A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. Please provide the original contours, proposed contours, and spot elevations on the plans. 2. Please provide and show drainage easements for the swales. 3. The note on the plans that "There are no known wetlands..." is a little too vague. If there has been a site visit by someone professionally able to determine wetlands and they have found none over the entire site, than please note that there are no wetlands. If a site visit has not been performed, then please do so. 4. On page C1 of the plans submitted it is believed that there should be a swale provided between lots 48&49 and also between lots 55&56. Please verify and correct. Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to July 30, 1999, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. The Division is allowed 90 days from the receipt of a completed application to issue the permit. If you have any questions concerning this matter please feel free to call me at (910) 395-3900. Please be advised that this Act requires that all persons disturbing an area of one or more acres of land must obtain approval of a soil erosion control plan prior to the commencement of said land-disturbing activity (NCGS 113A-54(d)(4)). The Act further states that this plan must be filed a minimum of 30 days prior to the activity and the approving authority must approve or disapprove the submitted plan within 30 days of receipt. Failure of the approving authority to approve or disapprove the submitted plan within the 30 day period will be deemed approval of the plan if the submitted plan is complete. Commencement or continuation of a land-disturbing activity under the jurisdiction of this Act prior to the approval of an erosion and sediment control plan is a violation of the Act. We have performed a preliminary review of your submitted plan and have determined that additional information will be necessary before a final review can be completed. Enclosed is a checklist of items that must be submitted before we can complete the review process. Failure to provide the additional information may result in disapproval of your plan. The existing site is currently an 83 acre wooded tract. The site is 83 acres with 0 acres of existing impervious area and 24.9 acres of proposed impervious area. This equates to 30% impervious coverage. Therefore, the site is eligible for the State low density stormwater option. Stormwater runoff will sheetflovyl from proposed impervious surfaces sivRr grassed areas into grassed swales. The grassed swales will convey the stormwater into natural channels that lead offsite. The grassed swales are in excess of 100' in length, have sideslopes no steeper than 3:1, and have a longitudinal slope of less thin five percent. Box 877 Shallotte, NC 28459 Project Name: Lakewood Estates Additional Phases Project No: 990408BR Brunswick County Dear Mr. Chappell: On April 5, 1999, personnel of this office inspected a project located on SR 1184 in Brunswick County, North Carolina. This inspection was performed to determine compliance with the North Carolina Sedimentation Pollution Control Act of 1973. The inspection revealed a land-disturbing activity of approximately 2 acres being conducted. It is our understanding that you and your firm are responsible for this land-disturbing activity. The purpose of this letter is to inform you that this activity was found to be in violation of the Act, NCGS 113A-50 to 66, and Title 15A, North Carolina Administrative Code, Chapter 4. If you feel that you are not responsible for the following violations, please notify this office immediately. The violations that were found are: 1. Failure to file an erosion control and sedimentation control plan with this office at least 30 days prior ro beginning a land-disturbing activity on a tract comprising more than one acre, when more than one acre is to be uncovered, failure to secure this office's prior approval of the plan for any land-disturbing activity. NCGS 113A-57(4) abd 15A NCAC 46.0007(c). An erosion and sedimentation control plan has not been submitted to this office for the additional site improvements on the side of the existing development. 2. To correct these violations, you must: 1. Submit an erosion and sedimentation control plan to this office for the referenced project. 2. Install the measures, structures and/or devices necessary to control erosion and retain sediment on site. • Please be advised that if these violations are not corrected within 20 days of receipt of this notice, the Director, Division of Land Resources, will be requested to take appropriate legal action against you pursuant to NCGS 1 13A-64. That action could be the assessment of a civil penalty and the amount may be up to $500 per day for each day of the violation. The penalty may be assessed from the date of your receipt of this Notice of Violation. (15A NCAC 4C.0007). If these violations are corrected within the time period specified for compliance, no further legal action will be pursued. Pursuant to NCAC 15A:4C.0007(a), please be advised that the project is being referred immediately to the Director, Division of Land Resources, for appropriate legal action. Action could include an assessment of civil penalties of up to $500.00 for beginning a land disturbance without benefit of plan approval, the issuance of a stop work order, or both. In addition, if the additional violations are not corrected within 20 days of the receipt of this notice, the Director will be requested to take additional legal action pursuant to NCAC 113A-64. That action could be the assessment of a civil penalty and the amount may be up to $500.00 per day for each day of the violation. The penalty may be assessed from the date of your receipt of this Notice of Violation (15A NCAC 4C.0007). Please be advised that any new land-disturbing activity associated with this project must not begin until the area presently disturbed is brought into compliance with the Act. When corrective actions are complete, you should notify this office so the work can be inspected. You should not assume that the property is in compliance with the Act until we have notified you. After installation, all erosion control measures must be maintained in proper working order until development is complete and the site is completely stabilized. We solicit your cooperation, and would like to avoid taking further enforcement action. At the same time, it is your responsibility to understand and comply with the requirements of the Act. Copies of the relevant statute and administrative rules may be examined at this office or will be sent to you upon request.
