Dear Mr. Gintert:
On September 25, 2023, the Division of Water Resources' Municipal Unit received a request to revise the renewal date for McAlpine Creek's Headworks Analysis (HWA) due 180 days following the issue of the permit. The current date for McAlpine Creek’s HWA submission is December 1st, 2023.

After reviewing the proposal, the Division has determined the 180 day request following the issuance of the McAlpine Creek NPDES permit to be satisfactory. The Division recognizes that a new NPDES permit will be issued to the McAlpine Creek facility imminently. One of the requirements of a new NPDES permit is the revision of the HWA. Therefore, a new deadline has been established for the submission of McAlpine Creek's HWA, which must be no later than 180 days after the Division has
renewed and issued the NPDES permit number NC0024970.

Federal and State pretreatment regulations require the local delegated pretreatment program to
effectively control and document the discharge of wastewater from Significant/Categorical Industrial
Users to the POTW. It is the POTW’s responsibility to ensure that these objectives are consistently met.
