It has been determined that the nature of the proposed change meets the definition of a minor modification in that it does not result in an increase in the size of the permitted stormwater control measure (SCM) and does not increase the amount of built -upon area. Please refer to Attachment C for a detailed description of the current proposed minor modification and a list of all the past modifications approved during the effective period of the permit. We are forwarding you an approved copy of the modified plans for your files. Please add the attached plans to the previously approved plan set. Please replace the previously issued permit with the revised permit, dated September 16", 2020, attached. This revised permit does not impose new or different terms; it merely restates and clarifies some of the previous terms to provide you with a better understanding of your obligations under the permit. Please be aware that all terms and conditions of the permit issued on February 23td, 2018 and modified as attached, remain in full force and effect. Please also understand that the approval of this minor modification to the subject State Stormwater Permit is done on a case -by -case basis. Any other changes to this project must be approved through this Office prior to construction. The approval of this minor modification does not preclude the permittee from complying with all other applicable statutes, rules, regulations or ordinances which may have jurisdiction over the proposed activity, and obtaining a permit or approval prior to construction. North Carolina 28405 910.796.720 NONIH G�LINA ,./ State Stormwater Management Systems Permit No. SW8 960424 STATE OF NORTH CAROLINA DEPARTMENT OF ENVIRONMENTAL QUALITY DIVISION OF ENERGY, MINERAL AND LAND RESOURCES STATE STORMWATER MANAGEMENT PERMIT HIGH DENSITY ALTERNATIVE DESIGN DEVELOPMENT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Carteret Community College Carteret Community College Expansion Morehead City, Carteret County FOR THE construction, operation and maintenance for one (1) area of redevelopment (the 'redevelopment area"), for an Alternative Design consisting of one (1) Wet Detention Pond used for pre-treatment of 1.5" of runoff prior to a final polishing in Infiltration Pond, and one (1) infiltration system alone, in compliance with the provisions of 15A NCAC 2H .1000, effective September 1, 1995 (hereafter referred to as the "stormwater rules') and the approved stormwater management plans and specifications and other supporting data as attached and on file with and approved by the Division of Energy, Mineral and Land Resources (DEMLR) and considered an enforceable part of this permit. This permit shall be effective from the date of issuance until July 16, 2022 and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. The redevelopment portion of this project is exempt from State Stormwater permitting requirements under the following conditions: a. The project must be constructed as shown on the plans submitted to this Office. b. The redevelopment area proposes 2,400 square feet of BUA, which does not exceed the existing BUA of 2,400 square feet. This permit does not provide any allocation of BUA for future development within this redevelopment area. c. The proposed stormwater controls of vegetated sheet flow and rainwater harvesting provides equal protection of surface waters as the existing stormwater control of vegetated sheet flow. 3. This stormwater system has been approved for the management of stormwater runoff as described in the Project Data Sheets of this permit. The stormwater controls have been designed to handle the runoff from a total of 121,100 square feet of impervious area. 4. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 5. The tract will be limited to the amount of built -upon area indicated in this permit, and per the approved plans. Page I of 9 State Stormwater Management Systems Permit No. SW8 960424 6. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. The following items will require a modification to the permit (In addition, the Director may determine that other revisions to the project should require a modification to the permit.): a. Any revision to the approved plans, regardless of size. b. Project name change. c. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. g. The construction of permeable pavement for impervious area credit. 8. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. The Rainwater Harvesting System must consist of the following major components: a. A collection system, b. A pre-treatment device to minimize gross and coarse solids collection in the tank, c. A cistern or other storage device, d. An overflow; and e. A distribution system. 2. Fate of Captured Water: Captured stormwater shall be used or discharged as follows: a. Use to meet a water demand. The usage, type, volume, frequency, and seasonality of water demand shall be established and justified, b. Discharge through a passive drawdown device to a vegetated infiltration area or another SCM; or c. A combination of use and passive discharge. 3. Sizing: The Rainwater Harvesting System shall be considered as a primary SCM because the system is sized and water demand and passive discharge for 85 percent of the total annual runoff volume as demonstrated through water balance calculations. 4. Water Balance Calculations: The system has been designed using the NCSU Rainwater Harvester model. 5. Distribution System: The distribution system shall be tested for functionality prior to the completion of the rainwater harvesting system. 6. Signage: All harvested rainwater outlets such as spigots and hose bibs, and appurtenances shall be labeled as "Non -Potable Water" to warn the public and others that the water is not intended for drinking. Passive drawdown devices, when employed, shall be marked with identifying signage or labels that are visible to owners and maintenance personnel. 7. Setbacks: The concrete basins located in the buffer are necessary to bring seawater into the system, and have therefore been determined to be water -dependent structures which are allowed per. 1003(4)(d)(ii), effective January 1, 2017. SCHEDULE OF COMPLIANCE The permittee will comply with the following schedule for construction and maintenance of the stormwater management system: a. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. c. All connections into the permitted system from future areas shall be made such that short- circuiting of the system does not occur. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at the design condition. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. c. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. h. Check the ability of the infiltration systems to drawdown within 5 days. 3. Records of maintenance activities must be kept and made available upon request to authorized personnel of DEQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 4. The facilities shall be constructed, operated and maintained in accordance with the provisions of this permit, the approved plans and specifications, and the supporting documents attached to this permit and on file with the Division. 5. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 6. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of the recording. The recorded copy must be signed by the permittee, dated, stamped with the deed book number and page, and bear the stamp of the Register of Deeds. 7. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 8. Decorative spray fountains will be allowed in the stormwater treatment system if calculations are provided documenting the permanent pool volume is greater than 30,000 cubic feet. Page 6 of 9 State Stormwater Management Systems Permit No. SW8 960424 No person or entity, including the permittee, shall alter any component shown in the approved plans and specifications. Prior to the construction of any modification to the approved plans, the permittee shall submit to the Director, and shall have received approval for modified plans, specifications, and calculations including, but not limited to, those listed below. For changes to the project or SCM that impact the certifications, a new or updated certification(s), as applicable, will be required and a copy must be submitted to the appropriate DEQ regional office upon completion of the modification. a. Any modification to the approved plans and specifications, regardless of size including the SCM(s), BUA, details, etc. b. Redesign or addition to the approved amount of BUA or to the drainage area. c. Further development, subdwision, acquisition, lease or sale of any, all or part of the project and/or property area as reported in the approved plans and specifications. d. Altering, modifying, removing, relocating, redirecting, regrading, or resizing of any component of the approved SCM(s), the stormwater collection system and/or vegetative conveyance shown on the approved plan. e. The construction of any allocated future BUA. f. The construction of any permeable pavement, #57 stone area, public trails, or landscaping material to be considered a permeable surface that were not included in the approved plans and specifications. g. Other modifications as determined by the Director. III. GENERAL CONDITIONS Permit Transfer: This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed "Permit Transfer Application Form" (available on the Division website) accompanied by the required fee and supporting documentation as listed on the form, to the Division at least 60 days prior to any one or more of the following events: a. The sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions and protective covenants; b. Dissolution of the partnership, corporate, or LLC entity, subject to NCGS 55-14-05 or NCGS 57D-6-07 and 08, c. Bankruptcy; d. Foreclosure, subject to the requirements of Session Law 2013-121; 2. Current Permittee Name or Address Changes: The permittee shall submit a completed "Permit Information Update Application Form" (available on the Division website) to the Division within 30 days to making any one or more of the following changes: a. A name change of the current permittee; b. A name change of the project, c. A mailing address change of the permittee; 3. Any individual or entity found to be in noncompliance with the provisions of this stormwater management permit or the requirements of the Stormwater rules is subject to enforcement procedures as set forth in NCGS '143 Article 21. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DEQ Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. The permit issued shall continue in force and effect until the permittee files a request with the Division for a permit modification, transfer, renewal, or rescission; however, these actions do not stay any permit conditions. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Neither the sale of the project, in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the stormwater permit. 10. A permit renewal request must be submitted at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate application, documentation and the processing fee as outlined in Title 15A NCAC 02H.1045(3). The highway comprises the northern limits of the campus, with the southern boundary being the normal high-water level of Bogue Sound. The surface waters of Bogue Sound in this location are classified by the INC Division of Water Resources as SA. The college urgently needs to construct a greenhouse in support of the recently re-established Horticulture Technology Program. College staff indicates that the future of this program is dependent upon the greenhouse being constructed this upcoming August (2020). There are currently five stormwater permits for the college campus. The existing permits are listed below: SW8 940419 West Campus Expansion (active, no expiration date) SW8 960424 Master Plan & 2018 Modification (South of Howard Building (active, expires 7/16/22)) SW8 970426 Center for Marine Sciences and Technology (active, expires 7/15/21) SW8 020908 Additions & Renovations ((Wayne West Building) expired on 2/27/18) SW8 190107 Hospitality & Culinary Arts Building (active, expires 3/4/27) In accordance with past discussions with NCDEMLR staff, CCC maintains its commitment to consolidating four of the five stormwater permits into a single permit. The most recently acquired permit, for the Hospitality & Culinary Arts Building (SW8 190107), is proposed to remain separate. Our original intent was to include the urgently needed greenhouse in the permit consolidation. However, a currently contracted survey of the entire college campus (necessary to consolidate the permits) anticipated to be completed in December 2019 remains unfinished. The survey is to provide the campus boundary as a single project area (excluding the Hospitality and Culinary Arts project) and provide horizontal and vertical data for all impervious areas and stormwater facilities. Page 1 of 2 Based upon the forthcoming comprehensive survey and per NCDEMLR guidance, CCC ultimately will consolidate and modify the campus permitting as necessary to reflect the verified (as -built) conditions. In the interim, permitting and construction of the greenhouse is urgently needed to accommodate the fall semester horticulture students. Therefore we are currently proposing to modify existing State Stormwater Management Permit SW8 960424 to include and address the greenhouse built -upon area and associated runoff. The current proposal is similar to a modification approved February 23, 2018 for a shellfish mariculture demonstration center within the permit project area. The proposed greenhouse and concrete sidewalk will measure 72.17' x 24.67' (1,780.4 ftZ) and 9.78' x 5' (48.9 ftZ) respectively, for a total of 1,829.3 ftZ. The project land disturbance is anticipated to be approximately 2,500 ftZ. The proposed project will create additional impervious surfaces beyond what is currently identified or permitted under the existing stormwater permit, thus necessitating a major modification. There is no wetland disturbance proposed. While coastal wetlands are found intermittently along the shoreline of the ±42 acre campus, none are located within the current project area. Non -coastal wetlands are also thought to be located on the campus, although none are believed to be located within the current project area. We are aware that the locations of coastal wetlands and non -coastal wetlands will need to be verified respectively by the NC Division of Coastal Management and the US Army Corps of Engineers. Stormwater runoff is proposed to be treated via rainwater harvesting (a cistern), as in the 2018 modification. The collected rainwater will deliver the additional benefit of providing some of the demand for water needed in association with greenhouse operations. The remaining water needs will be met through connection to the Town of Morehead City public water system. Please note, previous shoreline delineations did not place the proposed greenhouse in a CAMA Area of Environmental Concern (AEC). However, during the ongoing survey work, a landward migration of the normal high-water line was recently identified, thus placing the site within the coastal shoreline AEC, but out of the CAMA buffer. Therefore, both an express State Stormwater Permit Major Modification and a CAMA Major Permit are being sought to facilitate construction of the greenhouse as soon as possible. The College urgently needs to construct a greenhouse to sustain its horticulture program. CCC is requesting express review of a modification (reallocation of redevelopment BUA) of stormwater permit SW8 960424 to this end. The original permit was approved in 1996 and was first modified in 2018. Most of the work proposed in the 1996 permit did not occur, including substantial redevelopment. The construction set forth in the 2018 modification did occur. SW8 960424 currently permits 3 Alternative Wet Detention Pond/Infiltration Basin Systems, an Infiltration Basin and via the 2018 Modification, a Rainwater Harvesting Cistern combined to serve 123,441 sf of BUA. In addition, the redevelopment of 112,849 sf was approved. 1 of the 3 Alternative Wet Detention Pond/Infiltration Basin Systems (system #1) and the associated BUA (17,581 sf) were constructed. The Rainwater Harvesting Cistern (system #5) and associated BUA (2,341 sf) were constructed. 57,939 sf of the proposed redevelopment was substantively constructed. After issuance of permit SW8 960424 in 1996, additional stormwater permits were approved for CCC, and development ensued within or overlapping the subject (1996) permit project area. Runoff from impervious surfaces covered by the subsequent permits is collected and treated in approved SCMs. Please note that since the issuance of the first CCC stormwater permit in 1994 (SW8 940419), every additional stormwater permit has overlapped at least one prior permit, including the most recent (SW8 190107 for the Hospitality & Culinary Arts Building). In order to construct the greenhouse, CCC is seeking redevelopment credit for BUA previously removed from within the subject (1996) permit area, near the proposed greenhouse location but not within an area covered by overlapping permits. - - ii AUG 0 7 2020 BY: Although not in direct conflict with the greenhouse construction, as part of this modification we are also requesting that the originally permitted Stormwater System #3 be deleted from permit SW8 960424, as requested by NCDEMLR. The location of the proposed / permitted (1996), but not constructed system #3 Wet Detention Basin overlaps the existing CMAST (Permit SW8 970426) stormwater infrastructure. The impervious surfaces (Classroom Buildings B & C and appurtenances) associated with the 1996 system #3 were likewise not constructed. CMAST permitting and development now prohibit the proposed construction of Classroom Building B. Also, a "polishing" wetland constructed circa 2006, occupies much of the area formerly proposed for Classroom Building C. During a long and still ongoing complete campus surveying process (initiated in September 2019 as the first step to remedy the difficulties created by the overlapping stormwater permits), it was discovered that the present normal high-water level of Bogue Sound along a section of shoreline east of the proposed greenhouse is significantly landward of that indicated on earlier permit documents. We believe this to be an unintended consequence of a constructed "polishing" wetland, part of a Shoreline Stabilization and Habitat Enhancement Project circa 2006. Prior to this discovery, the requirement for a 50' setback from surface waters was not a concern. Thankfully, the rules allow a 30' setback for redevelopment (consistent with the LAMA buffer) which is provided. To utilize reallocation of redevelopment BUA, the proposed greenhouse must meet the requirements of redevelopment per GS 143-214.7(al) (2) which states: Redevelopment. —Any land -disturbing activity that does not result in a net increase in built -upon area and that provides greater or equal stormwater control to that of the previous development. Whereas the stormwater control of the previous development is unknown, sheet -flow of runoff appears the best case for BUA eligible for redevelopment. This is the proposed condition for the concrete walk at the greenhouse front entry. We submit that the greenhouse gutters, designed to drain to a cistern as an element of a complete Rainwater Harvesting System (in accordance with the NCAC Minimum Design Criteria), provide greater stormwater control than the previous development. Sheet -flow runoff from the top of the cistern and appurtenances will provide equal control to that of the previous development. Please see the original plan sheet 1, Stormwater Masterplan/Existing Impervious Conditions Map for SW8 960424 on which the proposed greenhouse location is indicated. Whereas the stormwater control of the previous development is unknown, sheet -flow of the runoff resulting from a IS' design storm appears the best case, although unlikely for much of the original BUA eligible for redevelopment. When time is not an issue, for future redevelopment, we will request old construction plans and photographs from the college (which may or may not be available). The horticulture instructor encourages inclusion of a cistern. If you agree and will allow, we propose the greenhouse gutters drain to a cistern capturing at a minimum the runoff from the 1.5" design storm and provide for its passive release per the SCM manual as regards DIS or a LS/VFS. To date we have not been provided a non -potable water demand for the greenhouse. It may be that the demand will not be known until the greenhouse has been in operation for some period. If you are in agreement, I will ask the instructor for a volume he would like to have on hand, place the passive Page 1 of 3 drawdown device above this level and not consider greenhouse water use as part of the stormwater management. Please note that Thomas Charles, Regulatory Specialist (USACE) has visited the project site and provided an email stating that the greenhouse project is not in the Corps jurisdiction. We first discussed some of the above during a December 11, 2018 scoping meeting regarding permitting of a campus trail. It was clear then as now, that utilizing BUA redevelopment credit is ideal for the linear nature of the proposed trail. Also, modifying each permit the trail crosses, especially given the multiple permit overlaps and misrepresentations of the existing conditions, was agreed impractical. Please know that the college is continuing to plan on construction of the trail. Since the first stormwater permit was issued in 1994 (SW8 940419), every additional permit has overlapped at least one prior permit, including the most recent (SW8 190107 for the Hospitality & Culinary Arts Building). Please see the attached exhibit A, prepared this past November to illustrate the overlapping of