This law impacts any development approval issued by the Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010. The law extends the effective period of any stormwater permit that was set to expire during this time frame up to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for an extension of up to four (4) years On November 8, 2012 Staff of the Division of Water Quality, determined that the Renewal Request for this permit was mailed to the wrong address. As a result of this the following has been determined: • On August 22, 2002, the Wilmington Regional Office received a request for the transfer of ownership of the Stormwater Management Permit from Echo Group, LLC to Westwood at Echo Townhome Association, Inc. • The permit transfer was accepted on September 11, 2002, but the hardcopy of the transferred permit was never issued to Westwood at Echo Townhome Association, Inc. • The permit is subject to the extensions granted and the new renewal date would have been March 24, 2011. However, due to the fact that the renewal letter was mailed to the wrong address this office is allowing 180 days to submit the attached Renewal Application and associated $505.00 fee. As indicated on the Name/Ownership Change form, you have acknowledged receipt of a copy of the permit, which includes the application and supplement forms, a copy of the approved plans and a copy of the required Operation and Maintenance agreement from the previous permittee. By acknowledging receipt of the permit, and by signing the Name/Ownership Transfer form, you have accepted the responsibility for complying with the terms and conditions outlined in this permit. If you need additional copies of the permit, or copies of the approved plans, please contact the Division of Water Quality in the Wilmington Regional Office at the phone number below. A letter of reply was sent back to you in November 2002 stating that your request would be acted upon with the completion of the items mentioned in the letter. We have yet to receive any follow-up correspondence from you on the matter. 3. Overall the pond looked good. You should verify the orifice size (opening in the outlet structure) to be sure it has not become larger than what was permitted. Also, a small amount of debris was noted in the outlet structure and should be removed. 4. The vegetative filter appears to be nothing more than a drainage ditch. The flow spreader could not be located and there was no grass on the filter, just leaves and tree debris. S. Operation and maintenance records were not available on the inspection date. According to the last inspection report from RPS, dated November 12, 2002, the pond was in compliance with the permit conditions.
