Tremont Ave. Suite C Charlotte, NC 28203 RE: APPROVAL LETTER w/MODIFICATIONS—EROSION CONTROL PLAN (EC23.040) PROJECT NAME: Landis85—Phase II—EC23.040 LOCATION: Old Beatty Ford Rd. TOTAL DISTURBED ACRES: 49 LATITUDE: 35.5339 LONGITUDE: -80.5942 Dear Ms. Michele Wheeler: This office has reviewed the subject erosion and sedimentation control plan. We find the revised plans submitted on January 23', 2024 to be acceptable with the following modifications: 1. Construction shall not begin before ownership of properties have been transferred to the FRO. Copy of new deed should be presented to this office at that time. 2. Provide a document of agreement with JSC-CCI Landis I, LLC that JSC-CCI Landis II, LLC can perform grading and construction activities on their property under this Approval Letter. We hereby issue this Letter of Approval w/Modifications and the following comments: 1. A pre-construction conference is required for this project. Contact this office at least 48 hours in advance. 2. This approval does not authorize off-site land-disturbing activity (borrow or spoil) associated with this project. 3. This approval does not supercede nor negate the need for any applicable development permits or approvals including(ie: planning, subdivision, floodplain, DOT, etc.). Letter of Approval Ms. Michele Wheeler January 23',2024 Page 2 Please be advised that Section 18-52 b. of the Rowan County Soil Erosion & Sedimentation Ordinance (RCSESO) states that a copy of the approved Erosion Control Plan be on file at the job site. Also,you should consider this letter as giving the Notice required by G.S. 113A-61(d)& Section 18.53 a. of that same ordinance specifying our right of periodic inspection to ensure compliance with the approved plan. This plan approval shall expire two (2) years following the date of approval if no land-disturbing activity has been undertaken,as is required by Title 15A NCAC 4B.0129. Based on rules established by the North Carolina Department of Environmental Management Land Resources (DEMLR) as of April 1, 2019, all new construction activities are required to complete and submit an electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the NCG010000 Construction Stormwater General Permit. This form MUST be submitted prior to the commencement of any land disturbing activity on the above mentioned project. The NOI form may be accessed at deq.nc.gov/NCG01. Please direct questions about the NOI form to Paul Clark at Paul.clark@ncdenr.gov. After you submit a complete and correct NOI form, a COC will be emailed to you within three business days. A $120 fee will be charged annually. This fee is to be sent to the DEMLR Stormwater Central Office staff in Raleigh. Rowan County's Sedimentation Pollution Control Program is performance oriented, requiring protection of the natural resources and adjoining properties. If, following the commencement of this project, it is determined that the erosion and sedimentation control plan is inadequate to meet the requirements of the Sedimentation Pollution Act of 1973 (North Carolina General Statute 113A-51 thru 66), which are set forth in the local ordinance, this office may require revisions to the plan and implementation of the revisions to ensure compliance with the Act. Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water quality laws,regulations,and rules pursuant to G.S. 113A-61(b1). Please note that this approval is based in part on the accuracy of the information provided in the Financial Responsibility Form which you have provided. You are requested to file an amended form if there is any change in the information included on the form. Your cooperation is appreciated,and we look forward to working with you on this project.