permits. The college is committed to rectifying the state of its stormwater management permitting. Given the multiple permits, modifications and renewals approved since the 1994 permit, I hope that my bringing these overlapping permit actions to DEMLR's attention does not damage CCC by preventing expeditious issuance of the urgently needed minor modification. Please see the attached Preliminary Topographic (Drone) Survey for Carteret Community College from McKim & Creed as evidence that the college is aggressively working to resolve its stormwater permit issues by verifying existing conditions and consolidating four of its five stormwater permits accordingly. The final survey (engaged September 23, 2019 for delivery December 2019 to be provided by The Cullipher Group) is to address the "obscure' areas indicated, delineate all BUA, stormwater ponds, etc. We have asked repeatedly when to anticipate the final survey files, yet do not know. Since receipt of the preliminary drone survey, we did receive a survey of the campus boundary as a single parcel. Following are brief discussions of each permit. I hope they are helpful in your deliberations as to allowing the requested minor modification. SW8 940419 Proposed 4 Infiltration Basins and 78,373 sf of BUA — none of which were constructed. I believe the final survey will demonstrate this permit may be rescinded without concern. SW8 960424 Proposed 3 Alternative Wet Detention Pond/Infiltration Basin Systems, an Infiltration Basin and via a 2018 Modification a Rainwater Harvesting Cistern combined to serve 123,441 sf of new BUA. In addition, the redevelopment of 112,849 sf was approved. 1 of the 3 Alternative Wet Detention Pond/Infiltration Basin Systems and the associated BUA (17, 581 sf) were constructed. The Rainwater Harvesting Cistern and associated BUA (2,341 sf) were constructed. 57, 939 sf of the proposed redevelopment was constructed. Page 2 of 3 Of the unbuiIt stormwater treatment systems, retaining the right to only the infiltration system (#4) has value to the college. SW8 970426 The treatment of runoff from all proposed BUA by infiltration appears consistent with the permit documents. 4,782 sf of BUA indicated to be pre-existing and eligible for redevelopment (see SW8 94019 and SW8 960424) was removed from within the project area. SW8 020908 The treatment of runoff from all proposed BUA by infiltration appears consistent with the permit documents. 91,181 sf of BUA indicated to be pre-existing and eligible for redevelopment (see SW8960424) was removed from within the project area. Upon receipt of the complete campus survey, we look forward to verifying the existing conditions, combining the permits as discussed above as well as incorporating additional campus areas not presently within a stormwater permit project area. As previously considered, if I can demonstrate this to your satisfaction (via the existing permit documents), I now believe this is the better permitting pathway to expedite construction of the greenhouse. At this time, we request this only for the proposed greenhouse impervious area (1,830 ftz). I prepared a narrative and two exhibits to this end in November of 2019 and recall discussing the scenario with you, but I cannot find an email where I sent you the documents. My recollection is that you indicated it may be possible. In any case the option was not pursued, as I had expected to soon receive a survey that would not only provide for the greenhouse, but address all the CCC permits. We agree that the existing, overlapping, and misrepresentative CCC permits must be addressed as soon as possible. CCC and Crystal Coast Engineering, PA (CCE) entered into an agreement on September 25, 2019 to this end. A comprehensive survey of the campus is essential to address the multiple stormwater permits. As part of CCE's agreement with the college, a surveying and engineering group was engaged on behalf of CCC and scheduled to perform the survey field work last fall. We were told to expect delivery of certified paper and CAD file copies of the survey in December of 2019. The surveying firm delegated field data collection (with CCC and CCE support) to a second engineering and surveying firm equipped to perform an aerial survey of the campus. The aerial survey via drone was performed but found to be grossly incomplete. It appears that after several months (and requests for delivery of the survey), it was finally concluded that the survey would have to be completed by crew on the ground. We are assured this work is ongoing and progressing. However, the need for the greenhouse has become ever more urgent as time waiting for the survey has passed. The plan for months has been to treat the greenhouse as redevelopment of previously removed impervious surface. If the commissioned survey were complete, construction of the greenhouse could readily be demonstrated to qualify as redevelopment. We submit at this juncture that the existing permit documents provide that substantial impervious area is currently available to CCC for redevelopment. The amount of documented BUA removed available requiring stormwater control equal to the previous development far exceeds the proposed greenhouse area. However, a landward migration of the normal high- water (NHW) line was recently identified during the ongoing survey work, thus placing the site within the coastal shoreline AEC. Prior to being provided this revised boundary information, a 50' setback would not have been an issue. The