REGAN Secretary TRACY DAVIS Ott ector Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water Qualm, (DWQ) to the Division of Energy, Mineral and Land Resources (DENILR). All previous references to DWQ will remain in older stormvater permits issued prior to August 1, 2013 until they are modified. Please note that the updated permit or any updated pages to the permit will now reference DEMLR as the Division responsible for issuance of the permit. On November 29, 2017, the Division of Energy, Mineral and Land Resources (DEMLR) received a permit Renewal application for the subject project. The Division is hereby notifying you that permit SUr8 960424 has been renewed as follows: 1. 7/16/96: Original permit issued with the expiration date of 7/16/06. 2. 12/6/17: Permit renewed to extend the expiration date by eight years to 7/16/14. 3. 12/7/17: Permit renewed to extend the expiration date by eight years to 7/16/22. 4. 12/8/17: Permit modification application accepted for review. For your records, please find enclosed it copy of the renewed permit, and a copy of the renewal forms submitted on November 29, 2017. This permit is subject to the conditions and limitations as specified in the renewed permit. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of Stormwater runoff as described in the Project Data Sheets of this permit. The stormwater controls have been designed to handle the runoff from a total of 121,100 square feet of impervious area. 3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 4. The tract will be limited to the amount of built -upon area indicated in this permit, and per the approved plans. 5. The perniurce is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. State Stormwater Management Systems Permit No. SWR 960424 6. The following itans will require a modification to the permit On addition, the Director may determine that other revisions to the project should require a modification to the permit.): a. Purther subdivision of the project area. f. Pilling in, altering, or piping of any vegetative conveyance shown on the approved plan. g. The construction of permeable pavement for impervious area credit. 7. The Director may notify the permittec when the pennitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittec shall provide copies of revised plans and cenification in writing to the Director that the changes have been made. SCHEDUl E oR COMPHANCr 1. The perminee will comply with the following schedule for construction and maintenance of the stormwatcr management system: a. The stormwatcr management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. c. All connections into the permitted system from future areas shall be made such that short-circuiting of the system does not occur. 2. The pcnnittee shall at all times provide the operation and maintenance necessary to assure the permitted stonmwatcr system functions at optimum efficiency. The approved Operation and Nlaintenance Plan must be followed in ii s entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. c. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. -Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. It. Check the ability ofthc infiltration systems to drawdown within 5 days. 3. Records of maintenance activities must be kept and made available upon request to authorized personnel of DHQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 4. The facilities shall be constructed; operated and maintained in accordance with the provisions of this permit, the approved plans and specifications, and the supporting documents attached to this permit and on file with the Division. 5. Upon completion of construction, priorto issuance of a Certificate Of Occupancy, and prior to operation ofthis permitted facility; a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 6. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of the recording. The recorded copy must be signed by the pcnnittee, dated, stamped with the deed book number and page, and bear the stamp of the Register of Deeds. 7. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum often years from the date of the completion of construction. S. If the use of permeable pavement for 13UA credit within the lot is desired, the permince shall direct the lot owner to submit an application with all supporting documentation and the application fee to the Division and receive a permit prior to construction of the permeable pavement. "fhe permittee shall submit a completed and signed Namc/Ownership Change Form, accompanied by the supposing documentation as listed on the form, to the Division cf I%nergy, Mincral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in pas, except in the case of an individual lot sale that is made subject to the recorded deed restrictions: b. The sale or conveyance of the common areas to a I lomcowner's or Properly Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy; d. Foreclosure, subject to the requirements of Session Law 2013-121; e. Dissolution of the partnership or corporate entity, subject to NCGS 571)-2-01(e) and NCGS 57D-6- 07: f. A name change of the current pcnnittce; g. A name change of the project; h. A mailing address change of the pcnnittce: 2. Failure to abide by the conditions and limitations contained in this permit may subject the Pernimce to enforcement action by the DFMLR, in accordance with Nosh Carolina General Statute 143-215.6(a) to 143-215.6(c). 3. The issuance ofthis permit does not preclude the Permittce from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state; and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Pennittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stonnwater management systems. 5. The permittee grants DLQ Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuarice or termination does not stay any permit condition. 7. Any individual or entity found to be in noncompliance with the provisions of this stormwater management permit or the requirements of the Stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. 