A copy of the Compliance Inspection Report is enclosed for your review. Cody Tilberg was also present during the inspection and his time and assistance is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit NCG210000 under Certificate of Coverage NCG210353. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as Reedy Creek, class C waters in the Yadkin Pee-Dee River Basin. As a result of the inspection,the facility was found to be noncompliant with the conditions of the NCG210000 permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty assessment of up to $25,000 per day for each violation. Qualitative monitoring was being conducted and data was present for 2023. Qualitative monitoring records were missing for 2019-2022. All analytical data was reported as no-flows.According to Cody Tilberg, all outfalls are at basins once used when the land the facility currently operates on was a landfill. The basins were visually confirmed during the inspection. Cody Tilberg claimed that due to topography, the three of the four basins(outfalls 1-3)no longer receive flow from the site due to topographical changes. This may indicate the basins are eligible for representative outfall status (ROS). However, an updated topographical map as well as continued sampling efforts will be necessary to prove ROS eligibility. Outfall 4,while also reported as a no flow, is located at the west side of the site and was indicated to receive all the site's stormwater. The basin was retaining water at the time of the inspection, but no flow was observed. The riser structure, an approximately 4ft diameter CMP,was rusted and damaged.After discussing the issues at this location with Cody Tilberg, he indicated the facility was preparing to repair the riser structure and outfall. This may lead to proper outfall function, or otherwise discovery of issues creating the no flow results for outfall 4. Though the site is reporting no flows, discharge monitoring reports (DMRs) are required to be submitted. The facility should register for eDMR and begin using as soon as the registration is complete. Until then, DMRs may be submitted to the Regional Office.
