Facility Activities and Process: Jowat Corporation operates an adhesive manufacturing operation with ASTs for raw materials. These raw materials are conveyed in a closed piping system to the commercial mixers and the material is heated to form a liquid. Once the mixing process is completed the product is then transferred to a storage tank by a closed piping system. The product is then cooled and pelletized. Once pelletized the product will go as a finished product into a bulk bag or a bin at which time all the finished product is packaged for shipment. Per information from Tamera Eplin(WSRO; via email 10/19/2023), the consultant for Jowat Corporation stated that additional property acquired by Jowat Corporation (submitted updated permit application received January 2023) was previously owned by Novamelt and previously had a no- exposure certification. Outfall SW001: Drainage area consists of the maintenance building and a parking lot. Potential pollutants include TSS and O&G. Outfall SWO02: Drainage area consists of portions of the manufacturing building, administration building, an 800 gallon HTF system, two (2)transformers, loading/unloading activities, and a parking lot. Potential pollutants include TSS and O&G. Outfall SWO03: Drainage area consists of the Henkel building, PUR building, warehouse building, part of the manufacturing building, two (2) 5,000 gallon wastewater tanks (emptied by pumping to a tanker truck), five (5) solid ethylene vinyl acetate (EVA) copolymer granules storage silos, one (1) limestone storage Page 1 of 6 silo, two (2)transformers, miscellaneous drum storage, equipment storage, a stormwater retention pond, and wooded area. Why Industrial Sites with Stormwater are Subject to a Permit: Federal NPDES regulations define stormwater discharge associated with industrial activity in 40 CFR §122.26 (b)(14) as: "the discharge from any conveyance that is used for collecting and conveying storm water and that is directly related to manufacturing,processing or raw materials storage areas at an industrial plant. The term does not include discharges from facilities or activities excluded from the NPDES program under this part 122. For the categories of industries identified in this section, the term includes, but is not limited to, storm water [sic] discharges from industrial plant yards; immediate access roads and rail lines used or traveled by carriers of raw materials, manufactured products, waste material, or byproducts used or created by the facility; material handling sites; refuse sites; sites used for the application or disposal of process waste waters (as defined at part 401 of this chapter); sites used for the storage and maintenance of material handling equipment; sites used for residual treatment, storage, or disposal; shipping and receiving areas; manufacturing buildings; storage areas (including tank farms) for raw materials, and intermediate and final products; and areas where industrial activity has taken place in the past and significant materials remain and are exposed to storm water. For the purposes of this paragraph, material handling activities include storage, loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product, byproduct or waste product. The term excludes areas located on plant lands separate from the plant's industrial activities, such as office buildings and accompanying parking lots as long as the drainage from the excluded areas is not mixed with storm water [sic] drained from the above described areas." Section 2. Monitoring Information and Compliance History: • June 2021 to June 2023,benchmarks exceeded for: o SW002: TSS Ix o SW003: TSS 2x o Per information provided 10/27/2023, monitoring was not completed 2017-2020 based on understanding of No Exposure Certification o No monitoring data provided for pH, total rainfall, O&G, and new motor oil usage o No visual monitoring data provided • Per the November 2022 inspection report: Analytical monitoring has been conducted but at the inlet to the pond with high results for copper. The site drains to a 2-acre pond that does not appear to discharge. If the pond were to discharge, the facility owns at least 20 acres of woods where the flow would sheet flow and eventually infiltrate into the ground. Documentation of"No Flow"needs to be taken by the permittee and submitted. • Per the May 2017 inspection report, there are no stormwater exposures from industrial activities and only new pallets are stored outside Section 3. Proposed Monitoring for Stormwater Discharges: The Division considered potential pollutants from past and present industrial activities and data was submitted for June 2021 to June 2023. Quantitative sampling included TSS. Stormwater benchmarks are numerical action Page 3 of 6 levels for stormwater monitoring. Benchmarks are not effluent limits, and benchmark exceedances are not permit violations. Benchmarks provide facilities a tool for assessing the significance of pollutants in stormwater discharges and the effectiveness of best management practices (BMPs). Benchmark concentrations are intended as guidelines for the facility's development and implementation of the Stormwater Pollution Prevention Plan(SWPPP). Benchmark exceedances require the permittee to increase monitoring, increase management actions, increase record keeping, and/or install stormwater BMPs in a tiered program. The permit establishes a tiered approach to specify actions the