Staff review of the plans and specifications has determined that the project,as proposed,will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following specific conditions and limitations: I. DESIGN STANDARDS 1. The project is a golf course with condominium/apartment-style buildings,parking, roads, and cartpaths. The tract is limited to a maximum of 201.53 acres of built-upon area, as defined by the stormwater rules, and as indicated in the approved plans. CAMA regulations may reduce the built-upon area for those areas within CAMA's AEC. 2. The overall tract built-upon area percentage for the project must be maintained at 25%, per the requirements of Section .1005 of the stormwater rules. 3. This project proposes a curb outlet system. Each designated curb outlet swale or vegetated area to be used for treatment of the runoff must be maintained at a minimum of 100'long,have 5:1 (H:V) side slopes or flatter, a longitudinal slope no steeper than 5%, carry the flow from a 10 year storm in a non-erosive manner,maintain a dense vegetated cover, and be located in either a dedicated common area or a recorded drainage easement. 4. No piping shall be allowed except those minimum amounts necessary to direct runoff beneath an impervious surface such as a road, or under the fairways, as shown on the approved plan. 5. Runoff conveyances other than the curb outlet system swales, such as perimeter ditches, must be vegetated with side slopes no steeper than 3:1 (H:V). 6. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. State Stormwater Management Systems Permit No. SW8 031059 II. SCHEDULE OF COMPLIANCE 1. Curb outlet swales, vegetated areas and other vegetated conveyances shall be constructed in their entirety,vegetated, and be operational for their intended use prior to the construction of any built-upon surface, per the approved plans 2. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b. Sediment removal. c. Mowing, and revegetating of the swale side slopes. d. Immediate repair of eroded areas. e. Maintenance of swale side slopes in accordance with approved plans and specifications. f. Cleaning and repair of catch basin grates, flumes, and piping. 4. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans,regardless of size. b. Project name change. c. Transfer of ownership. d. Redesign or addition to the approved amount of built-upon area or to the drainage area. e. Further subdivision, acquisition or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought. f. Filling in,piping, or altering any vegetative conveyance shown on the approved plan. 5. The Director may determine that other revisions to the project should require a modification to the permit. 6. The permittee is responsible for verifying that the proposed built-upon area does not exceed the allowable built-upon area. Additions to the permitted amount of built-upon area must be approved through a permit modification. 7. The permittee must certify in writing that the project's stormwater controls, and impervious surfaces have been constructed within substantial intent of the approved plans and specifications. Any deviation from the approved plans must be noted on the Certification. The permittee shall submit the Certification to the Division within 30 days of completion of the project. 8. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. 9. The built-upon area covered by this permit must be located a minimum of 30 feet from the Mean High Water line of surface waters. 10. All roof drains must terminate at least 30' from the Mean High Water mark. 11. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame spccified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 3 State Stormwater Management Systems Permit No. SW8 031059 12. Prior to transfer of ownership, any permitted stormwater treatment devices such as swales must be inspected and determined to be in compliance with the permit. Any deficiencies will be repaired or replaced prior to the transfer. 13. The final plats for the project will be recorded showing all required swale easements and common areas,in accordance with the approved plans. III. GENERAL CONDITIONS 1. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. 2. The permit issued shall continue in force and effect until revoked or terminated. 3. The permit may be modified,revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws,rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al. 5. The permit is not transferable to any person or entity except after notice to and approval by the Director. The.Director may require modification or revocation and reissuance of the permit to change the name and incorporate such other requirements as may be necessary. A formal permit transfer request must be submitted to the Division of Water Quality accompanied by the appropriate fee, documentation from both parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits, and may or may not be approved. The permittee is responsible for compliance with all the terms and conditions of this permit until the transfer is approved by the Division. 6. The issuance of this permit does not preclude the Permitter from complying with any and all statutes,rules, regulations, or ordinances imposed by other government agencies (local, state and federal)which have jurisdiction. If any of those permits or approvals result in revisions to the plans, a permit modification must be submitted. 7. The permittee grants permission to DENR Staff to enter the property during business hours for the purposes of inspecting the stormwater control system and its components. 