Wildlands Engineering, Inc. (Wildlands) has reviewed the Division of Water Resources (DWR) comments
dated April 1st, 2024, for the draft Nutrient Offset & Buffer Mitigation Plan for the Hatch’s Hill Mitigation
Bank Parcel. Please note that Wildlands will no longer be applying the Wilmington District Stream Buffer
Credit Calculator for extra wide buffers on the Hatch’s Hill Stream and Wetland Mitigation Site. The tool
was intended for use on the portion of Lee Branch north of Baker Chapel Church Road, and therefore
riparian buffer credits and nutrient offset credits were not proposed along that section of Lee Branch
within the draft Buffer Plan. Wildlands will still not be proposing riparian buffer credits or nutrient offset
credits along this area, as DWR did not assess it for such during the May 31st, 2023, site viability visit.
Furthermore, most of the area is proposed for wetland mitigation credit or is existing forest that is likely
only suitable for riparian buffer credits through preservation. The conservation easement has been
adjusted on this portion and the total easement area has gone from 73.0 acres to 66.0 acres.
The DWR comments are listed below in bold, while Wildlands responses are noted in italics lettering.

a.This was an error. Table 9 is the Project Credit Table. “Table 9 Selected Wetland Tree

b.Some of these tables do not match the table ID in the Plan.
The Buffer Plan was updated to ensure that all tables within the Table of Contents match
the table names listed within the Buffer Plan.
c.The Project Credit Table is labeled Table 9 & 10 in the text, but should only be one
table. Determine if it should be Table 9 or Table 10 and update references throughout
the report accordingly.
The Project Credit Table should be Table 9 and has been updated so that it is shown as
one table. References to the Project Credit Table have been updated throughout the
Buffer Plan to reflect this.
3.Section 2.4
a.Acknowledge that these areas were determined using the existing conditions treeline
survey provided in Figure 7. Is it important to note, that DWR does not recommend
that provider's use aerial imagery to determine treelines at existing condition. If
aerial imagery was used, Wildlands needs to gather a more accurate representation of
the treeline for their existing condition (onsite GPS). This treeline is how your credits
will be determined in the Mit Plan as well as in the AsBuilt Report. The treeline survey

taken for the MP is to be overlayed with the AsBuilt survey on all Combo projects, so
that all existing treelines at pre‐construction represent where the Provider was
allowed to generate "Enhancement & Preservation" vs "Restoration" areas. Since this
is a combo project, it is known that the treeline will disappear in some areas along
stream corridors as part of the restoration plan. Therefore, tree lines at AsBuilt do not
necessarily adequately represent buffer credit assets. Make sure this is done
correctly.
The existing conditions tree line was surveyed at the base of trees and was performed by
a combination of Wildlands staff using sub‐meter accuracy GPS units and Professional
Land Surveyors. Wildlands recognizes that the existing tree lines are used after
construction to determine enhancement credit areas. The following text has been added
to section 2.4: “Livestock exclusion enhancement will be within existing, pre‐
construction, forested areas. Existing forest areas were defined by on‐the‐ground survey
of the existing tree line with sub‐meter accuracy GPS units or by a Professional Land
Surveyor (See Figure 7 for existing tree line survey).”
b. The Project Credit table should not be broken into two tables. It is one table with two
sections. Change the table to only be Table 9 and correct references from Table 10 to
be Table 9.
The Project Credit table is now shown as one table. References to Table 10 within the
Buffer Plan have been updated to refer to Table 9.
c. Acknowledge that these areas were determined using the existing conditions tree line
survey provided in Figure 7.
The following text has been added to Section 2.4: “Riparian Preservation will be within
existing forested areas which were defined by on‐the‐ground survey of the existing tree
line using sub‐meter accuracy GPS units or by a Professional Land Surveyor (See Figure 7
for existing tree line survey).”
4. Section 4.0 – As with most stream and usually most with Wetland sites, a provider will take
good soil from upland areas and use in wetland mitigation credit areas, thus rendering the
uplands with poor soil and lacking in nutrients much needed for tree growth. Since all the
RBCs are proposed outside of wetland areas and in more upland areas, it is concerning that
there isn’t any language describing how the riparian areas will be impacted to achieve
wetland credit. As with older sites, when this happens, trees in the RBC areas tend to have
high mortality, lower heights than normal, and poor soil conditions making it difficult for the
herbaceous layer to become healthy and established. Ultimately resulting in a less than
acceptable riparian condition. What is the providers plan to ensure this doesn’t happen?
Wildlands does not harvest topsoil from upland areas for use in wetland mitigation credit areas
and will not be doing so for Hatch’s Hill. Any areas of grading for the purposes of stream and
wetland mitigation will include the addition of topsoil once grading is complete, however, the
topsoil will be that which was harvested from the graded area and set aside for re‐use. This
practice will ensure that topsoil remains within areas generating riparian buffer credits and
nutrient offset credits. Additional text has been added to Section 4.0.
5. Section 4.2
a. There is also a table on Plan Sheet 6.0.1 showing “Supplemental Planting Zone.” But it
doesn’t look like these trees/shrubs will be planted in the riparian areas generating
buffer and nutrient offset. Please confirm if this is accurate.

