On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any
development approval issued by the Division of Water Quality under Article 21 of Chapter 143 of
the General Statutes, which is current and valid at any point between January 1, 2008, and
December 31, 2010. The law extends the effective period of any stormwater permit that was set
to expire during this time frame up to three (3) years from its current expiration date. On August
2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for an
extension of up to four (4) years
On November 8, 2012 Staff of the Division of Water Quality, determined that the Renewal
Request for this permit was mailed to the wrong address.
As a result of this the following has been determined:
• On August 22, 2002, the Wilmington Regional Office received a request for the transfer
of ownership of the Stormwater Management Permit from Echo Group, LLC to
Westwood at Echo Townhome Association, Inc.
• The permit transfer was accepted on September 11, 2002, but the hardcopy of the
transferred permit was never issued to Westwood at Echo Townhome Association, Inc.
• The permit is subject to the extensions granted and the new renewal date would have
been March 24, 2011. However, due to the fact that the renewal letter was mailed to the
wrong address this office is allowing 180 days to submit the attached Renewal
Application and associated $505.00 fee.
As indicated on the Name/Ownership Change form, you have acknowledged receipt of a copy
of the permit, which includes the application and supplement forms, a copy of the approved
plans and a copy of the required Operation and Maintenance agreement from the previous
permittee. By acknowledging receipt of the permit, and by signing the Name/Ownership
Transfer form, you have accepted the responsibility for complying with the terms and conditions
outlined in this permit. If you need additional copies of the permit, or copies of the approved
plans, please contact the Division of Water Quality in the Wilmington Regional Office at the
phone number below. For your records, please find enclosed a copy of the updated page 2 of
the permit, a copy of the inspection report, and a copy of the Name/Ownership Change form
submitted on August 22, 2002.

This permit shall be effective from the date of issuance until March 24, 2011 and shall be subject to the
following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the
application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described on
page 3 of this permit, the Project Data Sheet. The stormwater control has been designed to handle the
runoff from 148,620 square feet of impervious area.
3. Approved plans and specifications for this project are incorporated by reference and are enforceable
parts of the permit.

1. Your permit expired on March 3, 2007. To date, this office has not received a renewal request. You are advised that operation
of a stormwater facility without a permit is a violation of NC General Statute 143-215.1. You must request renewal at once.
2. You requested a name change in 2002. A letter of reply was sent back to you in November 2002 stating that your request
would be acted upon with the completion of the items mentioned in the letter. We have yet to receive any follow-up
correspondence from you on the matter.
3. Overall the pond looked good. You should verify the orifice size (opening in the outlet structure) to be sure it has not become
larger than what was permitted. Also, a small amount of debris was noted in the outlet structure and should be removed.
4. The vegetative filter appears to be nothing more than a drainage ditch. The flow spreader could not be located and there was
no grass on the filter, just leaves and tree debris.
S. Operation and maintenance records were not available on the inspection date. You are reminded that records must be kept in
accordance with the requirements in your permit.

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number
SW8970240 to Echo Group LLC, for a High Density stormwater pond to serve Echo Towns on
3/24/1997. This permit expired on 3/24/2007. You were sent a letter on January 25, 2008,
which inadvertently stated the amount of the processing fee as $420.00. This fee is actually
$505.00.
In addition, a name/ownership change was submitted in 2002. This office requested additional
information in order for the permit to be transferred to the Echo Town Homeowners, Inc.
Because this information was not received by this office, the permitee is still Echo Group LLC.
The forms for the Renewal Application, Name Ownership Change, Operation and Maintenance
Agreement, and Designer's Certification were provided in the January 25, 2008 letter. Upon
receipt of all information required to issue the new permit, the Division can transfer the permit
to a new permitee. If you need additional forms, please contact this office to receive them.
Section .1003(h) of 15 A NCAC 2H .1000 (the stormwater rules) requires that applications for
permit.renewals shall be submitted 180 days prior to the expiration of a permit and must be
accompanied by a processing fee, which is currently set at $505.00. If this is still an active

has not been constructed and a permit is no longer needed, please submit a request to have

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number
SW8970240 to Echo Group LLC, for a High Density stormwater pond to serve Echo Towns on
3%24/1997. This permit expired on 3/24/2007. Section .1003(h) of 15 A NCAC 2H .1000 (the.
stormwater rules) requires that applications for permit renewals shall be submitted 180 days
prior to the expiration of a permit and must be accompanied by a processing fee, which is
currently set at $420.00. If this is still an active project please complete and submit the
enclosed renewal application in a timely manner. If this project has not been constructed and a
permit is no longer needed, please submit a request to have the permit rescinded. If you have
sold the project, or are no longer the permittee, please provide the name, mailing address and
phone number of the person or entity that is now responsible for this permit. Enclosed is a form
for change of ownership, which should be completed and submitted if the property has
changed hands.

According to the Secretary of State's corporations database, you are the registered agent for both
corporations, and both corporations have the same principal mailing address. It has been the
Division's policy to transfer a permit to an HOA only after all of the following have occurred:
I . The stormwater facilities have been either restored to design condition, or a recent

inspection by an appropriate design professional has determined that the facilities
are in compliance with the Stormwater Management Permit;
2. A sufficient number of lots have been sold such that the developer no longer has a

majority vote;
3. A person who lives in the development and has no business connection to the
permittee is named as the president and accepts the permit.
This policy was formulated in response to the many HOA's that were being formed by the
developer and left with large maintenance expenses resulting from stormwater facilities that had
either not been properly maintained during the construction of the development, or had not been
restored to design condition. A number of maintenance and construction deficiencies were found
during an inspection conducted on May23, 2000. Per a letter from Retention Pond Services, Inc.,
dated August 13, 2000, the deficiencies were corrected. According to the last inspection report
from RPS, dated November 12, 2002, the pond was in compliance with the permit conditions. If
you can meet all three conditions above, I would be happy to complete the transfer of ownership.

Observations And Comments To Center Owners/Operators:
At the time of this inspection, pond conditions were good. Nuisance vegetation was under control. Trash
and accumulated debris were removed.

Monthly Inspection: Last Monthly Inspection: October 15, 2002
Inspect the trash rack; remove accumulated debris, repair/replace the rack K it is not
functioning properly.
Inspect and clear intake orifice of any obstructions. If a pump is used as the drawdown
mechanism, pump operation will be checked. The log of test runs for the pump
should be kept on site. Inspection personnel will operate pump and sign off on test log.
Inspect the pond side slopes and grassed inlet sweles if applicable. Any eroded areas
are noted in the remark section of page 1.
If the pond is operated with a vegetated filter, the filter has been checked for sediment
accumulation, trash accumulation, erosion and proper operation of the flow spreader
control.

Dear Linda,
Please find enclosed the application to change the name of the permit holder for the
aforementioned development. The system was certified back in the fall of 2000 as a result of a
compliance inspection by Scott Vinson and subsequent punch work by Retention Pond Services.
I am including a copy of the certification. I am also including an original Pond Maintenance
Agreement and a copy of the deed conveying the common areas to the Owner's Association.
I hope that this adequately addresses the requirements for this ambition. Please contact
me by phone or email if this is not the case in hopes that any additional information needed can
be provided with relatively minimal time and effort. Ultimately, we are desiring some
correspondence from Water Quality that acknowledges the changing of the permit holder.
