Dear Mr. Grant,
This office has reviewed the subject erosion and sedimentation control plan. We find the
plan to be acceptable with modifications and hereby issue this letter of Approval with
Modifications.The Modifications Required for Approval are listed on the attached page.
This plan approval shall expire three (3) years following the date of approval,if no land-
disturbing activity has been undertaken, as is required by Title 15A NCAC 4B .0129.
As of April 1, 2019, all new construction activities are required to complete and submit an
electronic Notice of Intent (eNOI) form requesting a Certificate of Coverage (COC) under
the NCG010000 Construction General Permit. After the form is reviewed and found to be
complete, you will receive a link with payment instructions for the $100 annual permit fee. '
After the fee is received,you will receive the COC via email. You MUST obtain the COC prior
to commencement of any land disturbing activity. The eNOI form may be accessed at
deq.nc.gov/NCG01. Please direct questions about the eNOI form to Paul Clark at

Paul.clark@ncdenr.gov. If the owner/operator of this project changes in the future, the
new responsible party is required to apply for his/her own COC.
Title 15A NCAC 4B .0118(a) and the NCG01 permit require that the following
documentation be kept on file at the job site:
1. The approved E&SC plan as well as any approved deviation.
2. The NCG01 permit and the COC, once it is received.
3. Records of inspections made during the previous 12 months.
Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic
inspection to insure compliance with the approved plan.
North Carolina's Sedimentation Pollution Control Program is performance-oriented,
requiring protection of existing natural resources and adjoining properties. If, following
the commencement of this project, it is determined that the erosion and sedimentation
control plan is inadequate to meet the requirements of the Sedimentation Pollution Control
Act of 1973 (North Carolina General Statute 113A-51 through 66),this office may require
revisions to the plan and implementation of the revisions to ensure compliance with the
Act.
Acceptance and approval of this plan is conditioned upon your compliance with Federal
and State water quality laws, regulations, and rules. In addition, local city or county
ordinances or rules may also apply to this land-disturbing activity. This approval does not
supersede any other permit or approval.
Please note that this approval is based in part on the accuracy of the information provided
in the Financial Responsibility Form, which you provided. This permit allows for a land-
disturbance, as called for on the application plan, not to exceed the approved acres.
Exceeding the acreage will be a violation of this permit and would require a revised plan
and additional application fee. You are requested to file an amended form if there is any
change in the information included on the form. In addition, it would be helpful if you
notify this office of the proposed starting date for this project.

MDIFICATIONS REQUIRED FOR APPROVAL
Project Name: LEGACY AT MILLS RIVER PHASE I
Project ID: HENDE-2023-005

For final plan approval please provide two revised plan sets that address the modifications
listed below.
1. Provide perimeter controls downgradient of basin construction until basin slopes
are stabilized, and emergency spillway is constructed. [G.S. 113A-57.(3)]
2. Provide velocities for the design storm event for the stormwater drainage
calculations, and use runoff coefficients based on final site conditions for permanent
ditch sizing calculations. [15A NCAC 04B .0108]
3. Runoff must be diverted to the designed inlets for all sediment basins. Inlets must
be stabilized from the top of bank to extend into the basin floor. Clearly illustrate or
provide detail for proposed joining points for conveyances. [15A NCAC
04B .0106(a)(4)]
4. Provide a disturbed acreage maximum,based on proximity to streams no more than
25 acres should be open at one time during initial grading operations. Show acreage
delineations on E&SC plan sheet. [15A NCAC 04B .0106(a)(2)]
5. Revise construction sequence to include the following language: notify NCDEQ LQS
inspector 48 hrs before project starts; all work within riparian buffers must be
stabilized by the end of each workday; for larger or complex add phasing to sequence
a maximum limit of acres, including any clearing and grubbing. Please include in
the sequence that any clearing and grubbing, shall be limited to the active -acre
phase. Prior to moving into the next phase, all erosion and sediment control
measures specified on the next phase must be installed. Sediment basins and traps
must be stabilized immediately upon construction. Once all measures on the next
phase have been installed and the active phase has been stabilized, construction
activities may progress into the next phase; for larger phased projects, a site
inspection should be requested at the completion of each phase of land-disturbance.
A new phase may not be disturbed until a Sedimentation Inspection Report is issued
documenting that the previous phase has adequate temporary or permanent ground
cover; specify order in which significant E&SC measures must be installed and
related areas in which they protect i.e. TCE, then perimeter controls, stabilized
outlets,then basins,then conveyances,proceed with clearing and grubbing for Phase
X, install additional measures X, then XX, then XXX for Phase II, continue to add
stabilization and seeding for areas not stabilized; specify the order that the traps and
basins and their collection systems be installed in before any other grading takes
place on site, prior to construction of the sediment basin, silt fence shall be installed
below the toe of the proposed embankment of the sediment basin to prevent
sedimentation damage during sediment trap construction; sediment basin and trap

embankments shall be provided with adequate groundcover immediately upon
construction;after the drainage areas to the basins and traps have been permanently
stabilized, dewater the basins. Fill the basins using stockpiled soil and bring to finish
grade in compacted lifts. Smooth the basin sites to blend with the surrounding area,
ensuring the basin sites will not pond water,and immediately permanently stabilize;
dewatering operations must be discharged into adequate stilling basin or
comparable measure to prevent the discharge of sediment; construct SW system
from point A to point B while installing inlet protection as soon as each inlet is
constructed; inspect and cleanout SW system before bringing online; specify when
E&SC measures are to be converted into post-construction SW BMP's i.e. sediment
basin converted to retention pond - requires separate individual sequence for
conversion; site must be "storm ready" before any extended breaks in construction
activities including weekends. [15A NCAC 04B .0106(a)(3)]
6. Provide surface preparation detail for seeding. Due to proximity to streams and
wetlands,fertilizer application rates must be applied per soil test recommendations.
Remove generic rates from seeding details. No fertilizer use is allowed within
stream buffers. [G.S. 113A-57.(3)]
7. Clearly define on plan sheets, call outs, and legend the proposed silt fence, wire
backed double row silt fence, or super silt fence locations. [G.S. 113A-57.(4)]
8. Provide construction sequence for creek crossings. All work must be done in the dry,
during dry weather, and must be stabilized at the end of each work day with
biodegradable netting. Provide construction details for all creek crossing
components. [15A NCAC 04B .0106(a)(3)]
9. Provide local post-construction SW authority approval or verification of permitting
status.
10. Provide verification that 404/401 permitting has been applied for, approved, or is
not required for the proposed stream construction activities.