That is accurate, the Supplemental Planting Zone does not overlap with any areas
generating riparian buffer credits or nutrient offset credits. The following text has been
added to Section 4.2: “Species planted within areas generating Buffer Mitigation Credits
and Nutrient Offset Credits will only be those listed in the Buffer Planting Zone.”
b. The composition of the species in this table is 100%, but the statement about only
planting 8 species would not yield 100%. Include the 8 that Wildlands intends to plant
if available (include their composition up to 100%) and include the remaining stems as
“possible substitutions” indicating what the composition will be of each substitution
in the case they are used for planting.
Wildlands will plan to plant all 13 species listed in Table 8. Three alternate species and
their compositions were added to Table 8, which are also listed within Plan Sheet 6.0.1.
c. While DWR does appreciate the language regarding 15% will be the max composition
of any one stem planted, and that none will be over 50%, this has been determined to
not fulfill the intent of a proposed planting plan. DWR needs to know the exact stems
and # intended to plan shall all things work in your favor, and then any remaining
stems desired to plant in case there is a need for substitutions. Modify text and table
accordingly and corresponding plan sheet.
Okay. Text that lists 15% as the max composition has been removed from Section 4.2.
Wildlands intends to plant all 13 species with the compositions listed in Table 8.
Alternate species have been added along with their compositions. Plan sheet 6.0.1 has
also been updated.
6. Section 5.1
a. Explain how 13 plots meets the 2% planted area requirement for plots (generating
buffer and nutrient offset)
The following text has been added to Section 5.1 “When the area of the 13 plots is added
together, they equate to 2% of the riparian restoration area generating either nutrient
offset nitrogen credits or riparian buffer credit. The equation used to calculate the
number of plots needed is as follows:
15.4027 acres x 0.02 = 0.3081 acres
0.3081 acres/0.0247 acres = 12.47 vegetation plots”
b. explain this last sentence. usually plots are shared with the USACE when there is a
credit stacking of buffer and stream credits, which is typical within the 0‐50 from top
of mitigated stream banks. According to text in Section 7, there are no non‐std buffer
calcs used on the project except north of Baker Chapel road where no RBC or NOC is
being generated. Meaning no wider buffers >50 are being calculated to generate
more stream credits south of Baker Chapel Rd. Therefore, why would plots beyond
50' be shared with the USACE and their performance criteria overlap with DWR's
performance criteria in those plots? A response to this comment is needed so that i
can confirm that Wildlands is not credit stacking where they are not allowed to by the
USACE
While areas outside of the 50’ riparian zone are not being used to generate extra stream
credit, USACE still requires that Wildlands provide data on the planted areas outside of
50’ if it is within the conservation easement. The same raw vegetation plot data will be
collected for use in the annual monitoring reports at the joint plots, however the
performance standards and reporting requirements will not be the same. The

performance standards for the stream and wetland monitoring reports will align with
the 2016 Wilmington District Stream and Wetland Compensatory Mitigation Update
performance standards and reporting requirements. The buffer and nutrient offset
monitoring reports will follow NCDWR’s performance standards and reporting
requirements.
c. in November providers were allowed to vote for monitoring report changes in what
was required to be collected and reported with each report. Modify this paragraph to
be consistent with the decisions that were made to include Height per Stem per Plot in
Years 1, 3, & 5 and reporting Average Vigor per plot in years 1, 3 & 5. All other
qualitative and quantitative data is required to be submitted each year. However,
since this is a combo project, if Wildlands wants to propose a different plan for
submitting Height and Vigor, that could align with what is required to be submitted to
the USACE, please let me know and explain how that data will be collected and
reported to DWR.
The following text has been added to Section 5.1: “Species composition, height, vigor,
and survival rates will be evaluated by plot during monitoring year 1, 3, and 5. Height
data will be reported per stem, while vigor data is only required to be reported as an
average per plot. During monitoring years 2 and 4 only qualitative data and stem counts
will be required to be reported. During all monitoring years volunteer woody stems will
also be recorded and documented within annual reports.”
7. Section 7.0
a. call this BMP out on the Figure. include a Plan Sheet from the Stream Plan that shows
how this BMP will look, or explain the grading and overall intended AsBuilt condition
of the ditch when construction is completed. it sounds more like Ditch B is going to be
"converted" into a BMP that may will be creating diffused flow ‐ Will the BMP on the
Ditch B actually create diffused flow? If so, then no deduction for non‐diffused flow is
required. Explain...once DWR reviews your response, we can determine if the credit
deduction for non‐diffused flow of Ditch B is necessary or not.
Referring to Ditch B as a BMP was an error in the draft Buffer Plan. Thank you for
bringing this to our attention and apologies for any consequent confusion. Work done on
Ditch B will be to stabilize the feature rather than convert it to a BMP, thus it will still be
bringing concentrated flow into the conservation easement and to Tree Swing Creek.
More specifically, Ditch B banks will be graded, matted, and seeded starting shortly
before it enters the conservation easement and continuing until its confluence with Tree
Swing Creek. Additionally, the bed will be raised between 0‐1.5 feet to meet the
proposed Tree Swing Creek streambed elevation. With these modifications, Ditch B will
be between 0.5 to 4 feet deep throughout its extent within the Parcel.
b. explain that even though no credit is proposed here, need to at least indicate that
these 0‐50' riparian areas will be planted as part of the planting plan (reference Table
8 and Plan Sheet 6.1.2 (no 6.5 was attached to the Buffer Plan (FYI)

d. Reiterate that the existing condition treeline survey submitted in this Buffer Plan will
be overlayed on the AsBuilt survey to ensure that existing treelines at pre‐
construction (not asbuilt treelines) will be used in determining rbc and noc.
The following text has been added to Section 7.0 “Furthermore, the existing conditions
tree line survey shown in Figure 7, rather than new tree lines following construction, will
be used to determine riparian buffer credits and nutrient offset credits.”
8. Table 9: Project Credit Table

That is correct Preservation is only off E1. The inclusion of E2 on the referenced row was
an error. Thank you for catching this.
f. the Project Credit Table is only 1 table, not separated into 2 tables. It will either be
Table 9 or 10 based on other comments made in the beginning of the Plan.