8. The permittee is responsible,for compliance with all permit conditions until such time as the Division approves the transfer request. Neither the sale of the project, in whole or in pas, nor the conveyance of common area to a third party constitutes an approved transfer of the stortmvater permit. 9. The pcnnittce shall submit a permit renewal application request at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate documentation and the processing fee. The site is found by following 70 Fast (Arendell St.) towards Carteret Health Care hospital. The college will be located directly across from the hospital entrance along Arendell St. The site location is along the west side of the college property and at the NCSU Center for Marine Sciences and Technology building (301/303 College Circle). The college property is 269 acres (1,171,764s1) in its entirety and 0' to 5' above nhw depending on location and is along Bogue Sound. The upland vegetation mainly consists of lawn grasses and trees. There are wetlands along this area of the property and consist of Spartina alt6niflora, Spartina patens, Jtuicus roemerianus and non -coastal wetlands. ']'here arc existing groins and breakwaters along the property (cove areas) that were permitted in the past. The Division of Water Resources classifies this area as HQW/SA Waters. This area of Bogue Sound is not designated as a Primary Nursery Area and is open to the taking of shellfish. The Morehead City Land Use Plan classifies this area as Public Institutional with Conservation within the AECs. Water depths within this project location are -6 inches nlw/mlw to -1.5' nlw/mlw (field verified), depending on location. The bottom substrate is sand and there are SAV located and marked within the middle cove. The width of the waterbody within this location is approximately 2,800 feet per Google Earth. 10) Proposed Development: Due to the proximity of the CMAST and CCC buildings, easy access, ADA compliancy and existing classroom facilities, the applicants are proposing the demonstration center within this location of the CCC property. The applicants are proposing to construct a covered pavilion area, as well as non -permanent culture gear such as bottom cages, floating oyster bags, floating cages, netting panels, FLUPSY and a floating platform. There would be 4 bottom culture netting located within the most western cove, 9 total locations of floating/suspended gear (4 in middle cove, 3 in most eastern cove and 2 along the west side of the existing pier), 11 total of bottom cages (3 in middle cove, 6 in the eastern cove and 5 along the east side of the existing pier). The FLUPSY would be located along the southeast side of the existing pier (secured to the pier and held in place by anchored with helical screws) as well as a floating platform with gangway along the north- east side of the existing pier. Per the installation specifications for the type of gear (off bottom cages, floating bags, LowproGro cages, Oystube baskets, OysterGro floating cages'), the equipment would be held in place by spans or lengths of rope, pvc risers, weights, rebar or other staking material. The proposal was successful and funds were received to initiate work that involves comparison of oyster gear types and different native oyster strains at industry partner sites, evaluation of sunray venus clams as a means to diversify the industry, and establishing shellfish mariculture demonstration centers at UNCW and at a site on Bogue Sound shared by NCSU CMAST and CCC in Morehead City. 'Permitting is being requested for the latter component of the parent project. Permitting for culture activities was initially sought via a research lease through NCDMF, however due to the presence of SAV on the site it was deemed necessary to seek CAMA permitting. Purpose: The purpose of the proposed shellfish mariculture demonstration center is to provide a site for hands on training of entrepreneurs and existing shellfish producers via workshops, seminars, short courses, and community college curriculum courses. NC Sea Grant will partner with CCC in development of the demonstration center and the educational focus will be on how to properly site, build, and manage a shellfish farm using best practices, thereby supporting development of shellfish mariculture in the state. The demonstration center will also serve as a site to conduct experiments to help develop best management practices for the industry including evaluation of various culture gear types, shellfish strain performance, stocking and.culling strategies, mitigation of biofouhng, and evaluation of native shellfish species with potential for culture in NC. Shellfish mariculture demonstration centers are critical to industry development and several state institutions have established centers including Auburn University and Louisiana State University (Figure 1). Site description: The proposed site consists of a 26.9 acre parcel of land containing the Carteret Community College (CCC) Campus and the North Carolina State University Center for Marine Sciences and Technology (CMAST). CCC and CMAST maintain two adjacent Research Sanctuaries, located on Bogue Sound and the ICW with a total acreage of approximately 0.6 acres (Figure 2). The site includes a research pier and associated infrastructure and 2.5 coves with constructed tombolos. Sediment samples from 10 locations in the research sanctuaries were obtained in 2015 and submitted to the University of Florida for analysis, revealing predominately sandy bottom with some loamy sand bottom which are suitable for bottom clam culture. Depth at the site ranges from 0 in on the northern edges of coves to approximately 10 in at the southern border of the site proximal to the ICW. There is considerable current at the southern edge of the site. Salinity ranges from 28 to 34 ppt. There is SAV present in one of the coves of the site (Figure 3). Dr. Dave Eggleston of CMAST has characterized and marked existing SAV growth. Site attributes: Because the proposed demonstration