We find the plan to be acceptable with modifications and hereby issue this letter of Approval with Modifications.The Modifications Required for Approval are listed on the attached page. This plan approval shall expire three (3) years following the date of approval,if no land-disturbing activity has been undertaken, as is required by Title 15A NCAC 4B .0129. As of April 1, 2019, all new construction activities are required to complete and submit an electronic Notice of Intent (eNOI) form requesting a Certificate of Coverage (COC) under the NCG010000 Construction General Permit. After the form is reviewed and found to be complete,you will receive a link with payment instructions for the $100 annual permit fee. After the fee is processed, you will receive the COC via email. As the Financially Responsible Party shown on the FRO form submitted for this project,you MUST obtain the COC prior to commencement of any land disturbing activity. The eNOI form may be accessed at deq.nc.gov/NCGO1. Please direct questions about the eNOI folio to the Stonnwater Program staff in the Raleigh central office. If the owner/operator of this project changes in the future, the new responsible party must obtain a new COC. The approved E&SC plan as well as any approved deviation. 2. The NCG01 permit and the COC, once it is received. 3. Records of inspections made during the previous 30 days. Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic inspection to ensure compliance with the approved plan. North Carolina's Sedimentation Pollution Control Act is performance-oriented,requiring protection of existing natural resources and adjoining properties. If,following the commencement of this project,it is determined that the erosion and sedimentation control plan is inadequate to meet the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 113A-51 through 66), this office may require revisions to the plan and implementation of the revisions to ensure compliance with the Act. Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water quality laws, regulations, and rules. In addition, local city or county ordinances or rules may also apply to this land- disturbing activity. This approval does not supersede any other permit or approval. Please note that this approval is based in part on the accuracy of the information provided in the Financial Responsibility Form, which you provided. You are requested to file an amended form if there is any change in the information included on the form. In addition, it would be helpful if you notify this office of the proposed starting date for this project. Your cooperation is appreciated. An accurate and completed Financial Responsibility/Ownership Form (FRO) shall be submitted to this office prior to the start of land disturbance activities. The Latitude and Longitude shall be provided in Part A, Item 2. The correct Registered Agent, for Baybridge Moore Farm, LLC, shall be provided in Part B, Item 2(a). 2. Provide written permission from the following property owners allowing land disturbance activities on their property: MD7 Moore Farm, LLC and Moore Farm Homeowners Association,Inc. The written permission must explicitly identify and give permission to Baybridge Moore Farm, LLC to conduct land disturbance activities on their property. This written permission shall be provided prior to the start of land disturbance activities. 3. Provide written documentation from the Regulating Authority (e.g. Indian Trail, Union County, etc.) indicating that all required stream buffers have been provided on the plans as required. The written documentation shall be provided prior to the start of land disturbance activities. 4. For Basin #3/BMP-1: The basin shall be excavated in Phase 1 to allow the skimmer to be installed within the riser structure at the lowest possible elevation and still achieve positive drainage through the riser structure. The bottom of the basin shall not exceed 1' below the skimmer invert during any phase. All openings below the top of the riser structure shall be temporarily blocked while basin is being used for erosion control. If full depth excavation of basin(e.g. for final BMP depth) cannot obtain positive drainage through the riser structure, the bottom of the basin shall be raised temporarily as necessary while basin is being used for erosion control. The full depth excavation cannot occur until all upland areas have been stabilized and the basin can be converted to the final BMP structure. 5. Inlet protection shall be provided for existing inlets located within the Limits of Disturbance(LOD). 9. On Sheet C-2.05 (and subsequent phases), inlet and outlet protection shall be provided for the new;pipe system located under Old Evergreen Pkwy. In addition, adequate inlet protection shall be provided for existing 15" RCP on NW side of roundabout. 10. On Sheet C-2.08,Ditch PD-1 shall be stabilized with adequately sized rip-rap immediately upon installation. Installation of this ditch shall start at the outlet end and work upstream until ditch is completed. All channel excavation shall be stabilized with rip-rap at the end of each working day. 11. On Sheet C-2.19, if the proposed grass liner fails to adequately stabilize any of the temporary ditches (e.g. SB-2B, SB-2B-2, SB-4B, SB-5B, SB-5B-2, SB-6C, SB-7A, SB-9A, SB-9A-2, SB-9B and SB-9B-2), the ditch shall be lined with an adequately sized rip-rap.