prior permit modification application (approved February 23, 2018) identified only a new drainage area (415) for the then -proposed new BUA (please see attached). The project data for the new drainage area q5 (and system) were appended to the original (July 16, 1996) permit. We plan, unless you direct otherwise, to similarly address the currently proposed greenhouse roof drainage area and stormwater management system as drainage area #6 in the forthcoming application. That's fine. 2. The project area was originally permitted per the 1995 Stormwater Rules, which do not appear to require a setback from surface waters. Also, the 95 rules do not explicitly include rainwater harvesting nor had the MDC been established. Do I understand correctly that the setback may be addressed in accordance with the current rules .1003(4)(c) and G.S. 143-214.7(b2)(2)? High density projects under the 1995 rules do not require setbacks. However, any additional BUA, additional SCMs, or SCMs that increasing in size are subject to the 2017 rules (per .1001(1)(d) and .1002(25) ond(23)) and would either have to provide the vegetated setback or demonstrate compliance with one of the exemptions to the setbacks (.1003(4)) and as listed in SL2008-211 (not all of the exemptions were captured in the 2017 rules and are still valid options). If trying to apply. 1 003(4)(c) and GS 143-214.7(b2)(2), that may be tricky as this project does not capture and treat the runoff from the entire development (refer to the Vegetated Setback chapter in the Stormwater Design Manual for additional info on the GS). Additional discussion and determination would be needed prior to scheduling any express submittals. 3. Is compliance with the MDC for Rainwater Harvesting the standard to achieve? Or, are there applicable, additional aspects per the coastal rules? The MDC appears to stand alone. Am I missing something? The MDC are the standards to achieve to demonstrate that the SCM can be considered a primary SCM so that no further treatment would be required. The SCM Credit Document, located on the stormwater design manual website, might help. However, I will admit 1 still need to review the documents it comes to primary and secondary SCMs. 4. The Carteret Community College Vice -President -of Operations and Facilities and horticulture instructor are working on determining the anticipated water use within the greenhouse. Do we need a letter or other document from them stating the water use? We do not see rainwater harvesting being used very frequently. 1 am only aware of a few that have been approved. I would ask you to review the information in .1057 and the associated chapter in the stormwater design manual for additional guidance. Carteret Community College has asked us to pursue express CAMA and stormwater permits for construction of a campus greenhouse for use with the recently re-established Horticulture Technology Program at the college. The greenhouse needs to be constructed in time for use with the upcoming fall semester. According to staff, the future of the horticulture program is dependent upon the greenhouse being in place. We have submitted requests to NCDEQ for express CAMA and stormwater permit reviews. Carteret Community College has just recently become aware that the greenhouse project site is located in a CAMA AEC. A recent survey showed that normal high water has moved landward and that the site is located within the 75-foot coastal shoreline AEC, but outside of the CAMA 30-foot buffer. Project engineers and surveyors have advised that non -coastal wetlands may exist in locations on the +/- 42-acre campus. Coastal wetlands are found intermittently along the shoreline. However they believe there are no coastal or non -coastal wetlands at the proposed greenhouse project location, and that no wetlands will be impacted by the work. We are working with CAMA staff to confirm the location of coastal wetlands. NCDEQ Staff has advised that in order to expedite the process we should contact the Corps to confirm that no non - coastal wetlands exist at the site. Would it be possible for you to visit the campus and confirm no wetlands in the project area? I can send maps and can also meet you onsite. I checked the status of the permits we discussed: SW8 940419 — active, no expiration date SW8 960424 — active, expires 7/16/22 SW8 970426 — active, expires 7/15/21 SW8 020908 — expired on 2/27/18 I also looked back at my notes regarding the setback. The 30' setback applies to projects / project areas that meet the redevelopment criteria found in the general statutes and would generally receive a redevelopment exemption from the rules (no increased BUA, equal or better treatment). As you develop the master plan more, how the site is divided up could impact the setback. For instance, if you designate a project/drainage area next to the surface waters as "redevelopment" and will meet all of the redevelopment requirements (now and in the future), then the setback would be 30'. Otherwise, the setback would be 50'. Feel free to let me know if you have any questions. I wanted to give you a heads up that one of the big differences between stormwater and CAMA is the setback requirement. Starting in 2008, the stormwater rules require a 50' buffer/setback requirement. I know there is some older permits through much of this area, but any areas that are subject to the 2008'or 2017 rules will need to consider a 50' buffer/setback though .1003(4)(c) and (d) may mitigate these issues.
