I didn't close the project because there was an unstable ditch to the basin and silt fence was still in place. Therefore,
this annual fee is like a reissuance, but you don't need the erosion and sediment control plan to be reissued because it
stays open as long as the project isn't closed.

Do you mean Lily Kay in our regional office? I've copied her in case that's the person you mean.
If you never submitted a Notice of Termination once the project was closed out, then the NCG01 COC remained active,
and annual fees were billed/due in 30 days. If this project has been closed-out, please submit a Notice of Termination

needed. Not sure why the project is being considered in deficiency.
