Facility Activities and Process: The Duke Energy Progress, LLC Roxboro Steam Electric Plant is an electric generating facility consisting of four coal fired units with a total generating capacity of 2,558.2 megawatts. Per the April 2023 DEMLR inspection report, the stormwater permit is issued for a flat staging and laydown area which has a railroad track that carries gypsum, limestone and coal in rail cars that circles the entire laydown area. The laydown area consists of large pipe sections that looked clean with no visible residue, staged in small areas around the site, and Conex Boxes and miscellaneous materials located in different areas of the yard. Letter from Duke Energy dated 5/2/2017: The station will be undertaking process improvement work in the vicinity of stormwater outfall SW-3 and request elimination the outfall. The removal will consist of plugging the existing concrete conveyance pipe then adding grout to fully eliminate any discrete discharge. The grading in this area will result in only sheet flow in the future. Outfall SW001 (SW-A): North loop of plant Drainage area consist of delivery trucks and train cars travelling through the area carrying limestone, gypsum, and coal. Drainage area is north of the plant and enclosed by a rail line. Additional outfalls Outfall SWO03: Plugged Outlet structure plugged. Drainage area previously consisted of the west access road, a warehouse, grassy swale, and small area adjacent to an access road where chemical deliveries may take place. Page 1 of 7 Why Industrial Sites with Stormwater are Subject to a Permit: Federal NPDES regulations define stormwater discharge associated with industrial activity in 40 CFR §122.26 (b)(14) as: "the discharge from any conveyance that is used for collecting and conveying storm water and that is directly related to manufacturing,processing or raw materials storage areas at an industrial plant. The term does not include discharges from facilities or activities excluded from the NPDES program under this part 122. For the categories of industries identified in this section, the term includes, but is not limited to, storm water [sic] discharges from industrial plant yards; immediate access roads and rail lines used or traveled by carriers of raw materials, manufactured products, waste material, or byproducts used or created by the facility; material handling sites; refuse sites; sites used for the application or disposal of process waste waters (as defined at part 401 of this chapter); sites used for the storage and maintenance of material handling equipment; sites used for residual treatment, storage, or disposal; shipping and receiving areas; manufacturing buildings; storage areas (including tank farms) for raw materials, and intermediate and final products; and areas where industrial activity has taken place in the past and significant materials remain and are exposed to storm water. For the purposes of this paragraph, material handling activities include storage, loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product, byproduct or waste product. The term excludes areas located on plant lands separate from the plant's industrial activities, such as office buildings and accompanying parking lots as long as the drainage from the excluded areas is not mixed with storm water [sic] drained from the above described areas." Section 2. Monitoring Information and Compliance History: • March 2017 to May 2022,benchmarks exceeded for: o SW-A: TSS Ix Threatened/Endangered Species: There are no threatened/endangered species at the discharge location, however, in the vicinity there are: Ringed Witch Grass (Dichanthelium annulum; NC status: E), Carolina Birdfoot-trefoil (Acmispon helleri; NC status: T), Tall Boneset(Eupatorium saltuense;NC status: SR-L), and Small Rabbit- Tobacco (Pseudognaphalium micradenium; NC status: SR-T). Section 3. Proposed Monitoring for Stormwater Discharges: The Division considered potential pollutants from past and present industrial activities (coal-fired electric generation) and data was submitted for March 2017 to May 2022. Quantitative sampling included pH, TSS, O&G, boron, zinc, antimony, arsenic, beryllium, cadmium, chromium, copper, lead, nickel, selenium, silver, thallium, and mercury. Unlike most stormwater permits in its program, the Division is proposing a permit structure with outfall- specific monitoring for discharges. Parameters are based on potential pollutants in the drainage area, sampling results, and in some cases, dependent upon future activities (e.g., ash removal through the drainage area). Below is a table of the proposed monitoring for each outfall at the Roxboro Steam Electric Plant site. Stormwater Benchmarks and Tiered Response: Rather than limits,North Carolina NPDES Stormwater permits contain benchmark concentrations. Stormwater benchmarks are numerical action levels for stormwater monitoring. Benchmarks are not effluent limits, and benchmark exceedances are not permit violations. Benchmarks provide facilities a tool for assessing the significance of pollutants in stormwater discharges and the effectiveness of best management practices (BMPs). Benchmark concentrations are intended as guidelines for the facility's development and implementation of the Stormwater Pollution Prevention Plan(SWPPP). Benchmark exceedances require the permittee to increase monitoring, increase management actions, increase record keeping, and/or install stormwater BMPs in a tiered program. The permit establishes a tiered approach to specify actions the permittee must take in response to analytical results above benchmark concentrations. The tiered structure of the permit provides the permittee and DEMLR wide flexibility to address issues that may arise with one or more parameters and/or outfalls. Metals benchmarks are calculated to mimic acute water quality standards and with the guidance of DWR. NC DWR follows established federal procedures for calculating acute standards when developing the benchmarks. Just like the acute standards, metals benchmarks normally reflect one half of the calculated Final Acute Value (the "1/2 FAV"). In most cases, translation into total recoverable values is based on an assumed hardness of 25 mg/L and a total suspended solids (TSS) concentration of 10 mg/L. Acute standards protect aquatic life from negative impacts of short-term exposure to higher levels of chemicals where the discharge enters a waterbody. The Stormwater Permitting Program applies this approach because of the ephemeral nature of rainfall events. The Division may evaluate results to determine if a smaller suite of parameters for some outfalls is adequate to characterize potential pollution or BMP effectiveness. For example, one or more metals or other parameters may serve as an adequate tracer for the presence of ash pollution during disturbance or ash removal in specific drainage areas at this site. For parameters that do not have a stormwater benchmark, the Division may develop a benchmark value if appropriate toxicity data become available or if rising trends in concentrations suggest a persistent source. The Division's maintains that implementation of Best Management Practices (BMPs) and traditional stormwater management practices that control the source of pollutants meets the definition of Best Available Technology (BAT) and Best Conventional Pollutant Control Technology(BCT). The permit conditions are not numeric effluent limitations but are designed to be flexible requirements for implementing site-specific plans to minimize and control pollutants in stormwater discharges associated with the industrial activity. Title 40 Code of Federal Regulations (CFR) §122.44(k)(2) authorizes the use of BMPs in lieu of numeric effluent limitations in NPDES permits when the agency finds numeric effluent limitations to be infeasible. The agency may also impose BMP requirements which are "reasonably necessary" to carry out the purposes of the Act under the authority of 40 CFR 122.44(k)(3). The conditions proposed in this draft permit are included under the authority of both of these regulatory provisions. In essence, the pollution prevention and BMP requirements operate as limitations on effluent discharges that reflect the application of BAT/BCT. Mercury Monitoring Requirements: The proposed permit requires mercury to be measured in stormwater samples by EPA Method 1631E, which can detect levels as low as 0.5 ng/l. This requirement is consistent with recent federal rule-making that requires NPDES permittees to monitor discharges with sufficiently sensitive test procedures approved under 40 CFR §136. Modifications to 40 CFR §122.44(i) require a method that has a minimum level (ML) at or below the effluent limit (not applicable here), or the lowest minimum level (ML) of EPA approved analytical methods for the measured parameter. Based Page 5 of 7 on results, Method 1631E will be required to quantify levels in these discharges. NC DEMLR understands that this method is more costly and requires a more intensive sampling protocol than most other parameters, and that fish tissue sampling will be provided during the permit cycle. Therefore, no benchmark applies that would trigger tiered response actions. Proposed permit provisions also allow the permittee to use field blank and/or method blank concentrations to adjust reported mercury levels as long as documented is submitted with the Data Monitoring Report DMR). Flexibility in Tier Responses: Tier Two actions provide an opportunity for the permittee to propose an alternative monitoring plan for approval by the Region: • Alternatively, in lieu of steps 2 and 3, the permittee may, after two consecutive exceedances, exercise the option of contacting the DEMLR Regional Engineer as provided below in Tier Three. The Regional Engineer may direct the response actions on the part of the permittee as provided in Tier Three, including reduced or additional sampling parameters or frequency. • If pursuing the alternative above after two consecutive exceedances, the permittee may propose an alternative monitoring plan for approval by the Regional Engineer. The permit therefore allows the permittee to petition the Regional Office for monitoring changes sooner than Tier Three (upon any four benchmark exceedances) and gives guidance on one option to take. For example, the permittee may request that mercury only be monitored semi-annually under the tiers, or that only parameters over the benchmark be monitored more frequently. In this way, changes to the monitoring scheme for any outfall could be handled outside of a permit modification. Other Proposed Requirements: • It is standard for Stormwater Pollution Prevention Plan(SWPPP)requirements to include an annual certification that stormwater outfalls have been evaluated for the presence of non- stormwater discharges, and if any are identified, how those discharges are permitted or otherwise authorized. • Requirement to submit a request for permit modification if the facility identifies or creates any new outfalls, removes outfalls, or alters any drainage area that changes potential pollutants. • The Division expects the permittee to apply best professional judgment and consider the safety of its personnel in fulfilling sampling obligations under the permit. • Federal regulations require electronic submittal of all discharge monitoring reports (DMRs). If a state does not establish a system to receive such submittals, then permittees must submit DMRs electronically to the EPA. • Quarterly QualitativeNisual Monitoring to assure regular observation of outfalls throughout year. Nearly the entire site is covered by a wastewater permit except for a small 3.5 acre laydown yard with a few Conex boxes, a little pipe and misc equipment stored there. I don't believe they understood why they had it either and looking at there sample data, it doesn't appear they have ever had anything even close to what would require a permit for a sample. I have included some pictures and a sample spreadsheet with sample data from 3/2017-01/2020 and a snip of the permit area shown as a small diamond shape just above the middle of the site as a representation of the size.The data shows that the readings are far below benchmark. We reviewed the required documents for the permit before walking the site and I found that everything was detailed and complete. The stormwater permit is issued for a flat staging and laydown area of 3.5 to 5 acreas with the plant and associated materials located to the South and Hyco Lake to the East, North and West. The area has a railroad track which carries gypsum, limestone and coal in rail cars that circles the entire laydown area. This laydown area consist of large pipe sections that looked clean with no visible residue, staged in small areas around the site . There are Conex Boxes and miscellaneous materials located in different areas of the yard. The sample outlet can be found at the one discharge point on the East side of the permit area. Site BMP's consist of grass and ditches. The stormwater pollution prevention plan (SP3)appeared to be in order and all the requirements of the plan are being followed. The one exception being the spill log.We recommend that the(SP3)contain a list of spills or leaks for the last threee years. If there were no spills or leaks during any year, please provide on the spill/leak document that there were no spills for that year. We recommend that all spills or leaks that occurr be listed on this document, regardless of the quantaty and whether its reportable.We also ask that the manner of recovered and the mode of disoposal of any spilled/leaked materials be listed on that document. Examples of BMP's for the Roxboro Electric Generating Plant include: • Source Reduction • Good Housekeeping • Preventive Maintenance • Visual Inspections • Spill Prevention and Response • Erosion and Sediment Control • Stormwater Runoff Management • Employee Training • Recordkeeping and Reporting • Recycling • Treatment 3.2.3.2 Source Reduction Source reduction measures reduced stormwater pollution by reducing the quantity of materials,which may contact stormwater. The source reductions measures to be implemented may require modifications in present work habits and practices. Example components of source reduction are: • Good Housekeeping • Preventive Maintenance • Visual Inspections • Spill Prevention and Response • Erosion and Sediment Control Many of the components of source reduction are addressed as main components of the BMP, therefore, source reduction should be considered under each of the other BMP components. 3.2.3.3 Good Housekeeping Good housekeeping practices are designed to maintain a clean and orderly work environment. Good housekeeping practices should be incorporated in the day-to-day conduct of operations and maintenance. A clean and orderly work area reduces the possibility of accidental spills caused by the mishandling of chemicals and equipment. Well-maintained material and chemical storage areas reduce the possibility of stormwater mixing with pollutants. The following practices shall be performed on a regular basis: ERM NC,INC. 3-3 398458 • Maintain clean and dry floors, ground surfaces, work, and process areas through the use of brooms, shovels, vacuum cleaners, mops and cleaning equipment. • Regular pickup and disposal of waste materials. • Proper operation of equipment. • Routine visual inspections by qualified personnel for leaks or spills, and for conditions which may lead to a leak or spill (such as the hazardous waste inspections being performed at various areas throughout the Roxboro Plant). • Training of employees in spill prevention and cleanup procedures • Bags storing dry chemicals shall be raised off the floor, preferably by pallet, to prevent any unwanted interaction of the chemical with water. • Walkways shall be maintained free of obstructions to facilitate inspection for leaks or spills. The Fossil Chemistry Technician, assigned the NPDES ORC responsibilities, routinely inspects work and storage areas for best housekeeping practices. Corrections are handled by work orders tracked through Maximo, the Company work order management system, on an as needed basis. 3.2.3.4 Preventive Maintenance Roxboro Plant has various inspections and site assessment practices in place to assist with detection of potential problems. Preventive maintenance schedules vary based on the potential risk by the source. In general, the Roxboro Plant is well manned in order to ensure the facility is a reliable and efficient source of electricity. Preventive maintenance will be performed to ensure that stormwater management facilities and controls operate correctly and effectively and to reduce their breakdowns and failure. Specific activities include: • Periodic inspection, cleanout and maintenance of catch basins, containment areas, ditches, and conveyance equipment. • Periodic scheduled inspection and testing of equipment and systems, including pumps,valves,pipes, storage tanks, and controls. • Proper scheduled maintenance of equipment and facilities. Additional preventive maintenance information will be provided as a separate section of the SPPP. 3.2.3.5 Visual Inspections Visual inspections will be performed in conjunction with other BMP's, such as housekeeping and preventive maintenance, and also as a separate activity (see section 7 "Visual Inspection"). Training in proper spill identification and cleanup procedures, including the use of equipment and the notification and documentation procedures, will be the main components of spill response. Specific spill preventative measures will include: • Piping protection, such as routing, coatings and wrappings, and cathodic protection where appropriate. • Adherence to current unloading procedures and practices,including monitoring and verification of all connections and seals. • Proper valve and control settings, and adequate labels, markings, and communications, to ensure that accidental closures or openings do not occur. • Adequate securities to prevent non-authorized access to facilities. • Appropriate documentation of actions taken. Spill response will be in accordance with existing Plant Procedures, including the Spill Prevention, Control and Countermeasure (SPCC) Plan and the Hazardous Substance Notification Procedure. Training is essential to a well-executed spill response. Personnel will be trained to identify potential stormwater pollution occurrences as may occur during a spill event, and respond in the appropriate manner. 3.2.3.7 Erosion and Sediment Control Areas under construction, or where accelerated erosion or sedimentation is occurring, will be monitored and corrective measures will be implemented as necessary. A Sediment Erosion Control Plan may be needed. The Environmental Site Coordinator will decide. Vegetation or equivalent stabilization of the ground will be performed to reduce/eliminate accelerated erosion. 3.2.3.8 StornlWater Runoff Management Uncontaminated stormwater will be diverted away from potential sources of contamination, and discharged to a stabilized conveyance structure. Contaminated waters will be directed to the appropriate treatment facilities prior to discharge. Diversion efforts should be made to reduce the quantity of contaminated stormwater that must be collected and treated depending on conditions. Vehicle washing should be performed in areas away from stormwater drains. ERM NC,INC. 3-5 398458 3.2.3.9 Employee Training General training of employees will emphasize good housekeeping, and preventive methods, procedures, and practices. Responsibilities will be clearly communicated to personnel, including notification procedures for preventive and corrective measures. Maintenance and inspection personnel will have the authority to follow-up on areas requiring improvement. Plant personnel will be trained in safety and clean-up operations and to recognize spills which may contribute to stormwater pollution. 3.2.3.10 Recordkeeping and Reports Training documentation will utilize the current training documentation tool. Maintenance activities will be documented in the current Maximo work management tool. Reports will be sent to the plant file 12520R located in the Environmental Coordinators Office. 3.2.3.11 Recycling No recycling of contaminated stormwater occurs at the Roxboro Plant. Recycling of some solid and universal wastes occurs at the Roxboro Plant. 3.2.3.12 Treatment Treatment measures will be the last step prior to the discharge of contaminated stormwater. Treatment is employed at the plant for those areas where, due to site constraints, other BMP's have been found to be infeasible or too costly to implement. Periodic vacuuming of storm drain catch basins will be conducted in high risk areas as needed. 3.3 SPILL PREVENTION AND RESPONSE PLAN[PART II, SECTION A.31 This SPPP contains the required elements of a Spill Prevention and Response Plan (SPRP), as outlined in Part II, Section A.3 of the permit. Roxboro Plant has strategically located spill response materials throughout the facility. Areas where potential spills could contribute pollutants to stormwater have been identified on Figure 2 and 3 of this Plan, along with the associated drainage points. Spill response training is provided to applicable employees on an initial hire and annual basis. In the event of a spill, Roxboro Plant employees are to respond only to incidental releases where the substance can be absorbed, neutralized, or otherwise controlled at the time of release by employees in the immediate release area or by maintenance personnel. An occurrence which results,or is likely to result, in an uncontrolled release of a hazardous substance requiring a response effort by employees from outside the immediate release area or by other designated responders (i.e., mutual-aid groups,fire ERM NC,INC. 3-6 398458 departments, etc.) is considered an"emergency response." Roxboro Plant employees are not to perform emergency responses, and such responses are only to be performed by personnel trained in accordance with 29 CFR 1910.120. All employees responsible for implementation of the SPRP are indicated in Section 3.3.2 of this Plan. (DEP) owns and operates the Roxboro Steam Electric Plant (Roxboro) located on Hyco Reservoir in Person County, North Carolina. As required by Roxboro's Wastewater National Pollutant Discharge Elimination System (NPDES) Permit No. NC003425, DEP is required to monitor arsenic, selenium, and mercury in fish tissue in Hyco Reservoir near the ash pond discharge under monitoring plans approved by the North Carolina Division of Water Resources. Additionally, DEP operates under the requirements of Industrial Stormwater NPDES Permit No. NCS000581 which requires the reporting of the fish tissue monitoring required under the wastewater permit. This report is submitted to fulfill the reporting of fish tissue monitoring as required by the Industrial Stormwater permit from 2017 through 2019. Supporting data for this report has been submitted the North Carolina Division of Water Resources as an element of the wastewater permitting process. 2.0 Study Site Description and Sampling Locations Fish were collected for individual muscle tissue trace elements analysis at two areas within Hyco Reservoir (Figure 1). An area upstream (C) of the discharge point serves as a reference location to monitor background trace element concentrations in fish muscle tissue, and an area in the immediate vicinity of the discharge location (D) serves to monitor near-field uptake and assimilation of elements in fish muscle tissue. 3.0 Target Species The target fish were sunfish (preferred Bluegill), black bass (preferred Largemouth Bass) and catfish (preferred White Catfish). Where the full complement of preferred target species was not available, fish from the same genus or family were included as necessary (Table 1). As recommended by the U.S. Environmental Protection Agency (USEPA) an attempt was made to limit the smallest fish to 75% of the largest fish total length by species depending on availability (USEPA 2000). 4.0 Field Sampling Methods Fish were collected using electrofishing procedures specified in the DEP Biology Program Procedures Manual (Procedure NR-00080, Rev. 2 and NR-00095, Rev. 1) which is approved by the North Carolina Department of Environmental Quality under the DEP Biological Laboratory Certification (# 006). Only live fish of good condition were retained and put in a labeled bag and placed on ice until frozen for analysis. Ancillary fisheries data including species, total length (mm), and total weight (g) were also recorded. Fish collected were transferred to a freezer daily and maintained frozen until processing at the DEP New Hill Trace Element Laboratory. Associated water quality data including water temperature, dissolved oxygen, and specific conductance were recorded daily at the surface at each sampling location (available on request). 5.0 Laboratory Processing and Arsenic,Mercury, and Selenium Analysis Fish samples were processed and analyzed individually in the DEP Trace Element Laboratory according to procedure NR-00107, Rev. 4 Trace Element Monitoring Laboratory Procedure. Pace Analytical conducted the metals concentration analysis in 2018 in accordance with EPA methods 6020 and 7471. Quality control was 1 achieved utilizing analytical standards, replicates, and certified reference materials. Following analysis, residual processed samples were archived and will be kept for at least two years in the event that re-analysis is needed. 6.0 Data Analysis and Reporting Arsenic, mercury, and selenium concentrations (converted to µg/g wet weight) in the fish muscle tissue collected from 2017 through 2019 are presented in Table 1. In addition to the length and weight of each fish, the dry-to-wet weight ratios are provided to convert the arsenic, mercury, and selenium concentrations wet weight values back to dry weight values as desired. Arsenic From 2017 through 2019, arsenic concentrations in the 183 fish collected were well below the USEPA recreational screening value of 1.2 µg/g (wet weight) (USEPA 2000). Mercury Of the 183 fish collected from 2017 to 2019, only two fish exhibited concentrations of mercury slightly above the USEPA recreational screening value of 0.4 µg/g (wet weight) (USEPA 2000). Both occurrences were in Largemouth Bass collected in 2019 at the reference sampling location (Table 1). Selenium From 2017 through 2019, selenium concentrations in the 183 fish collected were well below the USEPA recreational screening value of 20 µg/g (wet weight) (USEPA 2000). 7.0 References USEPA. 2000.