9. Figure 7
a. Where is this area?
The Riparian Enhancement via Livestock Exclusion for Buffer Credit (101’‐200’) area is a
narrow band along Lee Branch. An inset has been added to Figure 7 to better show the
area.
b. Call out a BMP here at this location
Ditch B is not being converted to a BMP. See comment 7.a. for an explanation on work
done to Ditch B. References to a BMP within the Buffer Plan were an error.
c. Show where culverts that are currently there will be removed as part of mitigation
activities.

1.0 Project Introduction
The Hatch’s Hill Mitigation Bank Parcel (Parcel) is proposed under the terms and conditions of the
Hatch’s Hill Mitigation Banking Instrument (MBI), proposed to be made and entered into by Wildlands
Holdings IX, LLC acting as Bank Sponsor (Sponsor) and the North Carolina Department of Environmental
Quality (NCDEQ) Division of Water Resources (NCDWR). The Parcel shall be planned and designed
according to the MBI, 15A NCAC 02B .0703, and the Consolidated Buffer Mitigation Rule 15A NCAC 02B
.0295. The Nutrient Offset and Buffer Mitigation Plan (Buffer Plan) has also been designed in
concurrence with the stream and wetland project under the Wildlands Neuse 01 Umbrella Mitigation
Bank, Hatch’s Hill Mitigation Site (SAW 2022‐00095, DWR ID 2021‐1425 V.1). The Hatch’s Hill Stream and
Wetland Mitigation Plan has been submitted to the Interagency Review Team (IRT) for their review and
approval. This Buffer Plan is Appendix 10 of the Hatch’s Hill Stream and Wetland Mitigation Plan.
The project is in Mount Olive in Wayne County, North Carolina (Figure 1). Directions are included on
Figure 1. The Parcel creates a protected riparian area from top of bank and up to 200 feet along Lee
Branch and six unnamed tributaries (Jackson Creek, Tree Swing Creek, Alpaca Creek, UT to Alpaca Creek,
E1, and E2). The primary purpose of the project is to provide riparian buffer credits and nutrient offset
credits to compensate for unavoidable impacts in the Neuse River Basin 03020201 Hydrologic Unit Code
(HUC), outside the Falls Lake Watershed (Figure 2). The Parcel is located within the Neuse River Basin
HUC 03020201170050 and NCDWR Subbasin 03‐04‐12 in Wayne County.
1.1 Parcel Description
The project includes Lee Branch, along with 6 features that drain to Lee Branch. Lee Branch is a tributary
to Brooks Swamp, which drains to Thoroughfare Swamp. Thoroughfare Swamp then flows to Falling
Creek which subsequently connects to the Neuse River. The NC Department of Environmental Quality
(NCDEQ) classifies Lee Branch as a Class C and Nutrient Sensitive Water (NSW).
This riparian mitigation project will reduce sediment and nutrient loading, provide and improve
terrestrial and instream habitats, and improve stream and bank stability. The Parcel is comprised of
active cropland and wooded areas, some of which are accessed by livestock. See Appendix A for August
2023 current land use photographs. Restoring and enhancing the riparian area up to 200 feet from the
streams and ephemeral channels will reduce nutrient and sediment inputs to Lee Branch and
subsequently to Thoroughfare Swamp, Falling Creek, and the Neuse River. The restored, enhanced, and
preserved floodplain areas will filter sediment during high rainfall events and provide cover and food for
wildlife throughout the Parcel. Fencing out livestock will protect the riparian buffers from their impact
and aid in the development of a functioning multi stratum forest. Preventing livestock access to streams
will also further reduce sediment and nutrient inputs by improving stream bank stability.

2.0 Mitigation Project Summary
2.1 Project Goals
The major goals of the proposed nutrient offset and buffer mitigation project are to provide ecological
and water quality enhancements to the Neuse River Basin by restoring, enhancing, and preserving, the
riparian area to create a functional riparian corridor. Specific enhancements to water quality and
ecological processes are outlined below in Table 1.

Decrease nutrient levels.
Nutrient input will be decreased by filtering runoff from surrounding
agricultural fields through restored native vegetation. The off‐site nutrient
input will also be absorbed on‐site by filtering flood flows through restored
floodplain areas, where flood flows can disperse through native vegetation.
Decrease sediment input. Sediment from off‐site sources will be captured by deposition on restored
floodplain areas where native vegetation will slow overland flow velocities.
Decrease water
temperature and increase
dissolved oxygen
concentrations.
Planted riparian trees will shade the project features as they mature, reducing
thermal pollution.
Reduce fecal coliform
inputs.
Fecal coliform input will be reduced by preventing livestock waste deposition
in project riparian areas and streams through the installation of fencing
around portions of the conservation easement. Furthermore, livestock waste
from surrounding agricultural fields will be filtered through restored and
enhanced floodplain areas.
Create appropriate
terrestrial habitat.
Riparian areas will be restored by treating invasive vegetation and planting
native vegetation.
Permanently protect the
project Parcel from
harmful uses.
A conservation easement will be recorded on the Parcel.
2.2 Existing Parcel Conditions
The proposed nutrient offset and buffer mitigation project includes approximately 66.0 acres of
cropland and forest along Lee Branch and six unnamed tributaries. Livestock, including goats, horses,
donkeys, lamas, and pigs have access to Lee Branch between Hatch’s Hill Lane and its confluence with
Tree Swing Creek. The Parcel easement boundary will extend from top of bank to at least 20 feet along
nearly all project streams and out to 200 feet where possible (Figure 3). There is a small area along
Alpaca Creek and Tree Swing Creek where the easement boundary does not extend to 20 feet, no credit
will be proposed in these areas (Figure 7).
In general, project streams have either a forested riparian area, which vary in width, or are surrounded
by agricultural fields. Lee Branch flows north through the Parcel and initially lacks existing woody
vegetation on both floodplains, with row crop fields on either side, and in some areas, a single row of
trees near its bank. After Lee Branch crosses under Hatch’s Hill Lane, it picks up a forested riparian zone
on both sides and maintains a forested riparian area for the remainder of its project extent. Alpaca
Creek originates from a culvert running underneath Highway 117 and flows northwest until its