8. The permittee shall notify the Division of Water Quality of any name, ownership or mailing address changes within 30 days,via the"Name/Ownership Change Form". Impervious materials include asphalt,gravel, concrete, brick stone, slate or similar material but do not include wood decking or the water surface of swimming pools. 3. Swales shall not be filled in,piped or altered except as necessary to provide driveway crossings. 4. Built-upon area in excess of the permitted amount requires a state stormwater management permit modification prior to construction. 5. All permitted runofffrom outparcels or future development shall be directed into the permitted stormwater control system. The overall tract built-upon area percentage for the project must be maintained at 25%, per the requirements of Section .1005 of the stormwater rules. 3. This project proposes a curb outlet system. Each designated curb outlet swale or vegetated area to be used for treatment of the runoff must be maintained at a minimum of 100' long,have 5:1 (H:V) side slopes or flatter, a longitudinal slope no steeper than 5%, carry the flow from a 10 year storm in a non-erosive manner,maintain a dense vegetated cover, and be located in either a dedicated common area or a recorded drainage easement. 4. No piping shall be allowed except those minimum amounts necessary to direct runoff beneath an impervious surface such as a road, or under the fairways, as shown on the approved plan. 5. Runoff conveyances other than the curb outlet system swales, such as perimeter ditches, must be vegetated with side slopes no steeper than 3:1 (H:V). 6. SCHEDULE OF COMPLIANCE 1. Curb outlet swales,vegetated areas and other vegetated conveyances shall be constructed in their entirety,vegetated, and be operational for their intended use prior to the construction of any built-upon surface,per the approved plans 2. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b. Sediment removal. c. Mowing, and revegetating of the swale side slopes. d. Immediate repair of eroded areas. e. Maintenance of swale side slopes in accordance with approved plans and specifications. f. Cleaning and repair of catch basin grates, flumes, and piping. 4. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including,but not limited to, those listed below: a. Any revision to the approved plans,regardless of size. b. Project name change. c. Transfer of ownership. d. Redesign or addition to the approved amount of built-upon area or to the drainage area. e. Further subdivision, acquisition or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought. f. Filling in,piping, or altering any vegetative conveyance shown on the approved plan. 5. The Director may determine that other revisions to the project should require a modification to the permit. 6. The permittee is responsible for verifying that the proposed built-upon area does not exceed the allowable built-upon area. Additions to the permitted amount of built-upon area must be approved through a permit modification. 7. The permittee must certify in writing that the project's stormwater controls, and impervious surfaces have been constructed within substantial intent of the approved plans and specifications. Any deviation from the approved plans must be noted on the Certification. The permittee shall submit the Certification to the Division within 30 days of completion of the project. 8. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. 9. The built-upon area covered by this permit must be located a minimum of 30 feet from the Mean High Water line of surface waters. 10. All roof drains must terminate at least 30'from the Mean High Water mark. 11. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. Prior to transfer of ownership, any permitted stormwater treatment devices such as swales must be inspected and determined to be in compliance with the permit. If you don't mind I have a few follow up questions: 1) As I understand it, the October 2003 storm water permit was issued to the property thought to be the Pearl North, but the property is actually the Angels Trace Golf Course. Does this mean that the Pearl does not have an approved storm water (SW) permit for its current proposed planed development? 2) One of NCCF's primary concerns is regarding the stormwater issues arising from the current and proposed use of the property. As described in our April 11 and June 5 (see below) comments (both in the project file) on the 2003 SW application, a series of ditches (not 3:1 vegetated swales) , extensive piping, interconnected ponds and impounded waters of the Calabash River and direct outlets all work to direct stormwater with little or no treatment into the SA waters of the Calabash River. According to my conversation with Rick Shiver on Thursday, the agent for the Pearl said that all these elements of a discrete SW system were in existence prior to the 1988 SW certification for the property. Rick said that DWQ staff asked the applicant to supply information supporting this contention. Rick said that DWQ staff was satisfied with the applicants' supporting materials that they supplied. These supporting materials were not in the file for the project that I reviewed on Thursday. How may I gain access to them for review and could they be faxed to me? 3) The Pearl property now being reviewed under the express permit program is directly adjacent to the SA waters of the Calabash River. The entire property is also within the drainage basin of the Calabash, and all of the Pearl's development activities are within one-half mile of and draining to SA waters or unnamed tributaries to SA waters. Will this fact result in a change in the SW plan being submitted for a permit due to the prior SW plan having extensive piping, wet detention and direct outlets to SA waters which are not permit able under NCAC 15:02H.1005? 