permittee must take in response to analytical results above benchmark concentrations. The tiered structure of the permit provides the permittee and DEMLR wide flexibility to address issues that may arise with one or more parameters and/or outfalls. Metals benchmarks are calculated to mimic acute water quality standards and with the guidance of DWR. NC DWR follows established federal procedures for calculating acute standards when developing the benchmarks. Just like the acute standards, metals benchmarks normally reflect one half of the calculated Final Acute Value (the "1/2 FAV"). In most cases, translation into total recoverable values is based on an assumed hardness of 25 mg/L and a total suspended solids (TSS) concentration of 10 mg/L. Acute standards protect aquatic life from negative impacts of short-term exposure to higher levels of chemicals where the discharge enters a waterbody. The Stormwater Permitting Program applies this approach because of the ephemeral nature of rainfall events. The Division may evaluate results to determine if a smaller suite of parameters for some outfalls is adequate to characterize potential pollution or BMP effectiveness. For example, one or more metals or other parameters may serve as an adequate tracer for the presence of ash pollution during disturbance or ash removal in specific drainage areas at this site. For parameters that do not have a stormwater benchmark, the Division may develop a benchmark value if appropriate toxicity data become available or if rising trends in concentrations suggest a persistent source. The Division's maintains that implementation of Best Management Practices (BMPs) and traditional stormwater management practices that control the source of pollutants meets the definition of Best Available Technology (BAT) and Best Conventional Pollutant Control Technology(BCT). The permit conditions are not numeric effluent limitations but are designed to be flexible requirements for implementing site-specific plans to minimize and control pollutants in stormwater discharges associated with the industrial activity. Title 40 Code of Federal Regulations (CFR) §122.44(k)(2) authorizes the use of BMPs in lieu of numeric effluent limitations in Page 4 of 6 NPDES permits when the agency finds numeric effluent limitations to be infeasible. The agency may also impose BMP requirements which are "reasonably necessary" to carry out the purposes of the Act under the authority of 40 CFR 122.44(k)(3). The conditions proposed in this draft permit are included under the authority of both of these regulatory provisions. In essence, the pollution prevention and BMP requirements operate as limitations on effluent discharges that reflect the application of BAT/BCT. Flexibility in Tier Responses: Tier Two actions provide an opportunity for the permittee to propose an alternative monitoring plan for approval by the Region: • Alternatively, in lieu of steps 2 and 3, the permittee may, after two consecutive exceedances, exercise the option of contacting the DEMLR Regional Engineer as provided below in Tier Three. The Regional Engineer may direct the response actions on the part of the permittee as provided in Tier Three, including reduced or additional sampling parameters or frequency. • If pursuing the alternative above after two consecutive exceedances, the permittee may propose an alternative monitoring plan for approval by the Regional Engineer. The permit therefore allows the permittee to petition the Regional Office for monitoring changes sooner than Tier Three (upon any four benchmark exceedances) and gives guidance on one option to take. For example, the permittee may request that mercury only be monitored semi-annually under the tiers, or that only parameters over the benchmark be monitored more frequently. In this way, changes to the monitoring scheme for any outfall could be handled outside of a permit modification. Other Proposed Requirements: • It is standard for Stormwater Pollution Prevention Plan(SWPPP)requirements to include an annual certification that stormwater outfalls have been evaluated for the presence of non- stormwater discharges, and if any are identified, how those discharges are permitted or otherwise authorized. • Requirement to submit a request for permit modification if the facility identifies or creates any new outfalls, removes outfalls, or alters any drainage area that changes potential pollutants. • The Division expects the permittee to apply best professional judgment and consider the safety of its personnel in fulfilling sampling obligations under the permit. • Federal regulations require electronic submittal of all discharge monitoring reports (DMRs). If a state does not establish a system to receive such submittals, then permittees must submit DMRs electronically to the EPA. • Quarterly QualitativeNisual Monitoring to assure regular observation of outfalls throughout year. Section 4. She may have neglected to consider the SIC code,which is not listed as an applicable SIC code for the general permits. 1/30/2023—Updated renewal documents were submitted by Jowat to include the recent purchase of an adjacent parcel of property. 