Dear Mr. Barker,
It has come to the attention of the Division of Energy, Mineral, and Land Resources (DEMLR)
that Wynfall Subdivision Phase One located off Hinkle Lane in Davidson County is not properly
permitted. Titles 15A NCAC 02H .1001 and .1016 require that developments occurring in
Urbanizing Areas be covered under a post-construction stormwater permit prior to the placement
of built- upon area on the site. Titles 15A NCAC 02H. 1003, .1017 and .1050-.1062 set forth the
requirements for low- and high- density developments in Urbanizing Areas and design standards
for stormwater control measures.
Our records indicate this site never obtained a post-construction stormwater management permit
and is therefore in violation of the following:
I. Failure to Obtain a State Stormwater Management Permit
Title 15A NCAC 02H .1001 and .1016 require a Post- Construction Stormwater Permit for
development activities within Urbanizing Areas of North Carolina.

Required Response
Submit a permit application within 90 calendar days of.receipt of this notice. Instructions and
required forms for the different post- construction permitting options are available at:
