Dear Applicant:
The Division of Energy, Mineral, and Land Resources (DEMLR) Stormwater Permitting
Program received your application for an NPDES Individual Stormwater discharge permit on
August 10, 2021. Upon review of the application, the facility does not qualify for coverage under
an NPDES stormwater permit due to the constituents of the water being discharged through the
proposed outfalls and the flow of the receiving streams. A site visit conducted by DEMLR
Raleigh Regional Office staff on May 31, 2022 indicated Outfall SW01 may receive water from
an onsite septic spray field. The permit application stated a new outfall, Outfall SW002, would
be added as part of a facility expansion and discharge to an unnamed tributary to Aycock
Swamp. Per 15A NCAC 02B .0206(d)(2), "If the 30Q2 and 7Q 10 flows are both estimated to be
zero, no new or expanded discharge of oxygen consuming waste shall be allowed.",

nathaniel.thomburg@deq.nc.gov to discuss appropriate permit coverage. Please be advised that
if the State determines that discharges from this site contribute to a water quality standard
violation or are a significant contributor of pollutants to waters of the State, the Department of
Environmental Quality (DEQ) is authorized to require an appropriate discharge permit or
eliminate the discharge.
The return of this application does not affect the legal requirements to obtain other permits,
which may be required by the Division of Energy, Mineral, and Land Resources, or permits
required by the Division of Water Resources (DWR), Coastal Area Management Act, or any
other federal or local government permit or approval that may be required.