10/19/2023—I spoke with Kevin Woods of AERIS Environmental [704-641-7003],who has provided stormwater environmental services for this facility for several years. He stated that he updated the SWPPP in January 2023 prompting the updated application that was submitted. He mentioned that the property acquired was previously owned by Novamelt and previously had a no-exposure certification. He stated that he wasn't certain whether a no-exposure request had been submitted at any point, but he believed the most recent application, the January 2023 updated renewal application, should take precedence over any previous application. Hydraulic and lubricating oil is present throughout the facility production areas. Limited drummed oil and chemical products are stored at the facility, and typically indoors or under cover. Drums and totes of oil and other chemical substances are typically stored indoors on spill pallets to contain any leakage. Drums and other containers are kept closed at all times except when in use. New and used oil drums and totes will also be stored in the Satellite Building located on the east side of the PUR Building. Formerly used for flammable liquid storages, the building is adequately curbed to prevent spills from exiting the building walls. Locations of drum storage are noted on the facility site plan (Figure 3). There are spill kits and response materials located onsite that can be used to remove spilled oil. The interior location of drum storages/use, lack of floor drains and limited building openings to the outdoors will allow building walls to serve as adequate secondary containment for anticipated spills. Jowat will have spilled and used oil and chemicals removed from the facility by appropriate contractors for offsite disposal. 2.1.2 Above Ground Storage tanks Jowat has two above ground storage tanks (AST), both 5,000-gallon wastewater tanks. Tank 1 is located outdoors on the south side of PUR Building. Tank 2 is located outdoors at the northeast corner of the manufacturing building. Both wastewater tanks are double-wall design for inherent Page 1 of 8 Jowat Corporation Archdale, North Carolina 10/27/23 containment. The wastewater tanks are emptied by pumping to a tanker truck. The configuration of the paved tanker truck parking area at the PUR Building during transfers from Tank 1 allows containment of approximately 2,000 gallons (6 in. x 25 ft. x 25 ft.), sufficient to contain spills occurring during transfer operations. Although there is not a dedicated containment area for the tanker truck during transfers from Tank 2 at the northeast corner of the Manufacturing Building, any spill would flow toward and be contained by the storm water retention basin. Jowat has six outdoor storage silos located outdoors on the south side of the manufacturing facility. Five of the silos are used to store solid ethylene vinyl acetate (EVA) copolymer granules. Silo No.4 is used to store pulverized limestone(calcium carbonate). During the warmest summer months (internal silo temperatures in excess of 101°F), approximately 45 gpm of water is applied to the exteriors of each EVA silo for evaporative cooling. The water is collected in an annular trough and returned for re-use. A list of above ground storage tanks and containers at the facility is provided in Table 1 - Facility Tanks and Bulk Liquids Storage. The indoor location of the majority of hydraulic equipment and the presence of catch pans, sumps and absence of floor drains will allow the building walls to contain most spills. The probability of any spill from this operational equipment reaching navigable waters is small. This operational equipment will be included in the routine inspections conducted in accordance with this plan; and any spills from this equipment will be addressed in accordance with this plan. This operational equipment is not subject to the 40 CFR 112 requirements for bulk storage containers, although the equipment will be included in the routine inspections conducted in accordance with this plan; and any spills from this equipment will be addressed in accordance with this Plan. For oil-filled operational equipment, the oil spill regulations allow an alternative to providing secondary containment. The facility may instead implement an inspection and monitoring program, develop an oil spill contingency plan and provide a written commitment of resources to control and remove discharged oil. Oil-filled operational equipment is eligible for this provision if during the past three years, releases from the equipment during any twelve-month period meet the following criteria: (1) no releases that reach navigable waters of more than 1,000 gallons in a single discharge, or (2) no more than two discharges exceeding 42 gallons that reach navigable waters. Jowat has not had any releases of oil during the past three years and therefore has the option to develop an oil spill contingency plan to address secondary containment for the oil-filled operational equipment. The oil spill contingency plan is detailed in Section 4.4 of this Plan. Page 3 of 8 Jowat Corporation Archdale, North Carolina 10/27/23 2.1.4 Heat Transfer Fluid The manufacturing process includes melting ethylene vinyl acetate pellets for molten mixing and extrusion as finished pastilles for shipping as hot melt adhesives. Heat transfer fluid (Mobiltherm 43) is used to provide heat to the process. A gas-fired boiler is used to heat the fluid which is piped throughout the manufacturing areas. The total quantity of heat transfer fluid in the system is approximately 800 gallons. The boiler room is designed to contain the full volume of heat transfer fluid. 