Please review this draft carefully to ensure thorough understanding of the requirements and conditions it contains. There are a few changes in the draft attached here from the existing permit. These changes are summarized below. • Regulatory Citations - Language has been added where necessary in the permit to provide regulatory citations for permit requirements. This includes updates to citations that have been changed with recent rule revisions. • Electronic Reporting - Permit language has been modified to be consistent with the finalization of federal requirements for electronic reporting. • Addition of Permit Limits - Data from the previous permit cycle was evaluated under a Reasonable Potential Analysis (RPA) to determine whether any pollutant has potential to impact instream water quality. The RPA evaluation found that three parameters showed reasonable potential and require the addition of a permit limit to assure no impacts to the receiving waters. Permit limits have been added to your permit for Toluene (11 µg/L), Total Recoverable Phenolics (300 µg/L) and Naphthalene (12 µg/L). Implementation of these limits will be postponed until the next permit cycle (2028). A Schedule of Compliance has been added in Section A. (5.) of the permit and is noted in Footnote 8, which has been added to the Effluent Table. You are required to continue monitoring for these parameters at the frequency specified in the permit during this permit cycle. This permit still includes the limits for these parameters as an indication of the expectations for the next permit renewal. The Schedule of Compliance includes requirements for annual reports on actions taken in review, assessment and implementation toward meeting these limits down the road. A new footnote and Section associated with monitoring and reporting for these methods have also been added (see info below). • Footnotes have been added in the effluent table as noted below. - Footnote 3 added addressing collecting oil and grease samples from a quiescent pool. - Footnote 4 is added back to the permit to require collection of certain parameters concurrently with WET sampling. Discussions with Division Aquatic Toxicology staff verified having these samples concurrently can help isolate any potential toxicity issues. - Footnote 5 has been added to assure that discharge does not cause the receiving stream to exceed the 50 NTU standard. - Footnote 6 has been added to reference an added Section addressing EPA Method 625.1 monitoring and reporting. - Footnote 7 for Toxicity has been modified to include reference to the specific parameters that WET testing should be done concurrently with. - Footnote 8 was added to address a Schedule of Compliance for the new permit limits. • Special Condition A.(2.) - This condition has been updated to be consistent with the required annual WET requirements. The language also notes the ability to now submit AT forms electronically. This was Section A.(3.) in the previous permit. • Section A.(3.) - This was Section A.(2) in the previous permit. • Section A.(4.) outlining specific monitoring and reporting requirements for Methods 624.1 and 625.1 has been added to the permit. • Section A.(5.) outlining a Schedule of Compliance for new limits has been added to the permit. • Section A.(6.) has been renumbered with the addition of new Sections A.(4.) and A.(5.). • Permit Map - Map information has been updated. The NPDES standard conditions (Parts II, III, and IV) that are a part of the permit are not included in this draft document (cover, map, and Part 1). Concurrent with this notification the Division is publishing a notice in a newspaper having general circulation in the Wake County area soliciting public comments on this draft permit. Therefore, the exclusive authority to operate and discharge from this facility arises under the permit conditions, requirements, terms, and provisions described herein. The Permittee shall submit Monthly Discharge Monitoring Reports (DMRs) electronically in accord with the Division's Electronic Discharge Monitoring Reporting (eDMR) Program [section A. (6.)]. 2. Flow — During periods of no flow, the Permittee shall submit a monthly Discharge Monitoring Report (DMR) indicating "No discharge." Flow shall be monitored at each discharge and may be monitored in one of four ways: a. measure flow continuously; b. Rational Method -- calculate flow [see Rational Equation — Section A. (3.)] based on total rainfall per area including built -on area draining to the outfall; c. estimate flow at 20-minute intervals during the entire discharge event; or d. report flow based on discharge pump logs. 3. Oil and Grease — Where possible, the grab sample for oil and grease should be skimmed from the surface of a quiescent (calm water) zone. 4. Samples for this analyte shall be collected concurrently with WET -Test sampling, appropriate to frequency. 5. Effluent shall not cause receiving stream turbidity to exceed 50 NTU. If receiving stream background turbidity exceeds 50 NTU, effluent shall not cause this background value to increase. 6. See Section A.(4.) for additional monitoring and reporting requirements for EPA Methods 625.1. 7. Whole Effluent Toxicity (WET) Testing — Acute Annual WET testing will continue at this frequency provided that the Permittee maintains WET test results showing "pass" [or LC50 > 100] for each annual event." If WET -test results show "fail," the sampling frequency shall immediately revert to Quarterly in accord with Section A. (2.), and the Permittee will not regain eligibility for Annual testing frequency except after five (5) consecutive quarters showing "Pass." WET testing to be preformed concurrently with parameters in footnote 4 above. 