confluence with Lee Branch. When it enters the project, Alpaca Creek has a narrow, forested, riparian
zone on its right side that extends out to approximately 50 feet and gradually narrows to a single row of
trees. About halfway down its extent, Alpaca Creek loses this buffer and is surrounded on both sides by
row crops. UT to Alpaca Creek originates off‐site, where it flows roughly parallel to Highway 117. When
it enters the project area it flows northeast until it reaches its confluence with Alpaca Creek. The banks
of UT to Alpaca contain a row of mature trees in some areas, but overall, the stream lacks existing
woody vegetation along its banks and has agricultural fields in the floodplain. E1 and E2 are ephemeral
channels that flow east before connecting with Lee Branch, and both lack existing forest on their
floodplains. Tree Swing Creek flows east and connects to Lee Branch. For the first approximately 400
feet Tree Swing Creek has a forested riparian area greater than 200 feet wide on its left side, and no
woody vegetation on its right side. For the last approximately 100 feet before its confluence with Lee
Branch the stream has existing forest on both sides. Jackson Creek originates from a culvert that runs
underneath Highway 117 and flows west.
In 2022, the riparian area around Jackson Creek was harvested in violation of rule 15 NCAC 02B .0714.
Selective pine removal took place during the harvest, leaving a partially forested riparian area extending
from the top of bank and out over 200 feet on the right bank and out to approximately 20 to 100 feet on
the left side. In addition, invasive vegetation that compromised the majority of the existing plant
community was removed between 2022 and 2023 by Wildlands Engineering Inc. (Wildlands), leading to
the riparian areas currently being comprised of dense vining and herbaceous vegetation with
interspersed shrubs and saplings (see Current Land Use Photographs in Appendix A).
In general, the Parcel has maintained its rural farming character over the last 60 years with only minor
changes in land cover (see historical aerials in Appendix B).

2.3 Site Viability for Buffer Mitigation and Nutrient Offset Mitigation
On November 8, 2022, February 21, 2023, and March 1, 2023, NCDWR assessed the project streams and
issued the official Stream Determination Letter on March 24th, 2023. NCDWR also performed an onsite
visit of the project area to determine viability for buffer mitigation and nutrient offset on May 31st,
2023 and issued a site viability letter on October 2, 2023. Seven features were assessed by NCDWR
during the May 31st site visit and six were deemed viable for both riparian buffer credits and nutrient
offset credits. There have been no changes to land use in the project area since NCDWR’s 2023 Site visit.
A copy of both the “On‐Site (Stream Origin) Determination for Applicability to Neuse Buffer Rules” and
the “Site Viability for Buffer Mitigation & Nutrient Offset” letters from NCDWR are included in Appendix
C and summarized in Table 3.

2.4 Alternative Mitigation
In addition to riparian restoration and enhancement on subject streams, per the Consolidated Buffer
Mitigation Rules (15A NCAC 02B 0.0295 (o)), alternative mitigation is proposed on the Parcel in the form
of livestock exclusion enhancement of grazing areas adjacent to streams, mitigation on ephemeral
channels, and riparian preservation on subject streams. The proposed project complies in the following
ways:
Livestock exclusion enhancement of grazing areas adjacent to streams (15A NCAC 02B .0295 (o)(6):
Grazing has been the predominant land use since the effective date of the applicable buffer rule
(See Appendix B for historical aerials).
Livestock exclusion enhancement will be within existing, pre‐construction, forested areas.
Existing forest areas were defined by on‐the‐ground survey of the existing tree line with sub‐
meter accuracy GPS units or by a Professional Land Surveyor (See Figure 7 for existing tree line
survey).
Mitigation work will include the permanent exclusion of grazing livestock and credit will be at a
2:1 ratio (See Table 9 for credit calculations and Figure 7 for proposed fencing).
Mitigation on ephemeral channels (15A NCAC 02B .0295 (o)(7):
The entire area proposed for mitigation credit is within the contributing drainage area to the
ephemeral channel (See Figure 6 for watershed areas and Figure 7 for credit areas).

The ephemeral channel is directly connected to an intermittent or perennial stream and
contiguous with the rest of the mitigation site protected under the perpetual conservation
easement (See Figure 3 for conservation easement boundary).
The area of the mitigation site on ephemeral channels will not comprise more than 25% of the
total area of buffer mitigation (See Table 9 for mitigation areas).
The riparian buffer preservation area on ephemeral channels meets all the requirements of 15A
NCAC 02B .0295(o)(4).
Riparian Preservation on subject streams (15A NCAC 02B. 0295 (o)(4) & (o)(5)):
Subject streams were confirmed as intermittent or perennial streams by Division staff certified
per G.S. 143‐214.25A using the Division publication, “Methodology for Identification of
Intermittent and Perennial Streams and Their Origins (v.4.11, 2010)” (See Appendix C for the
On‐Site Determination for Applicability to the Jordan Lake Buffer Rules letter).
The area of preservation credit will not comprise more than 25% of the total area of buffer
mitigation (See Tables 9 for credit calculations).
Riparian Preservation will be within existing forested areas which were defined by on‐the‐
ground survey of the existing tree line using sub‐meter accuracy GPS units or by a Professional
Land Surveyor (See Figure 7 for existing tree line survey).
2.5 Watershed Characterization
The Parcel is located within the HUC 03020201170050. All project features flow to Lee Branch, which is a
tributary to Brooks Swamp. Brooks Swamp drains to Thoroughfare Swamp and eventually to the Neuse
River. Lee Branch is classified as Class C and NSW.
Topography, as indicated on the Mount Olive USGS 7.5‐minute topographic quadrangle, shows wide and
flat alluvial valleys spanning the majority of the Parcel (Figure 4). The Parcel watershed encompasses a
portion of downtown Mount Olive, NC and surrounding agricultural areas. Lee Branch is depicted as a
stream on the USGS Topographic Map. Drainage areas were delineated using the USGS Stream Stats
website and the North Carolina Floodplain Mapping Program’s 2014‐2015 Light Detection and Ranging
(LiDAR) data. Land uses draining to the project streams are primarily a combination of agricultural and
forested land. The watershed areas and current land use around project streams are depicted in Figure
6, the current land use photographs in Appendix A, and are summarized in Table 4 below.