2.1.5 Transformers One oil-filled transformer containing 416 gallons of oil is located on the east side of the Boiler Building on a concrete pad. A second oil-filled transformer containing 312 gallons of oil is located south of the manufacturing facility along Lois Lane, also on a concrete pad. A third oil-filled, pole- mounted transformer containing an unknown quantity of oil (<100 gallons) is located on the eastern edge of the facility along Evelyn View Drive. A fourth oil-filled transformer containing 227 gallons of oil is located outside the east wall of the former Henkel Building. An evaluation of soil characteristics, compaction, and possible subsurface conduits in the areas of the transformers has not been completed. The transformers are owned, operated, and maintained by the local utility which is ultimately responsible for spill prevention and control from the transformers. 2.1.6 Loading/Unloading Areas Tanker trucks load wastewater from the 5,000-gallon wastewater tank outside the east side of the PUR Building and outside the northeast corner of the Manufacturing Building in the immediate area of the tanks. Containment for a tanker truck compartment is not necessarily required, as a catastrophic truck failure is not deemed particularly likely. The likely potential release during wastewater loading would be a hose break. Based on a maximum pump rate of 35 gallons per minute and an expected time of 30 to 60 seconds to shut down the transfer pump, containment for a pumped volume of up to 35 gallons would be required in the event of a release. Page 4 of 8 Jowat Corporation Archdale, North Carolina 10/27/23 Loading/unloading areas are relatively level and the areas free of storm drains. Spill containment equipment including sorbent pads, socks or pillows and protective equipment is present in loading/unloading areas. Administrative controls, including procedures for monitoring and responding to situations that could potentially result in spills, are used to prevent spills from occurring during tank loading/unloading operations. Any spill exiting the immediate areas would be routed toward stormwater drains or northward along Evelyn View Drive to the firewater retention pond which would provide adequate secondary containment and prevent discharge from the site. 2.1.7 Dumpsters/Compactors The facility may periodically use one or more dumpsters for office and general plant waste and periodic removal for disposal. Dumpsters will be either enclosed or covered when not actively in use to prevent stormwater intrusion. 2.1.8 Outdoor Material Storages The facility may periodically store pallets, bulk shipping containers and unused equipment outdoors. Pallets and unused equipment will be free of potential contaminants prior to placement outdoors. The exteriors of empty bulk shipping containers will be clean, and the containers sealed to prevent rainwater intrusion. 2.1.9 Vehicle Maintenance Vehicle maintenance activities involving more than 55 gallons of new motor oil per month when averaged over the calendar year are not conducted at the facility. In the event that such activity does occur, Part II, Section D of the current stormwater permit (ID No. NCS000133 effective August 1, 2017) will apply. Page 5 of 8 Jowat Corporation Archdale, North Carolina 10/27/23 2.1.10 Stormwater Exposures Outdoor storages exposed to stormwater events are generally limited. Raw materials and finished products are stored indoors. 2.1.11 Particulate Control The majority of particulates potentially present in stormwater discharges will be associated with asphalt/concrete parking lots and traffic routes. 2.2 Outfalls and Potential Pollutants The facility terrain generally slopes eastward toward the property boundary and nearby unnamed tributary of the Uwharrie River. Stormwater is routed to and through conveyances, discharging through one of three outfalls to one of two tributaries of the Uwharrie River. A stormwater retention pond located at the northeast corner of the facility serves to capture the majority of stormwater from the site. Floor drains are not present within the facility buildings. The following table summarizes the drainage area at the facility. The percentage of impervious surface area was estimated and calculated based on the site map. Stormwater originates from the gravel parking lot and roof drains. There is limited industrial activity routinely exposed to stormwater. Impact from off-site is limited to Lois Lane. The drainage area is characterized as being approximately 80% impervious. Potential pollutants associated with the outfall include Total Suspended Solids (TSS) and oil and grease from parking areas. There are no floor drains inside the facility which could discharge pollutants to the stormwater drainage area. Outfall No. 2—Outfall No. 2 is located near the southwest corner of the property north of Outfall No. 1 and is the point source of a vegetated and gravel ditch line that is located west of the manufacturing facility. Stormwater run-off is received from a drainage area that encompasses a vegetative area, an unpaved parking lot, a concrete pad, and roof drains. Impact from off-site sources has been determined to be minimal but could include Uwharrie Road and Lois Lane. Impervious surfaces represent approximately 70% of the drainage area. Potential pollutants associated with the outfall include Total Suspended Solids (TSS) and oil and grease from parking areas. Raw materials and additives are unloaded at