We find the plan to be acceptable with modifications and hereby issue this letter of Approval with Modifications. The Modifications Required for Approval are listed on the attached page. This plan approval shall expire three (3) years following the date of approval, if no land-disturbing activity has been undertaken, as is required by Title 15A NCAC 4B .0129. As of April 1, 2019, all new construction activities are required to complete and submit an electronic Notice of Intent (eNOI) form requesting a Certificate of Coverage (COC) under the NCG010000 Construction General Permit. After the form is reviewed and found to be complete, you will receive a link with payment instructions for the $100 annual permit fee. After the fee is processed, you will receive the COC via email. As the Financially Responsible Party shown on the FRO form submitted for this project, you MUST obtain the COC prior to commencement of any land disturbing activity. The eNOI form may be accessed at deq.nc.gov/NCG01. Please direct questions about the eNOI form to the Stormwater Program staff in the Raleigh central office. If the owner/operator of this project changes in the future, the new responsible party must obtain a new COC. The approved E&SC plan as well as any approved deviation. 2. The NCGO1 permit and the COC, once it is received. 3. Records of inspections made during the previous 12 months. Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic inspection to ensure compliance with the approved plan. North Carolina's Sedimentation Pollution Control Act is performance-oriented, requiring protection of existing natural resources and adjoining properties. If, following the commencement of this project, it is determined that the erosion and sedimentation control plan is inadequate to meet the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 113A-51 through 66), this office may require revisions to the plan and implementation of the revisions to ensure compliance with the Act. Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water quality laws, regulations, and rules. In addition, local city or county ordinances or rules may also apply to this land-disturbing activity. This approval does not supersede any other permit or approval. Please note that this approval is based in part on the accuracy of the information provided in the Financial Responsibility Form, which you provided. You are requested to file an amended form if there is any change in the information included on the form. Any portion of the project associated with the modification comments should not begin until a revised plan is submitted to and approved by this office. Additional review comments may be generated if the proposed design is altered significantly to address the comments below. 1. Provide a notarized executed Financial Responsibility/Ownership form with Parts A.9 and B.1 completed that exactly match the deed and information on file with the N.C. Secretary of State. {G.S. 113A-54.1.(a)} , 2. Provide phased sheets for the project,for a project of this scope and nature a minimum of three phases should be incorporated into the E&SC plan. {15A NCAC 04B .0106(a)(2)} 3. Revise the construction sequence to include the following language: no major grading activities or basin construction are to take place during wet weather or periods of predicted wet weather i.e. Hurricanes; notify NCDEQ LQS inspector when project is ready for a close out inspection; file for NPDES NCG010000 e-Notice of Termination when final close out inspection report is received from NCDEQ LQS; install inlet protection by the end of the workday for all constructed SW inlets; specify order in which significant E&SC measures must be installed and related areas in which they protect i.e. TCE, then perimeter controls, stabilized outlets,then basins,then conveyances, proceed with clearing and grubbing for Phase X,install additional measures X,then XX, then XXX for Phase II, continue to add stabilization and seeding for areas not stabilized; specify the order that the traps and basins and their collection systems be installed in before any other grading takes place on site; prior to construction of the sediment basin, silt fence shall be installed below the toe of the proposed embankment of the sediment basin to prevent sedimentation damage during sediment trap construction; sediment basin and trap embankments shall be provided with adequate groundcover immediately upon construction; after the drainage areas to the basins and traps have been permanently stabilized, dewater the basins. Fill the basins using stockpiled soil and bring to finish grade in compacted Iifts. Smooth the basin sites to blend with the surrounding area, ensuring the basin sites will not pond water, and immediately permanently stabilize; dewatering operations must be discharged into adequate stilling basin or comparable measure to prevent the discharge of sediment; construct SW system from point A to point B while installing inlet protection as soon as each inlet is constructed; inspect and cleanout SW system before bringing online; specify when E&SC measures are to be converted into post-construction SW BMP's i.e.sediment Letter of Approval with Modifications Aspire Global Venture, LLC ATTN: Mr. Patrick Bowler July 11, 2023 Page 4 of 4 basin converted to retention pond-requires separate individual sequence for conversion; road construction shall be limited to 1000 linear feet of disturbed area at any given time. Land Quality Staff may authorize additional linear footage of disturbance if weather and site conditions allow; Site must be "storm ready"before any extended breaks in construction activities including weekends; for sites using slope drains, at the end of each day,the contractor shall establish a berm or ditch at the top of all fill slopes. The berm or ditch shall be constructed to prevent potential runoff from sheet flowing over and down the slope. Positive drainage shall be established to the inlets of any slope drains. {15A NCAC 04B .0106(a)(2)} 4. Provide a drainage area map that illustrates the drainage areas for the basins and culverts. {15A NCAC 04B .0108} 5. Skimmers must be utilized if a sediment basin is over 1 acre in drainage area. Provide location and skimmer construction detail. Proposed contours must be added to all sediment trap/basin slope contours. Show emergency spillway locations for all basins. It appears that traps have been used in some areas where basins need to be designed,verify all drainage areas and sizing requirements. 6. Provide stabilized inlets and outlets for all proposed conveyances and basins. {G.S. 113A-57.(3)} 7. Hatch all areas that must meet 7-day stabilization requirement specified in NPDES NCG010000. 8. Provide double row wire backed silt fence or super silt fence below all long or steep fill slopes. Reinforced outlets should be used adjacent to conveyance discharge points. {G.S. 113A-57.(3)} 9. Show the final discharge point for the reinforced ditch located in the southwestern portion of the site. {G.S. 113A-57.(4)} 10. Provide compaction requirements for fill slope in addition to the lift requirement provided. {G.S. 113A-57.(3)} 11. Remove the Limits of Disturbance from the stockpile area since stockpiling is a land disturbing activity. {G.S. 113A-57.(4)} 12.
