Good evening. My name is Derek Denard, and I am an Environmental Program
Consultant with the Division of Water Resources in the Department of Environmental
Quality. I will be giving a brief presentation on the draft permit for the Martin
Marietta Materials, Inc. —Vanceboro Quarry.

This map provides us with the facility location in relation to Blounts Bay, the Pamlico
River, and the adjacent geography in the Beaufort county area. The stars represent
outfalls and instream sampling locations for this permit. Outfalls 001, 002 are
represented by these stars. There is an upstream sampling location and there are two
downstream sampling locations.

for the planned quarry (at full development of 50 years) and the approximate facility
boundaries (in the bright yellow line). This map shows a zoomed in view of outfalls

Why does the quarry need an NPDES permit? ■
• The Vanceboro Quarry will produce crushed limestone for the construction
industry.
• The open mine pit will accumulate comingled groundwater and stormwater.

• The mine pit will need to be dewatered by pumping.
Dewaterin = pumping water from a mine pit or excavation.
• The Clean Water Act (CWA) & NC General Statue 143-215.1, requires an
NPDES permit for control of sources of water pollution.

Why does the Vanceboro Quarry need an NPDES permit?
• The Vanceboro Quarry will produce crushed limestone for the construction
industry. Mining is an industry that produces waste streams. These waste streams
require regulation.
• Over time and with the weather, the open mine pit will accumulate groundwater
and stormwater.
Let's define a term. Comingled means the mixing of wastewater, groundwater
& stormwater.
• To continue mining, the pit will need to be dewatered.
Dewotering is a term we use that means pumping water out of a mine pit or
removing water from a construction excavation such as a building basement.
• Most importantly, the Clean Water Act (CWA) and state General Statues require a
discharge permit for sources of water pollution as we have described above.
• Before we move on to the next slide, lets define what NPDES stands for: National
Pollutant Discharge Elimination System.

• October 19, 2011 — Original Application for NPDES Permit
• March 14, 2013 — Public Hearing for NPDES Permit & 401 Water

• July 24, 2013 — Original NPDES Permit Issuance Date
• September 19, 2013 — Petition filed with Office of Administrative
Hearings (OAH)
• September 1, 2023 — NC Supreme Court—Affirmed Court of
Appeals &ALJ Decisions

• The mining permit was issued in May of 2010.
• The original NPDES application was received in October 2011.
• Please note that the previous public hearing for this NPDES was held in
conjunction with the Wetlands 401 Certification in March of 2013.
• The original NPDES discharge permit was issued on July 24, 2013.
• After issuance, the NPDES discharge permit took a 10-year legal journey through
the courts.
• Long story short, the permit was finally affirmed by the North Carolina Supreme
Court decision in September last year (2023).
• Permit Issuance was upheld. This action is for the permit renewal.

Permitting Date & Current Status of NPDES Permit ■
• July 24, 2013 — Original NPDES Permit Issuance Date
• February 27, 2018 — Renewal application was received from Martin Marietta
• August 31, 2018 — Original Expiration Date
• Current Permit Status— Because Martin Marietta submitted a timely renewal
application, the Permit remains in effect pursuant to 15A NCAC 02H .0112,
and Martin Marietta is authorized to discharge under the Permit.

• A few important dates to note for NPDES discharge permits are the issuance date
and the expiration date. In this case the expiration date was August 2018.
• This expiration date occurred during the contested case which wasn't resolved
until much later. Please note that the renewal application was received greater
than 180 days before expiration date.
• In response to the contested case being resolved on September 1, 2023, an
updated permit renewal application was submitted by Marin Marietta on
November 1, 2023.
• Because Martin Marietta submitted a timely renewal application on February 27,
2018, the Permit remains in effect pursuant to administrative code sited here.
• Martin Marietta is currently authorized to discharge under the original Permit. In
other words, the original permit is administratively continued until the renewal
process is completed.

• The permit is drafted, which includes internal peer review.
• The draft is submitted to public notice for a 30-day comment period.
• If a public hearing request is received, the Director of the Division of Water Resources
makes the decision to have a hearing or not have a hearing.
• After the hearing and the close of public comments, a final permit decision is made by the
director within 90 days after comments have closed.
• If the permit is approved, it will have a 5-year duration.

• What do NPDES discharge Permits consist of?
• First of all, let me point out the QR Code for the NPDES Standard Conditions found
on our website. The standard conditions are the same for every individual NPDES
discharge permit issued in North Carolina. We do not typically attach the standard
conditions to the draft permit. They will be attached to the final permit. If you
haven't reviewed these conditions, they may provide more information or an
answer a few questions that you might have.
• The first part of the permit consists of a cover page seen here to the left. This is
from the the original version of this permit.
• After the first page there is a supplement to cover page that includes a
components list and the receiving stream characterizes.
• The next section of the permit includes effluent pages with limits and monitoring
requirements, which also includes instream monitoring that is sometimes arranged
in separate tables.
• Permits also include special conditions.
• We have already talked about the Standard Conditions.

• Pictured on this slide are the approximate locations for the clarification ponds and
outfalls.
• There will be an initial pit in this location to the right and above the upper pond.
• The upper one will be just outside of an initial pit that will be expanded over 50
years to the future footprint of the mine (the red outline).
• The clarification pond will be relocated over time as the pit expands. The permit
specifies as many a two clarification ponds will be in operation at one time.
• The aqua blue dashed line indicates the approximate location of a discharge ditch
that eventually splits into two ditches that discharge as two separate outfalls.
• This divides the total flow into two separate outfalls.
• That is how the permit flow of 12 millions gallons is divided into 6 million gallons.

• The next section of the permit is the effluent limits and monitoring requirements.
• This permit has two identical effluent tables for outfalls 001 and 002.
• The effluent characteristics or parameters include:
• Flow with a daily maximum limit of 6 million gallons per day,
• Total Suspended Solids (TSS) as monitor and report.
• M&R means "monitor and report".
• There is monitoring included for Iron.
• Turbidity has a narrative standard that is given as a footnote.
• Settleable Solids has limits of 1 and 2 milliliters per liter for monthly
average and daily max, respectively.
• Monitoring for Total Nitrogen and Total Phosphors is included because the
stream is classified as nutrient sensitive.
• pH has been given a limitation of 5.5 to 8.5 standard units.
