On February 8, 2024, the DEMLR received your application for a Utility Line Project to be covered under the State
Stormwater General Permit Number SWG040000. In accordance with your application, we are forwarding herewith the
subject Certificate of Coverage Number SWG040162, along with a copy of the General Permit, for the construction of a
linear utility line project with associated incidental built-upon area. The General Permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and Title 15A NCAC 2H .1000, the stormwater management
rules.

Please take notice that this Certificate of Coverage is not transferable except by action to and approval by DEMLR. The
DEMLR may require modification or revocation and reissuance of the Certificate of Coverage.

This permit does not affect the legal requirement to obtain other permits which may be required by the Division of
Energy, Mineral and Land Resources, the Division of Water Resources, Coastal Area Management Act, or any other
Federal, State, or Local agency, law, rule, or ordinance.

The original signed permit package and approved plans are being mailed to the permittee, Aaron Weldon, at the

There is one small discrepancy. On the application, the BUA is listed as 2.57 ac, whereas the plansets are listed as 2.54
ac.

Once, you are able to correct this, go ahead and send in the plan sets and the application in (with a notarized original
signature)!

When measured at a 1” = 200’, the plan sheets show a BUA area of approx. 1.84 ac and a project area of approx.. 56.9
ac, which does not match what is on the application (see comments of the measurements in the pdf. Attached).

If you can show the measurements you are getting from Cad on the site plans (signed and sealed), then that is fine.

Morning Kaitlin, I’m not sure I understand the comment. The plans are at 1”=200’ scale when plotted on a 34”x22”
sheet. If you print it at half size onto an 11”x17” page, it would be 400 scale. We have both a graphic scale on the sheet
as well as the scale noted in the title block. We do not have the acreages of the project area or BUA listed on the plan
sheet, but if you would like us to do that I can. The area numbers provided were directly from taking the square footages
out of the cadd drawings. Please let me know if there is any other way we can clarify this for you so we can push
towards a speedy resolution. Thank you.

Hi Dyanna,

The whole 17 miles is your project area, not your BUA. That is what I meant by that answer. So the BUA would be the
actual BUA you are putting on site (and any existing BUA) and the project area would be the 17 miles.

To clarify, we are not asking for the easement, we are asking for the project line delineation to scale, so that the area’s
measurements can be confirmed. The project area can be the limits of disturbance, the offset from the transmission
line, etc., it just needs to be consistent with the areas provided throughout the submittal.

This project is complicated as it traverses 2 counties, only one of which requires the state SWG04 review. The 17 miles
and 224 acres is the entire project length. We don’t, at this time, have a comprehensive document showing all of the
B&D for the easement since some of it is in very old prescriptive easement that was not changed. The survey group we
contracted with has individually recorded documents from the linework we provided for each parcel for recordation
purposes. Can we give you copies of all of the recorded easement documents?

As for the BUA area question, please see the attached email. If I’m supposed to revise the application in some way other
than what I was directed to, I’d be happy to. Again, should this apply to ALL of the regulator stations along the whole
pipeline, even the ones that are not in Union County?

This all might be easier to discuss over the phone. If you can, please give me a call and hopefully we can hash all this out.

For further clarification, we need to be able to manually confirm the areas provided to us in the application.
The project area should be able to be measured with a scale and the area confirmed. Providing a metes/bounds or
dimensioned boundaries is helpful for this. Additionally, ensure that it is clear what the boundaries are, and that the
entire area is clearly shown in a way that can be confirmed.

Per Kaitlin’s email:
 BE sure to include the ENTIRE project area in the map frame to provide clear bounds of what the project area is
(the 17 miles we discussed previously). Currently the line appears to extend beyond the map frame past the
(MLV-1? It is not labeled in the “Key Map”). This project area, including the line between the two areas of BUA,
should have bearings and distances so that we are able to verify the project area.
o To follow up on this, if the project area is 17 miles, a clearly delineated project area of those 17 miles
needs to be provided so that the square footage/acreage can be confirmed.
 On the application, you have it listed that there is 224.5 ac of BUA (Number 8). Please revise this to the correct
amount so that I can work to verify this on your site plans.
o To follow up on this, I believe 224.5 ac was listed as the project area, which would make this site 100%
impervious, which I don’t believe is your intention.

I am having trouble verifying the BUA and project area on your site plans.
 BE sure to include the ENTIRE project area in the map frame to provide clear bounds of what the project area is
(the 17 miles we discussed previously). Currently the line appears to extend beyond the map frame past the
(MLV-1? It is not labeled in the “Key Map”). This project area, including the line between the two areas of BUA,
should have bearings and distances so that we are able to verify the project area.
 On the application, you have it listed that there is 224.5 ac of BUA (Number 8). Please revise this to the correct
amount so that I can work to verify this on your site plans.

Please send me back your revised plans in a .pdf so I can look them over. Additionally, your revised application, (I can
print the application out so that I can add it to your existing application).

Kaitlin & Jim,

The proposed equipment installations located at the Line 129 site are considered incidental to the Line 477 since their
sole purpose is supporting the gas transmission main being installed and would not be needed if the utility upgrade
were not being performed. The proposed launcher is equipment that needs to be installed as part of the Federally
mandated update to gas transmission systems, requiring the ability to do in-line inspections for public safety. The
regulator station that will also be installed is a transfer location for gas flowing through the transmission main to be
diverted into the distribution system serving local PNG customers. The BUA of this site was reviewed and minimized to
the maximum extent practicable in accordance with PNG operational guidelines.

Can you provide some insight on what the regulator station is? (in reference to Line 129 launcher). Additionally, can you
provide your reasoning for why this BUA should be considered “incidental”? (For general permits, typically only
incidental BUA is permitted).

Also, after speaking to Jim, you can either permit both of the sites under one permit, or two permits (one for each site),
it is up to you. Please let me know what route you would like to take so I can send out the appropriate additional
information that is needed.

Good Morning Kaitlin,

One other question, PNG wants to confirm when the package was received by your office, so we have an idea of the

timeline. Mooresville received it on November 30 because we Fed-ex the application. When do you show
receipt? We are currently in construction and Union County will not approve the permit until we have the SWG-04 back
from the State (your office). So, we are just trying to see how that will impact the schedule and trying to avoid delays
and potential Change orders.

Do you have any idea on when Jim will start his review on eligibility?

Michelle,

So the Fast-Track option is no longer available (and did’t apply to general permits), but the general permits (which are
different from standard permits) tend to take approximately around the same time that the fast-tracks used to.

“Please be aware that, effective October 1, 2023, the Fast-Track permitting option has been eliminated (The Fast-Track
option is still available for those projects that have filed their Fast-Track application on or before the effective date). For
this project, you will need to apply for post-construction stormwater coverage through the Standard permitting option”.

Good afternoon Kaitlin,

I’m trying to find the status of 2 permits I send in to the Mooresville office accidently back at the end of November.
When I called to check on them they told me all the state post-construction permits go to the central office. The two
permits are for our client, Piedmont Natural Gas, both for Line 477; One for the Line 129 Tie-over, one for the MLV1. I’ve
attached copies of the applications for your reference.

If you could please let me know 1) if you have the applications, 2) what their permit numbers are for future reference,
and 3) what the standard review times are, I would appreciate it. Thanks for your help!
