HomeMy WebLinkAboutNCC233216_ESC Approval Submitted_20231027 WILSON NORTH CAROLINA October 24, 2023 To: Watson Caviness Heritage Crossing Holdings, LLC 639 Executive Place, Suite 400 Fayetteville, NC 28305 SUBJECT: Local Sedimentation and Erosion Control Program Approval The Carolinian (EC-082523) Previously referred to as the Heritage Crossing Apartments Mr. Caviness, The City of Wilson received a revised FRO and associated back-up documentation dated October 24, 2023 stating the owner changed from Caviness & Cates to Heritage Crossing Holdings, LLC. Additionally, the project name has been changed from Heritage Crossing Apartments to The Carolinian. The erosion control plan for the Carolinian submitted by WithersRavenel for the disturbance of 22.60 acres is approved. WithersRavenel has addressed all outstanding comments. Thus, the plan is approved. This plan approval shall expire three years following the date of approval, if no land-disturbing activity has been undertaken, as required by 15A NCAC 4B .0129. This approval was based partially on the accuracy of the information provided in the Financial Responsibility Form. You are requested to file an amended form if there is any change in the information included on the form. The City of Wilson has been granted delegated authority from the North Carolina Division of Energy, Mineral and Land Resources to regulated land disturbing activities subject to the Sedimentation Pollution Control Act of 1973. This Act is performance oriented, requiring protection of existing natural resources and adjoining properties. If the approved sedimentation and erosion control plan is inadequate to meet the requirements of the Act, this office may require revisions to the plan and implementation of the revisions to insure compliance with the Act. Acceptance and approval of this plan is conditioned upon your compliance with all Federal, State, and City of Wilson's ordinances as applicable to this land disturbing activity. Please be aware that this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic inspections to insure compliance with the approved plan. As of April 1, 2019, all new construction activities are required to complete and submit an electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the NCG010000 Construction Stormwater General Permit. This form shall be submitted prior to the commencement of any land disturbing activity on this project. The NOI form may be accessed at deq.nc.gov/ncg01. Please direct all questions about the NOI form to NC DEQ. After you submit a complete and correct NOI Form, a COC will be emailed to you within three business days. Title 15A NCAC 4B .0118(a) and the NCG01 permit require that the following documentation be kept on file at the job site: 1. The approved E&SC plan as well as any approved deviations/revisions; 2. The NCG01 permit and COC; and 3. Records of all required inspections made during the previous 30 days. The General Contractor or delegated agent is required to set up an erosion control pre- construction meeting (before construction begins) with the City Staff.