2.6 Soils
The proposed Parcel is mapped by the Wayne County Soil Survey. The project area soils are described
below in Table 5. All the project features are depicted as streams on the 1974 NRCS Soil Survey
provided in Figure 5.

2.7 Existing Vegetative Communities
The existing vegetation within the Parcel is primarily comprised of cropland and existing forest. Existing
vegetation species across the project area are listed in Table 6. This is not an exhaustive list but gives an
indication of types of species growing in the area.

2.8 Threatened and Endangered Species
According to the Official Species List provided by the Raleigh Ecological Services Field Office of the U.S.
Fish and Wildlife Service (USFWS), there are no threatened or endangered species or final designated
critical habitat that occurs within the project boundary. Additionally, on Augst 17, 2022, the USFWS
responded to the public notice issued on July 18, 2022, for the Hatch’s Hill Mitigation Site, stating “The
project is not likely to adversely affect a listed species”. All correspondence with USFWS and a list of
Threatened and Endangered Species in Wayne County, NC is included in Appendix D.
2.9 Cultural Resources
There are no existing structures in the project area. The Parcel is not located near any sites listed on the
National Register with the State Historic Preservation Office (SHPO). On August 9, 2022, SHPO
responded to a public notice dated July 18, 2022, that they “are aware of no historic resources which
would be affected by the project” and have no comment on the project as it is currently proposed. The
SHPO request and response are included in Appendix D.
2.10 FEMA Floodplain Compliance
The Parcel is represented on the Wayne County Flood Insurance Rate Map (FIRM) panels 2573, 2583,
2574, and 2584. A limited detailed study has been done on Lee Branch starting within the project limits
down to the culvert at Baker Chapel Church Road. This section of the project is mapped as FEMA Zone
AE and Zone X. Downstream of the road there is a detailed study of Lee Branch including a delineated
regulatory floodway. Project limits within the downstream reach are mapped as FEMA Zone AE and
Zone X. The confluences of Alpaca creek and Tree Swing Creek are located in the Lee Branch floodplain,
but they are not modeled. The project will be designed to avoid adverse floodplain impacts on adjacent
properties and local roadways.
2.11 Parcel Location, Parcel Constraints, and Access
The project area is split into multiple sections by four external easement breaks (Figure 7). The portions
of the project south of Baker Chapel Road are all accessible via Hatch’s Hill Lane or Baker Chapel Church
Road. The northern portion of the project is also accessible via Baker Chapel Church Road. There are no
internal crossings within the Parcel.
2.12 Other Environmental Conditions
An EDR Radius Map Report with Geocheck was ordered for the Parcel through Environmental Data
Resources, Inc. on October 27, 2021. Neither the target property nor the adjacent properties were listed
in any of the Federal, State, or Tribal environmental databases searched by EDR. There were no known
or potentially hazardous waste sites identified within or immediately adjacent to the project area. The
Executive Summary of the EDR report is included in Appendix D.
3.0 Site Protection Instrument
The land required for planting, management, and stewardship of the mitigation project includes
portions of the parcels listed in Table 7. The Parcel will remain in private ownership, protected in its
entirety by an approved NCDWR long term steward, and will be managed under the terms detailed in an
approved NCDWR conservation easement.

4.0 Mitigation Work Plan
The project will restore and enhance agriculturally impacted land along the riparian areas of Lee Branch
and six other mitigated tributaries on the Parcel to a protected riparian corridor, improving the
ecological function of the area. Disturbance of areas generating riparian buffer credits and nutrient
offset credits will be limited and will only occur where grading is necessary for stream mitigation. Topsoil
removed during grading will be set aside and re‐applied following construction. This practice will ensure
that topsoil remains within areas generating riparian buffer credits and nutrient offset credits and that
any impacts which might affect future vegetation growth and establishment are minimized across the
Parcel. Figure 7 illustrates the nutrient offset credit areas and riparian buffer credit areas and conceptual
design; Figure 8 depicts the riparian zones and designated widths for the Parcel.
4.1 Parcel Preparation
In general, riparian areas within the Conservation Easement will either be restored by planting trees and
shrubs, enhanced by installing fencing to exclude livestock, enhanced through improving density within
existing low‐density forests, or preserved with minimum widths of 20 feet from tops of banks and
maximum widths of 200 feet from tops of banks. Much of the land within 200 feet from top of bank of
the project features has either been used for row crop production, maintained for active livestock
grazing or has remained forested. Areas slated for riparian restoration and enhancement that are not
impacted by the construction of the stream and wetland mitigation project will require little preparation
including select herbicide treatments or limited mechanical clearing to removed undesirable underbrush
and invasive species. Other areas of the easement will be graded in accordance with the IRT approved
stream and wetland mitigation plan. Any haul roads or other areas of compacted soil including areas
compacted by livestock within the easement boundary will be ripped prior to planting. The specifics of
the stream and wetland restoration project are in the Hatch’s Hill Stream and Wetland Mitigation Plan.
Sections 6.5 and 6.6 of the Hatch’s Hill Stream and Wetland Mitigation Plan contain information on
grading. A 401 & 404 permit will be required for all stream and wetland restoration work and will be
obtained before any work in the waters begins.

