Pursuant to provisions of North Carolina General Statutes (G.S.) 143-215.2 and
143-215.67,this Special Order by Consent is entered into by the Town of Maysville,hereinafter
referred to as the Town, and the North Carolina Environmental Management Commission, an
agency of the State of North Carolina created by G.S. 143B-282,and hereinafter referred to as
the Commission:
1. The Town and the Commission hereby stipulate the following:
(a) The Town holds North Carolina NPDES Permit Number NC0021482 for operation of an
existing wastewater treatment works and is permitted to discharge treated wastewater to White
Oak River, Class C waters of this State in the White Oak River Basin. The Town needs to
reduce and adequately treat high flows from excessive infiltration and inflow.The Town is
currently in noncompliance with permit conditions and limits for flow,Ammonia Nitrogen, Total
Residual Chlorine and Dissolved Oxygen. Compliance will require preparation of plans and
specifications for construction and operation of additional treatment works and an evaluation of
their collection system to reduce infiltration and inflow.
(b) Noncompliance with the Permit constitutes causing and contributing to pollution of the
waters of this State named above, and the Town is within the jurisdiction of the Commission as
set forth in G.S. Chapter 143,Article 21.
(c) The Town desires to cause or allow the discharge of 0.01 MGD of additional wastewater to
the treatment works, and the discharge of such additional wastewater will not result in any
significant degradation to the quality of any waters. The nature of the additional flows is such
that the waste characteristics do not exceed those generally associated with domestic waste or are
pretreated to domestic strengths. Waste of greater than normal domestic strength will not be
approved for discharge. As part of the request for any additional wastewater other than the
10,000 gpd, the Town must demonstrate that there is no net increase in flow and the
discharge of such additional wastewater will not result in any significant degradation to the
quality of any waters. Provide the Washington Regional Office of the North Carolina Division
of Water Resources (DWR), located at 943 Washington Square Mall, Washington,NC 27889,
with a list of all additions of flow under the Town's Special Order by Consent,and update this
list each time flow is added to the system.
(d) The Town has secured a grant or has otherwise secured financing for planning, design,or
construction of a new or improved waste system and new disposal system which,once
constructed and operated,will be sufficient to adequately treat wastewater presently being
discharged,to such an extent that the Town will be able to comply with final effluent limits.
(e) Since this Special Order is by Consent, neither party will file a petition for a contested case
or judicial review concerning its terms.
2. The Town desiring to comply with the Permit identified in paragraph 1(a) above,hereby
agrees to do the following:
(a) Undertake the following activities in accordance with the indicated time schedule:
1) On or before March 1 2023, begin repairs of the collection system to reduce
infiltration/inflow which will include replacement of 1600 linear feet of 8
inch gravity sewer, 50 linear feet of 10 inch gravity sewer and the
rehabilitation of twenty manholes. (Met)
2) On or before June 1,2023, submit complete plans and specifications and
any applications for necessary permits or permit modifications to address
necessary wastewater treatment plant improvements. (Met)
3) On or before January 1,2025, begin construction of the proposed
wastewater treatment plant and disposal system modifications. (Met)
4) On or before April 1,2024,complete repairs identified in item 1 above.

5) On or before January 1,2027, complete construction.
6) On or before May 1,2027, achieve compliance with all final permit effluent
limits and permit conditions.
7) The Town will submit quarterly progress reports detailing the work and
activities undertaken and complete on the upgrades to the wastewater
treatment plant or collection system. The reports are to be submitted as
follows: one copy must be mailed to the NCDWR Washington Regional
Office,943 Washington Square Mall,Washington,NC 27889,and one
copy must be mailed to the Water Quality Permitting Section/NPDES,
1617 Mail Service Center Raleigh,NC 27699-1617.
The quarterly reports are due in each respective office no later than
thirtieth (301h)day of January,April,July,October for the duration of
this order.
(b) No later than thirty (30)calendar days after any date identified for accomplishment of any
activity listed in 2(a) above, submit to the Director of DWR written notice of compliance or
noncompliance therewith. In the case of noncompliance,the notice shall include a statement of
the reason(s) for noncompliance,remedial action(s)taken,and a statement identifying the extent
to which subsequent dates or times for accomplishment of listed activities may be affected.
(c) Identify any Infiltration and Inflow problems associated with the facility and establish a
program to correct.
(d) During the time in which this Special Order by Consent is effective, The Town shall comply
with interim effluent limitations as contained in Attachment A.
Under this Special Order by Consent, ONLY the parameters listed below have been
modified from the most current NPDES Permit currently in effect.

3. The Town agrees that unless excused under paragraph four(4),Town will pay the Director of
DWR, by check payable to the North Carolina Department of Environmental Quality, stipulated
penalties according to the following schedule for failure to meet deadlines set out in paragraphs
2(a)and 2(b).

4. The Town and the Commission agree stipulated penalties are not due if Town satisfies the
Division,noncompliance was caused solely by:
(a) An act of God;
(b) An act of war;
(c) An intentional act or omission of a third party, but this defense shall not be available if
the act or omission is that of an employee or agent of the defendant or if the act or omission
occurs in connection with a contractual relationship with the Town;
(d) An extraordinary event beyond the Town's control. Contractor delays or failure to obtain
funding will not be considered as events beyond the Town's control; or
(e) Any combination of the above causes.
Failure within thirty(30)days of receipt of written demand to pay the penalties or challenge
them by a contested case petition pursuant to G.S. 150B-23,will be grounds for a collection
action,which the Attorney General is hereby authorized to initiate. The only issue in such an
action will be whether the thirty(30)days has elapsed.
5. This Special Order by Consent and any terms,conditions and interim effluent limitations
contained herein,hereby supersede any and all previous Special Orders, Enforcement
Compliance Schedule Letters,terms,conditions, and limitations contained therein issued in
connection with NPDES Permit No. NC0021482
6. Noncompliance with the terms of this Special Order by Consent are subject to enforcement
action in addition to the above stipulated penalties, including injunctive relief pursuant to G.S.
143-215.6.(C).
7. The Town, upon signature of this Special Order by Consent,will be expected to comply
with all schedule dates,terms,and conditions of this document.
8. This Special Order by Consent shall expire September 1,2027.

EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
During the period beginning on the effective date of the SOC and lasting until expiration,the
Permittee is authorized to discharge treated effluent via Outfall 001. Such discharges shall be
limited and monitored' by the Permittee as specified below:

Footnotes:
1. Limit and monitoring only apply if the facility uses chlorine or chlorine derivatives for
disinfection.
2. The monthly average BOD5 and Total Suspended Residue concentrations shall not exceed
15%of the respective influent values (85%removal).
3. Fecal Coliform shall be calculated using the geometric mean, according to the procedure
detailed in Part II. Section A of the permit.
4. Low level mercury analysis using EPA Method 1631E for all effluent mercury sampling is
required.
Samples shall be taken at the outfall but prior to mixing with the receiving waters.
There shall be no discharge of floating solids or foam in other than trace amounts.