center is located adjacent to CMAST and CCC, the site will be accessible without the need for a vessel. In addition, the site is ADA compliant with classroom facilities in place that will facilitate meeting and educational opportunities. Also, as part of the grant from NOAA, CCC received funding for the construction of a covered pavilion next to the demonstration site which will be incorporated into training activities. The site is suitable for deployment of water column as well as bottom culture gear and the presence of SAV would allow collaborative research to be conducted with Dr. Eggleston to evaluate SAV/shellfish aquaculture interactions. Site plan and gear deployment: The long term plan for the site is to install non-pernment structures (anchor screws and PVC pipe risers) for support of various water column culture gear types. In addition, it is planned to install non -permanent bottom culture gear including netting and mesh bags and cages for clam culture. No anchors, riser pipes, or bottom culture gear will be placed within 5' of SAV areas and no water column culture gear will be placed above SAV areas. .An initial plan for the layout of gear types on the site is shown in Figure 4. Please note that this is only an initial suggestion and gear and associated structure will be placed according to permit guidelines, if approved. Initially, the following oyster culture gear types are proposed to be deployed: off bottom cages (Figure 5), floating bags (Figure 6), LowProGro® cages (Figure 7), Oystube® baskets as part of a long -line culture system (Figures 8 and 9) and OysterGro® floating cages (Figure 10). As described in Figures 6-8, spans or length of rope or line supporting floating or suspended gear will range from 30 to 75'. Anchor screws will be twisted fully into the bottom manually and PVC risers will be jetted in via water pump. For clam culture, deployment of protective netting panels, mesh bags, and mesh cages is proposed (Figure 11). These gear types will be secured to the bottom with weights, rebar, or other staking material. Access to the CMAST cove with SAV will be allowed only through a single marked pathway to avoid foot traffic through the SAV. Access to the portion of the site close to the research pier will be improved by the addition of a floating dock with gangway (Figure 12). The bottom underneath this proposed location is sand with some rocks, no vegetation is present on this part of the site. To support the shellfish culture activities on the site and demonstrate shellfish nursery techniques, nursery tanks will be maintained within the pavilion area and a Floating Upweller System (FLUPSY) (Figure 13) will be deployed on the East side of the pier. Research on the use of tidal flow to support shellfish growth within the FLUPSY will be evaluated. The FLUPSY will be secured to the pier and the East end will be anchored with helical screws. Access to the floating platform will be gained from the pier. Additional nursery facilities and workspace will be sheltered by the construction of a demonstration pavilion, an open sided covered area located between the Howard Building and the Shoreline (Figure 14). A Stormwater Management Permit Application has been submitted to NCDENR for this project. Environmental monitoring: Salinity and water temperature of the site will be monitored daily. As part of the NOAA grant monthly assessment of primary productivity of the site will be conducted through chl a measurements: In addition, Dr. Eggleston will continue regular sampling and assessment of SAV. Storm and hurricane plan: The: site will be managed according to CMAST and CCC storm and hurricane policy.. This means that this modification can not be completed until the permit is renewed. I have a check here that we can use for a renewal but the problem is that it will only renew it for 8 years (until 2014). So it will still need another renewal to get the permit into compliance and active. So you have a couple of choices: 1. The current check you sent is only good for 60 days which means it will expire 12/4/2017. So if you wanted to use this check for renewal of the permit you would have to immediately send me another check and the renewal application so we can do a double renewal on this project to get it into compliance. Plus we will also need another separate check for the modification. Once the renewals are complete we can do the modification. 2. OR, if you can not get a new check to us before the 12/4/2017 date, we can return the check and you will have to renew and mod later. We will not return the mod package so you can pick up the mod submittal package to submit later. Please let me know what you would like to do. I've gone out of my way to offer the community college other options available to them concerning the storage and infiltration basin, and I don't think the college has lived up to its part of the bargain, so I don't see much way to help you all with this one. Those present included: Trustees, Mr. Bill Henderson and Mr. Holt Faircloth; Carteret Community College (CCC) President, Dr. Joe Barwick; CCC Vice President for Administrative Services, Ms. Janet Spriggs; CCC Director of Operations, Mr. Tommy Rime; CCC Director of Public Affairs, Mr. Morgan Smith; and North Carolina Division of Water Quality Representatives (DWQ), Rick Shiver, Linda Lewis, and Laurie Munn. The purpose of the meeting was to discuss possible alternatives to requiring the college install an impervious liner in the storm water retention pond south of the new Wayne West building. During the discussion, Mr. Shiver said one of the concerns is that the holding pond may be too close to the groundwater table. He stated the lowest part must be at least two feet above the seasonal high level for groundwater. The new storm water system will include a storm water retention pond located south of the new Wayne West Building, which will be connected through a series of pumps and pipes to an infiltration pond located on higher ground northwest of the new