4) Several of the major existing ponds on the property proposed for wet detention are impounded waters of the Calabash and tributaries of the Calabash. There are ditches and piped outfalls discharging SW into these impoundments, and these impoundments are all connected through inlets and outfalls to other impoundments all draining to the Calabash River. Are these impounded waters of the Calabash considered SA waters of the Calabash? 5) You mentioned that there has been correspondence between you and the applicant regarding the recent submittal of the express SW permit application. The applicant is proposing to expand the existing impervious surface area in the 806.13 acre drainage area of the project from 16.24 acres to 195.89 acres. A 4,186 unit Planned Unit Development is proposed creating an overall density of 4.75 du/ac. The overall proposed BUA for the Pearl is 195.89 acres for a percent BUA/impervious surface area of 24.8 %. The development activities on the site are located within one-half mile of and drain to SA waters or unnamed tributaries of the SA waters of the Calabash River. Representatives of NCCF continue to survey the site from the air, land and water. The Pearl Development is within the drainage area of Calabash Creek. Calabash Creek is classified as SA waters. In addition Calabash Creek has been designated as a primary nursery area from Route 179 to approximately 1.2 miles upstream. Calabash Creek is closed to shellfishing due to high fecal Coliform counts. The 1998 Phase I Stormwater Master Plan for SBSWA lists seven golf courses within the project territory: The Pearl (East and West) ; Marsh Harbor; Ocean Harbor; Oyster Bay; Sea Trail (Maples, Jones and Byrd) ; Angles Trace and a portion of Sandpiper Bay. Current conditions within the project area indicate that there exists a persistent problem with high levels of Fecal Coliform being discharged into the Calabash River. This is exacerbated through the transport of stormwater in the existing ditches, pond outfalls and direct outfalls to the river on the Pearl. The stormwater discharges are contributing to violations of the SA fecal Coliform standard and the loss of protected "existing uses" in violation of the state and federal Anti-degradation Policy. Water quality protection measures used to protect the river have failed to maintain its designated values, resulting in its closure to the harvest of shellfishing 2 of 4 5/3/2004 8:58 AM Pearl SW application and it's listing on the state's 303 (d) list as "impaired waters. " Observations from the field (photos attached to NCCF 4/11/03 letter to DWQ) , permit reviews and anecdotal evidence from residents of the SEWSA territory indicate that a discrete stormwater collection system exists on the East Course of the Pearl. Observations from aerial photos and the field and discussions with residents and golfers in the area indicate that a similar situation exists on the West Course of the Pearl and to some extent on the six other golf courses within the SBSWA territory. The Pearl's stormwater system consists of an extensive system of ditches, interconnected ponds and impoundments, and outfalls that collects and directs stormwater into the SA waters of the Calabash River and its tributaries. This represents a discrete stormwater collection system. According to NC Administrative Code Section: 15A NCAC 2H. 1000 Stormwater Management Section .1005 Stormwater Requirements: Coastal Counties (2) development activities within one-half mile of and draining to SA waters or unnamed tributaries to SA waters: , (a) , Low Density Option: (ii) : "stormwater runoff transported primarily by vegetated conveyances; conveyances system shall not include a discrete stormwater collection system as defined in Rule .1002 of this Section;" Rule .1002, stormwater collection system defined in (18) : "Stormwater Collection System" means any conduit, pipe, channel, curb or gutter for the primary purpose of transporting (not treating) runoff. A stormwater collection system does not include vegetated swales, swales stabilized with armoring or alternative methods where natural topography or other physical constraints prevents the use of vegetated swales (subject to case-b y-case review) , curb outlet systems, or pipes used to carry drainage underneath built-upon surfaces that are associated with development controlled by the provisions of Rule .1003 (d) (1) in this Section. As described in NCCF's 4/11/03 letter to DWQ, this system of ditches; which are not vegetated swales with 3:1 slopes; transports stormwater into the waters and tributaries of Calabash Creek. Some of these ditches drain into impounded tributaries of Calabash Creek, including Lake Metcalf and Osprey. Piping exists on the property that conveys stormwater into the Calabash and its tributaries. This un-permitted and un-certified discrete stormwater system exists to convey stormwater off the golf courses and impervious surfaces of the Pearl and into the receiving SA waters of Calabash Creek. If this system is allowed to remain in place it will be utilized to drain the proposed 