8. Permit Limits for Toluene, Total Recoverable Phenolics and Naphthalene will not be effective for this permit cycle, but monitoring will continue to be required. Permittee shall meet the Schedule of Compliance outlined in Section A.(5). Conditions: 1. The Permittee shall discharge no floating solids or foam. 2. The Permittee shall discharge no tank or pipe solids, bottom water, or rag layer. 3. Following hydrostatic tank testing, the Permittee shall discharge no tank (or pipe) contents with concentrations of benzene > 1.19 µg/L or toluene > 11 jig/L. Page 3 of 14 Draft Permit NCO081469 A. (2.) ACUTE TOXICITY MONITORING (EPISODIC)- LIMITED (ANNUAL) [15A NCAC 02B 0.200] The Permittee shall conduct annual acute toxicity tests using protocols defined as definitive in E.P.A. Document EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24-hour static test. Effluent samples for self -monitoring purposes must be obtained below all waste treatment. The Permittee will conduct one test annually, with the annual period beginning in January of the calendar year of the effective date of the permit. The Annual test requirement must be performed and reported by June 30. If no discharge occurs by June 30, notification will be made to the Division by this date. Toxicity testing will be performed on the next discharge event for the annual test requirement. Should any annual toxicity test result in a "failure", the Permittee shall test each subsequent discharge event until testing indicates "pass," after which Quarterly monitoring shall take place. The Quarterly tests will be performed on a discharge event during each quarter (January - March, April -June, July -September, October -December). If after a subsequent five (5) consecutive Quarterly WET tests indicate "Pass," the Permittee may petition the Division to change the monitoring. Should there be no discharge of flow from the facility during a quarter in which toxicity monitoring is required, the Permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited below. The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the appropriate parameter code. Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Page 4 of 14 Draft Permit NC0081469 Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Resources indicate potential impacts to the receiving stream, this permit may be re- opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. A. (3.) FLOW MEASUREMENT RATIONAL METHOD [G.S. 143-215.1(b)] The Rational Method - Determination of Peak Runoff: [REF: FHWA Urban Drainage Design Manual, 3.2.2. Rational Method (3-1)] Q=KuCIA, where: Q = flow (peak flow rate in cfs or m3/sec) Ku = unit conversation factor = 1.008 for U.S. standard units (usually ignored because it is so close to 1), or 0.278 for metric units C = dimensionless runoff coefficient for the watershed, loosely defined as the ratio of runoff to rainfall I = intensity of rainfall [taken from the intensity -duration -frequency curves for the specified design return period at the time of concentration, tc (in/h or mm/h). tc = time of concentration (time after beginning rainfall excess when all portions of the drainage basin are contributing simultaneously to outlet flow). A = area of tributary watershed (acres or km2) The rational equation is used to calculate the runoff from a region, given: • the runoff coefficient (accounts for infiltration losses in the region), • the rainfall intensity to the region, • the time for runoff to travel from the region's upper reaches to its outlet, and • the region's drainage area. A. (4.) ADDITIONAL MONITORING REQUIREMENTS [G.S. 143-215.1(b)] (a.) EPA Method 625.1— Base Neutrals & Acids (Semi-VOCO. The permittee shall conduct Monthly effluent pollutant scans using protocols as defined in E.P.A. Document EPA 821-R-16-007 entitled "Method 625.1: Base/Neutrals and Acids by GC/MS". The parameter code for reporting EPA Method 625.1 is 76028. Parameter codes for reporting analytes associated with this method are listed in EPA Method 625.1: Tables 1, 2 and 3 below. Page 5 of 14 Draft Permit NC0081469 (b.) Standard Conditions. Analytical methods shall be in accordance with 40 CFR Part 136 and shall be sufficiently sensitive to determine whether parameters are present in concentrations greater than applicable standards and criteria (See Part II. Section D). Laboratory reports shall be kept on file in accordance with records retention requirements found in Part 11. Section D. (c.) Effluent Scan Reporting. • For the eDMR application system, under the parameter code for the pollutant scan, indicate whether the test was performed by entering "1" for "yes" and "0" for "no". • Any detection of analytes shall be entered in eDMR, using the appropriate parameter code listed in the tables below. Once an analyte is detected, the parameter should be reported in eDMR at the same monitoring frequency as the pollutant scan until further notice by the Division. • Parameter codes noted with "+" in the tables below may not currently be allowed in eDMR and will need to be added by the eDMR administrator. Please submit requests to add parameters to the appropriate eDMR contacts with the Division. • Any analytes in the tables below that do not have an assigned parameter code are noted as "No Code". These parameters shall be noted in the comments section of eDMR by noting the analyte detected, the CAS Registry No. and the reported concentration. • A current List of Parameters Allowed for DMRs can be found at the following webpage: https://deq.nc. gov/about/divisions/water-resources/edmr/user-documentation. (5.) SCHEDULE OF COMPLIANCE FOR TOLUENE, TOTAL RECOVERABLE