Marine Training and Education Center (MARTEC). Storm water will be collected from parking lots and impervious surfaces, gutters, etc., and channeled first to the retention pond before being pumped to the infiltration pond. Mr. Henderson commented that he thought the college was exempt from having to include the liner under the new regulations because the pond was part of the original master plan. Ms. Lewis responded that the new regulations have been in place since 1988 and that there could be no grand fathering allowed, particularly since this is a significant modification of the original plan. Any modification would require it to be updated to today's standards. There was a great deal of uncertainty regarding the elevation associated with the seasonal high level for the water table, and a call was made to Stewart Engineering to try to obtain more information. By meeting's end, no exact data on the seasonal high level for ground water could be obtained. Mr. Rhue is working with the engineers to obtain this information. Ms. Lewis said she had emailed K.C. Underwood with Hayes -Howell in January 2003 asking for water table data, specifically the seasonal high information, and she had not received a response with that information. Mr. Shiver gave the group an explanation on infiltration requirements and why two feet of vertical separation is required between the bottom of the holding pond and the seasonal high level for ground water. He said engineers could use soil discolorations from boring samples to determine where the seasonal high is located. Mr. Faircloth asked if the college could make the retention pond shallower. Ms. Lewis answered that first they needed to determine what the seasonal high is. She noted the engineers were not required to show the seasonal high level on the specifications because the retention pond in question was originally designed as a storage pond. They did not anticipate that it would require a liner, which could cost anywhere from $100,000 to $146,000, according to Ms. Spriggs. Ms. Lewis said that other alternatives exist such as using clay soil to create the impervious liner. She recommended using an engineer that is familiar with the special rules associated with storm water retention systems in the coastal areas adjacent to SA waters. Projects within one-half mile of SA waters come under special scrutiny and rules. Mr. Shiver said that if you want a successful storm water project, then pick a consultant who works a lot in the counties most affected. Mr. Shiver noted that the project is not in compliance by not having the pumping system in place before any impervious surfaces have been installed. The participants then toured the site of the storm water retention pond. Mr. Shiver said he was willing to consider as an option a ground water monitoring system as part of a pilot project that would forego the need for a liner on the storm water retention pond south of the new Wayne West building. It would have to be designed by the college's engineers and would include approximately three shallow water table monitoring wells near the perimeter of the storm water retention pond. This would be less expensive than the liner. If the tests showed significant contamination of groundwater, then the college would be required to install a liner on the retention pond. He added this approach is innovative and is in keeping with the Triangle J initiatives. He also stated that DWQ might also obtain some useful information from the project. Mr. Shiver noted that the ground water monitoring tests would be over a finite time period that would involve periodic sampling from the test wells. The college would still need the infiltration pond that will be located northwest of MARTEC. Mr. Shiver suggested that Dr. Barwick send DWQ a letter after talking to Stroud Engineering, stating that the college is proposing an alternative that includes design of a series of test wells for monitoring ground water adjacent to the storm water retention pond instead of installing an impervious liner. It was originally permitted with a drainage area of 1.78 acres, and a BUA limit of 72,558 sq. ft. The new building and parking they propose has a 5.34 acre drainage area and proposes 129,113 sq. ft. of BUA. They will have to modify the previously approved alternative system to demonstrate that it can handle the increased drainage area ,and BUA. When they do that, we have to review it under current rules, which means lining the storage pond may still be needed, but they will have another shot at adjudication. After our conversation, I retained Stroud Engineering to give us a professional opinion concerning the requirement of a clay liner for one of our proposed storm water retention ponds. Stroud Engineering assisted the college in developing and permitting a campus -wide storm water plan in 1996 and also provided technical assistance to Stewart Engineering in designing the proposed pond for our current construction. We hastily accepted the new permit because we had a deadline that would have jeopardized a $1.5 million Economic Development Authority grant. Also, as the pond was designed with the original permit in hand, we did not anticipate the addition of the clay linernor the amount of change this would require in the original bid. I realize that through the published procedures, we had 30 days to appeal the new permit. Hopefully, you understand why our appeal in this letter has fallen out of the normal process. What we would like for you to consider is to allow us to operate with a modification of permit SW8 960424. For your convenience, a copy of that permit is enclosed, along with a copy of the letter from Stroud Engineering, and copies of the campus wide storm water plan on which SW8 960424 was based. As that permit does not expire until July 2006, 1 request that we be allowed to comply with those conditions. It is my understanding that our new construction does not exceed the impervious surface and retention capacity in the 1996 design and permit.