196 acres of impervious surface of the expanded Pearl Development. This will by-pass any permitted non-structural low-density stormwater system, and lead to the continued degradation of Calabash Creek. In a 4/11/03 email from Darren England to Linda Lewis regarding the existing ponds within the Pearl Development, Mr. England writes: "If their (ponds) discharges could lead to the closure of shellfish waters or removal of uses, the story might have different ending. " The attached aerial photo clearly shows that many of the ponds on the Pearl are in fact inter-connected, impounded sections of tributaries of the Calabash Creek which constitute SA waters. These are not isolated golf course ponds or course features; these are the waters of Calabash Creek and its tributaries. Currently they are being utilized as stormwater retention ponds as stormwater is conveyed to them through ditches, pipes and sheet flow. Direct discharges to SA waters are prohibited. Existing pipes and ditches which direct stormwater to these impounded waters of the Calabash and its tributaries constitute direct discharges which are prohibited. NCCF respectfully recommends the following actions be taken by DWQ: § This golf course community was originally certified in 1989 as a low-density project with 30' wide vegetated buffers and using only grass swales to collect and treat stormwater. A DWQ compliance inspection on 11/19/93 yielded a letter with required action items for the owner. The letter from Linda Lewis to Mr. Odell Williamson required the submittal of a current storm water plan revision, updated calculations, and recorded deed restrictions. In the current stormwater file for the Pearl, these required action items are not evident. Prior to any further action on the current 3 of 4 5/3/2004 8:58 AM Pearl SW application storm water permit application, these action items in the form of an updated and accurate As Built Plan must be submitted. § As described in Linda Lewis' 4/14/03 letter to Mr. DeCarol Williamson, the As Built Plan must show all of the following existing items on the property: roads, golf ponds and impounded waters of the Calabash River with outlets, inlets and dams; all existing development; all ditches; and all existing piping and swales. § A thorough compliance inspection by DWQ is needed to determine the extent and nature of the existing drainage system and outfalls. The site must be brought into compliance with existing coastal stormwater requirements and the new Phase II stormwater regulations. No agency action should be taken on the current storm water application until the site is brought into compliance. § In documents submitted to SBSWA and Brunswick County the applicant states that they have "existing wet detention basins" . They also state that the stormwater management plan of the site will include "new wet detention basins, " especially in the high-density portions of the project and "stormwater runoff routing. " No engineered stormwater collection system is permissible under state regulations with the low-density option (as cited previously) . If the applicant chooses to pursue a high density option rather than a low density option, then coastal stormwater rules state that only infiltration systems and vegetative filters are allowed within one-half mile or draining to SA waters or unnamed tributaries of SA waters. Therefore the existing and any proposed new or expanded wet detention basins would be in violation of the existing regulations. It must be made clear to the project applicant that wet detention ponds draining to or within one-half of SA waters mile are in violation of State Stormwater Rules and will not be permitted. § NC DWQ rules require protection of water quality standards, and there exists discretionary authority to take necessary action to ensure that SA water quality standards are not violated. Given that Calabash Creek is impaired, it is recommended that DWQ fully evaluate the existing development and proposed project's effects on the receiving waters to ensure that additional stresses will not add to water quality problems already being experienced in Calabash Creek. In addition, this project may require a NPDES construction stormwater permit. This permit should not be issued if water quality standards will not be protected. We recommend that the DWQ complete a full site compliance inspection before any action is taken on the permitting for this project. The applicants must resubmit the master stormwater plan indicating all of the existing ponds, ditches, and outfalls. In addition, to accurately evaluate any proposal a complete hydrology, soils and wetland report must be submitted based on existing site conditions. Specifically, we would like to address the existing piping. We would like to review the file for the previously permitted project showing the golf course and drainage features. Can you have this file available for us to review tomorrow afternoon when we deliver the additional application fee? We did address item 4 in our response. Item 4 read as follows: "4. In many areas, the opportunity to sheet flow across the parking lot and over the edge into the grass (remove the curbing entirely) is not utilized. Both 100'swales and 100'grassed areas will meet the intent of low density development with curb and gutter. The overall impression 1 get from the proposal is one where too much drainage is directed into too few swales, dumping into ponds, with not enough sheet flow through grass." This is a very