PHENOLICS, AND NAPHTHALENE [G.S. 143-215.1(b)] During this permit cycle, from the effective date of the permit until permit renewal (2028) the applicable limits for Toluene, Total Recoverable Phenolics and Naphthalene will not be imposed. During this time the permittee will undertake reviews and actions to move toward compliance with these limits in the next permit cycle. Actions taken by the permittee and data collected during this permit cycle may result in evaluations that adjust the required limits for the parameters of concern in future permits. (a.) No later than one year from the effective date of this permit the permittee shall submit a report summarizing the actions taken toward compliance with the permit limits. (b.) No later than two years from the effective date of this permit the permittee shall submit a report summarizing the actions taken toward compliance with the permit limits. (c.) No later than three years from the effective date of this permit the permittee shall submit a report summarizing the actions taken toward compliance with the permit limits. (d.) No later than four years from the effective date of this permit the permittee shall submit a report summarizing the actions taken toward compliance with the permit limits. This report may be combined with the permittee's submittal of the renewal application for this permit and should include information that the Division should consider in evaluating limits for Toluene, Total Recoverable Phenolics and Naphthalene in the renewal process. (6.) ELECTRONIC REPORTING - DISCHARGE MONITORING REPORTS [G.S. 143-215.1(b)] Federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and program reports. The final NPDES Electronic Reporting Rule was adopted and became effective on December 21, 2015. (6.) • Section E. (5.) Signatory Requirements Reporting Records Retention Monitoring Reports 1. Reporting Requirements [Supersedes Section D. (2.) and Section E. (5.) (a)] Page 10 of 14 Draft Permit NC0081469 The permittee shall report discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR) internet application. Monitoring results obtained during the previous month(s) shall be summarized for each month and submitted electronically using eDMR. The eDMR system allows permitted facilities to enter monitoring data and submit DMRs electronically using the internet. The eDMR system may be accessed at: https:Hdeg.nc.aov/about/divisions/water-resources/edmr. If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being physically located in an area where less than 10 percent of the households have broadband access, then a temporary waiver from the NPDES electronic reporting requirements may be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1.1, 2, 3) or alternative forms approved by the Director. Monitoring results obtained during the previous month(s) shall be summarized for each month and reported via the eDMR system no later than the last calendar day of the month following the completed reporting period. Regardless of the submission method, the first DMR is due on the last day of the month following the issuance of the permit or in the case of a new facility, on the last day of the month following the commencement of discharge. Starting on December 21, 2025, the permittee must electronically report the following compliance monitoring data and reports, when applicable: Sewer Overflow/Bypass Event Reports; Pretreatment Program Annual Reports; and Clean Water Act (CWA) Section 316(b) Annual Reports. The permittee may seek an electronic reporting waiver from the Division (see "How to Request a Waiver from Electronic Reporting" section below). 2. Electronic Submissions In accordance with 40 CFR 122.41(1)(9), the permittee must identify the initial recipient at the time of each electronic submission. The permittee should use the EPA's website resources to identify the initial recipient for the electronic submission. Initial recipient of electronic NPDES information from NPDES-regulated facilities means the entity (EPA or the state authorized by EPA to implement the NPDES program) that is the designated entity for receiving electronic NPDES data [see 40 CFR 127.2(b)]. Page 11 of 14 Draft Permit NC0081469 EPA plans to establish a website that will also link to the appropriate electronic reporting tool for each type of electronic submission and for each state. Instructions on how to access and use the appropriate electronic reporting tool will be available as well. How to Request a Waiver from Electronic Reporting The permittee may seek a temporary electronic reporting waiver from the Division. To obtain an electronic reporting waiver, a permittee must first submit an electronic reporting waiver request to the Division. Requests for temporary electronic reporting waivers must be submitted in writing to the Division for written approval at least sixty (60) days prior to the date the facility would be required under this permit to begin submitting monitoring data and reports. The duration of a temporary waiver shall not exceed 5 years and shall thereupon expire. At such time, monitoring data and reports shall be submitted electronically to the Division unless the permittee re -applies for and is granted a new temporary electronic reporting waiver by the Division. Approved electronic reporting waivers are not transferrable. Only permittees with an approved reporting waiver request may submit monitoring data and reports on paper to the Division for the period that the approved reporting waiver request is effective. Records Retention [Supplements Section D. (6.)] The permittee shall retain records of all Discharge Monitoring Reports, including eDMR submissions.