the receiving dock at the west end of the facility. This dock has a covered canopy which prevents stormwater contact. Spills and leaks from storage areas located within the manufacturing facility do not appear to pose a hazard to stormwater discharges since the facility does not have any floor drains in the manufacturing and storage areas inside the facility. Outfall No. 3—Outfall No. 3 is located northeast of the stormwater retention pond and receives stormwater from most of the facility. Roof drains are routed to stormwater conveyances. A double-wall 5,000-gallon wastewater storage tank is present on the south side of the PUR Building. Miscellaneous equipment storage is present on the concrete pad adjacent to the east side of the PUR Building. The drainage area is characterized as being approximately 30% impervious surfaces. We do not discharge any machine waste, or waste of any kind into the storm system. Our waste is contracted out to be removed from our facility from the two storage tanks that we have on site. The site plan was included in the original renewal permit showing these two storage tanks. Our storm water permit is strictly based on the amount of rain fall we receive. Form 1 indicates that if we answer No to section 1 this will be complete and we are not required to do any further action. I apologize for not understanding the reason for the forms that do not pertain to our processes. Can you please verify that Form 1 and Form 2F are required for our permit, if so I will have them completed immediately and sent to you. Material Handling Equipment: Forklifts,pallet jacks,and other material handling equipment where failure could lead to spills or leaks that could cause contamination of surface water. 7 Roof exhausts:Fans,exhaust piping,and equipment where failure could lead to contamination of surface water via roof drains. 8. The perimeter around the manufacturing building will be inspected to detect any leaks and/or spills associated with indoor equipment,shipping and receiving operations, and other potential equipment failures These inspections and any subsequent maintenance activities performed as d result of the inspection will be ducumented using this log sheet and maintained in Appendix D of the SWPPP All records are to be maintained for at least five(5)years. Jowate Best Management Practices at Jowat Corp. consist of several plans. All water waste is disposed of thru an outside contractor and taken offsite. We have in place an Oil Contingency Plan that is monitored thru our monthly documented inspections. Preventive Maintenance is a regular inspection consisting of testing of our equipment and operational systems. Good Housekeeping is maintained and documented on a daily schedule. SPCC inspections are conducted monthly and documented. Storm water outfalls are inspected monthly and documented. Material Storage Practices are maintained thru our SAP system. Inspections will occur once during the first half of the year(January -June)and once during the second half of the year(July-Oecember),with at least 60 days separating the inspection dates(unless performed more frequently than semi-annually): 1. The storm drams and outf ill at the facility will be inspected for integrity and signs of erosion. 2. tither drainage areas around the perimeter of the property will be inspected for signs of erosion associated with stormwater discharge. 3. Bulk storage tanks for oils,liquid materials,and fuels: Filling and unloading pumps,valves,piping,flanges,drainage devices,etc where failure could lead to spills or leaks that could cause contamination of surface water. 4 The outdoor chillers and transformers will be inspected to prevent leaks and/or spills from impacting stormwater runoff. S. Receiving and shipping docks: Finished goods will be stored inside the facility. Miscellaneous 55 gallon drums(full or empty)will be stored in designated holding areas, and not on or near any dock areas. 6. Material Handling Equipment: Forklifts,pallet jacks,and other material handling equipment where failure could lead to spills or leaks that could cause contamination of surface water 7 Roof exhausts:Fans,exhaust piping,and equipment where failure could lead to contamination of surface water via roof drains. 8. The perimeter around the manufacturing building will be inspected to detect any leaks and/or spills associated with indoor equipment,shipping and receiving operations, and other potential equipment failures. These inspections and any subsequent maintenance activities performed as d result of the inspection will be documented using this log sheet and maintained m Appendix O of the SWPPI, Ali records are to be maintained for at least five(5)years. Jowats Best Management Practices at Jowat Corp. consist of several plans. All water waste is disposed of thru an outside contractor and taken offsite. We have in place an Oil Contingency Plan that is monitored thru our monthly documented inspections. Preventive Maintenance is a regular inspection consisting of testing of our equipment and operational systems. Good Housekeeping is maintained and documented on a daily schedule. SPCC inspections are conducted monthly and documented. Storm water outfalls are inspected monthly and documented. Material Storage Practices are maintained thru our SAP system_ Spill clean-up kits located thru out our facility. At present we have had no significant changes in our day to day operations.