vague and ambiguious item to which to respond. It does not mention site specific locations, regulations prohibiting curb and gutter and 100' swales, regulations requiring a certain number of swales on a site, regulations prohibiting the size of the drainage area allowed to flow to a single swale, etc. The project is designed with curb, curb cuts, and swales. If this is not allowed, let us know, but if "100'swales.... meet the intent of low density development with curb and gutter" then we would like to utilize that option on this project. Furhermore, it is our experience that sheet flow off of paved surfaces of paved surfaces often leads to rill erosion at the transition from ashalt to grass. We prefer to direct runoff to specific controlled outlets and design these outlets and swale to prevent erosion and treat the runoff according to stormwater guidelines. It is difficult to satisfy an "impression." We need facts and specific locations. We would like to meet and discuss this matter further. We obviously can not revise the plans to satisfy Item 4 prior to such a discussion. We will gladly resolve any legitimate items prior to the issuance of the permit. Let us know when we can meet. However,we have added additional spot elevations to the tennis courts indicating the water will runoff. Attached are the design sheets to replace those previously submitted. 2. Please cut back on the lengths of pipes, such as SD-58 on sheet 10 and SD-13 on sheet 11, and any others. Piping is allowed only under roads. The overall impression I get from the proposal is one where too much drainage is directed into too few swales, dumping into ponds, with not enough sheet flow through grass." It is our experience that sheet flow off of paved surfaces often leads to rill erosion at the transition from asphalt to grass. We prefer to direct the runoff to specific controlled outlets and design these outlets and swales to prevent erosion. This project is thus designed with curb, curb cuts,and 100'swales as allowed and required. 5. `Please delineate the drainage area for each shale, and provide shale calculations, or is ityour intent to provide this information as each phase is submitted for appmval?" The complete project swale delineation area map, along with the swale calculations, was included as part of our original submittal. Attached is an additional copy of this material, as submitted. The entire project is being submitted for approval because there are no phases in the stormwater design. 6. `There is a lot of"existing"piping shown underfairways and between ponds, which the Division did not permit in 1988. Low-density ptvjects have always been limited in the amount and use of piping. I'm not sure bow to proceed with this information,so I will be soliciting advice from Central Office staff I'm not sure how long it will take to get a response. The existing piping within the golf course was designed and installed prior to the stormwater rules becoming effective in 1988. Therefore, it should be exempt from this stormwater permitting process,since we are not proposing any removal,replacement,or additional piping in these areas. A Brunswick County septic system Certificate of Completion showing that the Clubhouse septic system was installed prior to August 24, 1987, 3. If the approved erosion measures prove insufficient,the developer must take those additional steps necessary to stop erosion from leaving this site. 2. Any and all existing ditches on this project site are assumed to be left undisturbed by the proposed development unless otherwise noted. The removal of vegetation within any existing ditch or channel is prohibited unless the ditch or channel is to be regraded with side slopes of 2 horizontal to 1 vertical or less steep. Bank slopes may be mowed,but stripping of vegetation is considered new earth work and is subject to the same erosion control requirements as new ditches. 3. The developer is responsible for obtaining any and all permits and approvals necessary for the development of this project prior to the commencement of this land disturbing activity. This could include the Division of Coastal Management under CAMA requirements,the Division of Environmental Management under stormwater regulations,the U.S.Army Corps of Engineers under Article 404 jurisdiction,local County or Town Agencies under their local ordinances, or others that may be required. If any area on site falls under the jurisdiction of Section 404 of the Clean Water Act,the developer is responsible to the orders of the U.S.Army Corps of Engineers. Any erosion control measures that fall within jurisdictional wetland area must be relocated to the transition point between the wetlands and the highlands to assure that the migration of sediment will not occur. If that relocation presents a problem or contradicts any requirements of the Corps of Engineers,it is the responsibility of the developer to inform the Land Quality Section Regional Office so that an adequate contingency plan can be made to assure sufficient erosion control on site. Failure to do so will be considered a violation of this approval. 5. Any borrow material brought onto this site must be from a legally operated mine or other approved source. A single use borrow site or an area to waste material is only permissible if it is operated under total control of the Financially Responsible person or firm who is developing this site and a plan modification is submitted to this office that includes the area in question. 6.