4.2 Riparian Area Restoration Activities
Riparian area restoration will involve planting appropriate native tree and shrub species along the
riparian corridor, which will resemble Coastal Plain Small Stream Swamp communities. The proposed
tree and shrub species composition for this Parcel reflect the existing vegetation, which includes many
of the indicator species for coastal plain small stream swamps such as water oak (Quercus nigra) and
swamp tupelo (Nyssa biflora). Some adaptations were made to target community species composition
based on commercial availability and the addition of ruderal species, for example, cottonwood (Populus
deltoides) and wax myrtle (Myrica cerifera), that will accelerate the conditions under which the Coastal
Plain Small Stream Swamp co‐dominant species can flourish.
Vegetation management and herbicide applications may be needed over the first few years of tree
establishment in the riparian restoration areas to prevent encroachment of undesirable species that
may out‐compete the planted native vegetation.
Tree and shrub species planted across the riparian areas of the Parcel will include a mixture of the
species listed in the Hatch’s Hill Mitigation Site Planting Tables, located in Appendix E. Species planted
within areas generating riparian buffer credits and nutrient offset credits will only be those listed in the
Buffer Planting Zone of Plan Sheet 6.0.1. All activities associated with generating riparian buffer credits
and nutrient offset credits will occur at the same time as the stream and wetland mitigation activities
and not before.

Within riparian restoration areas, trees and shrubs will be spaced at 6 feet by 12 feet during planting,
which is equivalent to a stem density of 521 stems per acre and is sufficient to meet the performance
standards outlined in the Rule 15A NCAC 02B .0295 of 260 planted trees and shrubs per acre at the end
of five years. Stems will be well mixed prior to planting to ensure diversity of bare root species across
the Parcel. No one tree or shrub species will be greater than 50% of the planted stems. Due to the
nature of random mixing, some stems of the same species might be planted together in some areas. The
final performance standard shall include a minimum of four native hardwood tree and native shrub
species. A regionally appropriate seed mix of warm season grasses and wildflowers will also be applied
to provide temporary and permanent ground cover for soil stabilization and reduction of sediment loss
during rain events in areas without existing herbaceous cover. The proposed planting area includes the
areas identified as Riparian Restoration for Buffer Credits and Riparian Restoration for nutrient offset
credits on Figure 7. Planting is scheduled for March 2025.
4.3 Riparian Area Enhancement Activities
The revegetation plan for the buffer enhancement areas under 15A NCAC 02B .0295(n) will include
planting supplemental bare root trees listed in Table 8 and controlling invasive species growth. The
proposed supplemental planting area includes the area identified as Riparian Enhancement on Figure 7.
4.4 Riparian Area Enhancement Via Livestock Exclusion Activities
For enhancement areas under NCAC 02B .0295(o)(6), livestock exclusion, planting isn’t anticipated to be
needed except where required in the Hatch’s Hill Stream and Wetland Mitigation Plan. Fencing will be
installed throughout the entirety of the livestock exclusion area to discontinue livestock access. A seed
mix as identified in Appendix E will be applied where livestock have created bare soils and sufficient
sunlight is available to support the species in the seed mix.
4.5 Riparian Area Preservation Activities
There will be no parcel preparation work done in the riparian preservation areas under 15NCAC 02B
.0295(o)(4) except as required in the Hatch’s Hill Stream and Wetland Mitigation Plan. The area of
preservation credit within the buffer mitigation site is less than 25% of the total area of buffer
mitigation, as shown in Table 9. The preservation area will be protected in perpetuity under a
conservation easement and fencing will be installed throughout the entire easement boundary.
4.6 NCDWR As‐Built Evaluation
Within 30 calendar days after completing the establishment of the buffer mitigation and nutrient offset
areas, the Sponsor will submit written notification to NCDWR documenting that all buffer mitigation and
nutrient offset activities have been completed, including the installation of fencing, where proposed,
and adequate marking of easement boundaries. In addition, all stream and wetland mitigation activities
for the Hatch’s Hill Stream and Wetland Mitigation Site must be completed prior to the NCDWR as‐built
evaluation. Failure to submit written notification within 30 days may result in a modified credit release
schedule or a delay in the issuance of credit releases.
5.0 Monitoring and Maintenance Plan
5.1 Monitoring Protocol
Vegetation monitoring plots will be installed and evaluated within the riparian restoration areas to
measure the survival of the planted trees and shrubs. The plots will be randomly placed throughout the
planted riparian areas and will be representative of areas generating riparian buffer credits and nutrient

offset credits. A total of 13 plots will be established within the restoration and enhancement areas
(Figure 9). All 13 vegetation plots will be shared with the stream and wetland project. The size of
individual quadrants will be 100 square meters. When the area of the 13 plots is added together, they
equate to 2% of the riparian restoration area generating either nutrient offset nitrogen credits or
riparian buffer credit. The equation used to calculate the number of plots needed is as follows:

0.3081 acres/0.0247 acres = 12.47 vegetation plots
Vegetation assessments will be conducted and follow the Carolina Vegetation Survey (CVS) Level 2
Protocol for Recording Vegetation (Lee et al., 2008). A reference photo will be taken from the
southwestern corner of each of the 13 plots. Overview photos will be taken each monitoring year and
provided in the annual reports. All planted stems will be marked with flagging tape and recorded.
The first annual monitoring activities will commence at the end of the first growing season, at least five
months after planting has been completed and no earlier than the fall season. Species composition,
height, vigor, and survival rates will be evaluated by plot during monitoring year 1, 3, and 5. Height data
will be reported per stem, while vigor data is only required to be reported as an average per plot. During
monitoring years 2 and 4 only qualitative data and stem counts will be required to be reported. During
all monitoring years volunteer woody stems will also be recorded and documented within annual
reports. The measure of vegetative success for the Parcel will be the survival of at least four native
hardwood tree and shrub species, where no one species is greater than 50% of the established planted
stems, and an established density of at least 260 planted trees and shrubs per acre at the end of the
fifth year of monitoring. Appropriate and desirable native volunteer species may be included in the
Parcel’s density to meet the performance standards with written NCDWR approval.
A visual assessment of the livestock exclusion areas within the conservation easement will also be
performed each year to confirm:
Fencing is in good condition throughout the livestock exclusion area;
No livestock access within the conservation easement area;
No encroachment has occurred;
Diffuse flow is being maintained in the conservation easement area; and
There has not been any cutting, clearing, filling, grading, or similar activities that would
negatively affect the functioning of the buffer.
The Sponsor shall submit the annual monitoring report to NCDWR by December 31st of each year for five
consecutive years and will follow the terms and conditions of the MBI.
5.2 Parcel Maintenance
If the Parcel or a specific component of the Parcel fails to achieve the success criteria outlined in Section
5.1, adaptive measures will be developed and/or appropriate remedial actions will be implemented.
Maintenance will be performed to correct any identified problems on the Parcel that have a high
likelihood of affecting project success. Such items include, but are not limited to, fire, flooding, drought,
or insects that cause excess tree mortality. Any actions implemented will be designed to achieve the
success criteria and will include a work schedule and updated monitoring criteria. A rigorous herbicide
schedule may need to be implemented in the first few years of tree establishment in the restoration
areas to prevent establishment of invasive species that may out‐compete the planted native vegetation.
The only herbicides used on the Parcel will be aquatic approved herbicides that will be applied in
accordance with North Carolina Department of Agriculture rules and regulations.

The easement boundary will be checked annually as part of monitoring activities. The condition of
fencing will be assessed to ensure livestock do not have access to the easement. Easement boundary
conditions as well as any maintenance performed will be reported in the annual monitoring reports to
NCDWR.
5.3 Easement Boundaries
Easement boundaries will be identified in the field to ensure clear distinction between the Parcel and
adjacent properties. Boundaries may be identified by marker, post, tree‐blazing, or other means as
allowed by Parcel conditions and/or conservation easement prior to the NCDWR onsite As‐Built
evaluation for Task 2 credit release. Boundary markers that have been disturbed, damaged, or
destroyed will be repaired and/or replaced on an as needed basis. Contact information for the
conservation easement holder will be included on easement markers.
6.0 Financial Assurance and Long‐Term Management
6.1 Financial Assurances
Following approval of the Hatch’s Hill Buffer Plan, the Sponsor shall provide a Performance Bond from a
surety that is rated no less than an “A‐“ as rated by A.M. Best. The Performance Bond amount shall be
100% of the estimated cost for implementation of the project as described in the Buffer Plan, but not
less than $150,000.00. In lieu of posting the performance bond, the Sponsor may elect to construct the
project prior to the first credit release. In that case no performance bond will be necessary.
After completion of the restoration/construction, a separate Performance/Maintenance Bond will be
secured for 100% of the estimated cost to implement the monitoring and maintenance plan but not less
than $100,000.00. The Performance/Maintenance Bond shall apply at the inception of the monitoring
period for a term of one year and be extended annually for a minimum of five years. Upon NCDWR
approval, this may be lowered each year based on the adjusted cost to complete the monitoring.
Performance bonds for monitoring shall be renewed at least annually to cover the next years monitoring
period, with confirmation of renewal provided to NCDWR with each annual monitoring report when
applicable. NCDWR reserves the right to alter the credit release schedule if monitoring reports are
submitted without proof of bond renewals when applicable.
6.2 Long‐term Management
The Parcel will remain in private ownership, protected in its entirety by Unique Places to Save, an
approved NCDWR long term stewardship, and will be managed under the terms detailed in an approved
NCDWR conservation easement. The long‐term manager will be responsible for periodic inspection of
the Parcel to ensure that the restrictions documented in the recorded easement are upheld in
perpetuity. No remaining credits will be released for Monitoring Year 4 until the conservation easement
has been assigned to an approved land trust or stewardship.
7.0 Potential Credit Generation
Of the 73.0 acres protected under the conservation easement, the mitigation approach for 14.4 acres is
riparian restoration. Of the 14.4 acres of restoration, 8.5 acres are proposed for riparian buffer credit
and 5.9 acres are proposed for nutrient offset credit. Riparian buffer credits are also being generated
from enhancement, enhancement via livestock exclusion, and preservation. These areas total 1.0 acres,
1.3 acres, and 2.4 acres, respectively. Preservation credit within the buffer mitigation site is less than
25% of the total area of buffer mitigation, as shown in Table 9. The Buffer Interpretation/Clarification

