedule to clean the walls of the wet -well monthly. The Town is working diligently to verify the costs to replace and make repairs to the high-level alarm at the sewer lift station. o The reason for the high-level alarm at this pump station was due to the light having a possible short and we are working on getting it repaired. c. Pump Station #3 Hwy 305 s The individual pump station capacity is 60 gpm at19 ft TDH. a Per quote attached for pump station #3 an air brake will need to be installed between the wet well and junction box among other issues to assist with pump #2 being able to be placed in automatic mode. d. Pump Station #4 Park Street • The individual pump station capacity is 120 gpm at 25 ft TDH. • Both pumps are operating to meet the peak flow capacity to prevent an overflow from the collection system. c The town has purchased En -Sole a degreaser to assist with the high amounts of grease and debris build up on the walls of the wet -well. Pump Station Telemetry/SCADA — The Town is currently investigating the cost to either get the Roco Guard -it Dialers operational or replacing them per the attached quotes. We are also petitioning NC State Representative Rodney Pierce and Congressman Don Davis for state allocated funds to assist in making the much -needed repairs and to assist with the monitoring of the pump station operations and alarms. 6. Pump Station High Water Alarms —As listed in each pump station the Town is working on getting the financial assistance to help make the much -needed repairs to each of the pump stations. The Town is on the Distressed Units assistance list with the ND DEQ DWI and is on the UAL from the LGC for being 3 years behind on its fiscal year end audits. 8. Designated Operators — Jeffrey Long has been the ORC since he has been employed at Rich Square not sure as to why the information is not in your system. (B) For privately owned collection systems, the Grease Control Program shall include biannual distribution of grease education materials to users of the collection system by the permittee or its representative. (C) Grease education materials shall be distributed more often than required in Parts (A) and (B) of this Subparagraph if necessary to prevent grease -related sanitary sewer overflows. 3. Operations and Maintenance Plan. Inspection and maintenance logs are maintained for each pump station and regular daily inspections appear to be conducted. Overflow response plan and pump station contingency plans were not available for review. A preventative maintenance schedule along with a spare parts inventory list were not available for review. Develop an operations and maintenance plan for each pump station to help ensure reliable system operations. Develop an overflow response plan and include spill reporting procedures, response times, and cleanup procedures for sewer overflows. One mobile generator is available for emergency power backup for the pump stations. The pump stations have a quick -connect fitting for generator hook-up. No records of gravity sewer line cleaning were available for review.