Memo #2008‐019 applies to Ditch B where maintenance of diffuse flow onsite is unattainable;
therefore, a total of 1,310 square feet are removed from the creditable area. Ditch B banks will be
stabilized through grading, followed by the application of coir matting and temporary and permanent
native seed mix starting shortly before it enters the conservation easement and continuing to its end at
Tree Swing Creek. Additionally, the bed elevation will be raised between 0‐1.5’ to meet the proposed
Tree Swing Creek streambed elevation. Other areas within the conservation easement where credit is
not claimed include areas where the riparian width is less than 20 feet and conversely where the
riparian width exceeds 200 feet. Due to a timber harvesting violation along Jackson Creek, credit cannot
be claimed within the first 50 feet. The first 50 feet from Jackson Creek will be planted with species
listed in Table 8 above and as noted on Plan Sheet 6.1.2 of the Hatch’s Hill Stream and Wetland
Mitigation Plan. This is to ensure a contiguous riparian corridor along the mitigated stream. No credit is
proposed along Lee Branch past the current top of bank of Ditch A, as required in the Site Viability for
Buffer Mitigation and Nutrient Offset Letter (Appendix 2). Additionally, credit is not proposed within
areas where wetland mitigation credits are being claimed across the Parcel. The portion of Lee Branch
north of Baker Chapel Church Road is not proposed for riparian buffer credits or nutrient offset credits.
Most of this area is proposed for wetland mitigation credit and the area was not assessed during the
May 31st, 2023, site viability visit. All credit areas will be finalized in an As‐Built Survey and will be
submitted in the As‐Built report.
The credit calculations were derived based on Wildlands’ conceptual design for maximum ecological
uplift. The management objectives, mitigation type, and proposed amount of buffer mitigation are
presented in Table 9 below. The riparian buffer credits will be derived from riparian areas adjacent to
ephemeral channels and mitigated streams. Credits will be determined based on existing riparian
conditions on the Parcel. Furthermore, the existing conditions tree line survey shown in Figure 7, rather
than new tree lines following construction, will be used to determine riparian buffer credits and nutrient
offset credits. The riparian restoration areas are viable for either riparian buffer credits or nutrient offset
credits, but not both. On this Parcel, Wildlands is seeking riparian buffer credit from riparian restoration
areas within top of bank to 100 feet. These credits can be converted to nutrient offset Credits upon
receiving written approval by NCDWR. Wildlands is seeking nutrient offset credits in riparian restoration
areas from 101‐200 feet from top of bank along streams and ephemeral channels. These areas will not
be convertible to riparian buffer credits per the MBI. The total credit potential of riparian buffer credit
convertible to nutrient offset credit is represented in Table 9 below and will be documented in the As‐
Built Report and will be supported by the As‐Built survey. There will be three (3) credit ledgers for the
project: Buffer Restoration, Buffer Enhancement (Enhancement and Enhancement via Livestock
Exclusion) with Buffer Preservation, and Nitrogen Nutrient Offset Credits.

Location: Lat., Long: 35.219267, -78.065682 Dear Ms. Hogarth: On November 8, 2022, February 21, 2023, and March 1, 2023, Shelton Sullivan of the Division of Water Resources (DWR) conducted an on-site review of feature(s) located on the Hatch’s Hill Mitigation Site at the request of Wildlands Engineering, Inc. to determine the presence of stream features and the applicability of these to the Neuse River Riparian Area Protection Rules, Title 15A North Carolina Administrative Code 02B .0714. The enclosed map(s) depict the feature(s) evaluated and this information is also summarized in the table below. Features were evaluated for being ephemeral, at least intermittent, and for subjectivity to the Neuse River Riparian Area Protection Rules. Streams or features that are considered “Subject” have been located on the most recently published County NRCS Soil Survey and/or the most recent copy of the USGS Topographic (at 1:24,000 scale) map(s), have been located on the ground at the site, and possess characteristics that qualify them to be at least intermittent. Features that are considered “Not Subject” have been determined to not be at least intermittent, not present on the property, or not depicted on the required maps.
This determination only addresses the applicability to the buffer rules within the
proposed property boundary or proposed easement and does not approve any activity
within buffers or within waters of the state. There may be other streams or features
located on the property or adjacent property that were not evaluated or do not appear
on the maps referenced above. Any of the features on the site may be considered
jurisdictional according to the US Army Corps of Engineers and subject to the Clean
Water Act.
The following table lists the features observed for determination during the DWR site visits. See the attached maps for reference.

This letter is in reference to your prospectus document dated July 1, 2022, for the
proposed Wildlands Neuse 01 Umbrella Mitigation Bank and Hatch’s Hill Mitigation Site.
The proposal consists of the establishment and operation of a commercial umbrella
mitigation bank, and the associated 56.25-acre Hatch’s Hill Mitigation Site, located
directly adjacent to US-117, in Mount Olive, Wayne County, North Carolina
(35.219267°N, -78.065682°W). The proposed Hatch’s Hill Mitigation Site would include
stream and wetland restoration and enhancement activities within the Brooks Swamp
watershed, in the Neuse River Basin (8-digit hydrologic unit code (HUC): 03020201).
The Corps determined the Prospectus was complete and issued a public notice (P/N
# SAW-2022-00095) on July 18, 2022. The purpose of this notice was to solicit the
views of interested State and Federal agencies and other parties either interested in or
affected by the proposed work. Attached are comments received in response to the
public notice from the North Carolina Department of Natural and Cultural Resources,
State Historic Preservation Officer, and the U.S. Fish and Wildlife Service.
The Corps has considered the comments received from members of the Interagency
Review Team (IRT) and information that was discussed during an IRT site review on
March 29, 2022. We have determined that the proposed umbrella mitigation bank
appears to have the potential to restore and enhance aquatic resources within the 8-
digit HUC 03030006 of the Cape Fear River. Therefore, the bank sponsor may proceed
with preparation of a draft Umbrella Mitigation Banking Instrument (UMBI).

the submittal and offer the following comments.
We have conducted a review of the project and are aware of no historic resources which would be affected
by the project. Therefore, we have no comment on the project as proposed.

Advisory Council on Historic Preservation’s Regulations for Compliance with Section 106 codified at 36
