PROJECT SUMMARY: The applicant proposes to add four (4) finger piers and install seven (7) boatlifts at an existing community dock. Elliot Place HOA c/o Ron Jessup 9. PROJECT DESCRIPTION: The project site is located along River Vista Drive, off River Road, adjacent to the Cape Fear River, in New Hanover County. To get to the property take College Road south from Wilmington and turn right (west) onto Sanders Road. Continue west on Sanders and the road will dead end at the intersection of River Road. Tom left onto River Road and Elliot's Place will be located on the right approximately one mile from the intersection of Sanders and River Road. Turn into Elliot's Place (River Vista Drive) and the subject property will be located at the end of the road adjacent to Lot 5. The subject property, referred to as Lot 5, is part of Elliot's Place subdivision (S/D) and is currently undeveloped, however, the majority of individual lots within Elliot's Place S/D contain residential dwellings. The entire tract (Elliot's Place S/D), including the small, detached island recorded on the deed, is approximately 10.6 acres. Elevation at the site ranges from 5' to 9' above Normal.High Water (NHW). Lot 5, which is included as part of Elliot's Place, Home Owners Association (HOA), contains a community easement that is deeded to the HOA. The applicant has supplied a written agreement (letter of no objection) from the owner of Lot 5 approving the plans to construct a walkway, pier and dock along the 30' access easement. High ground vegetation at the site consists of Live Oaks, Magnolias, Pines, Maples and Red Cedars. Understory vegetation consists of Red Cedars, Wax Myrtles and Yaupons. Vegetation on the island consists of Live Oaks, some Pines, Red Cedars and Wax Myrtles. The island is separated from the remaining high ground and is surround by a variety of coastal wetland species including: Smooth Cordgrass (Spartina altenti/lora) and Black Needle Rush (Juncus roemarianus). High marsh coastal wetland species include; Spike Grass (Distichlis spicata), Black Needle Rush (Juncus roentarianus), and Salt Meadow Grass (Spanina patens) complete the transitional zone to the high ground. There is Sea Oxeye (Borrichia frutescens), and Grounsel-bush (Bacchants halimifolia) intermixed in the high marsh vegetation. The applicant obtained a CAMA general permit (GP# 36941) on 6/17/2004 for the construction of a walkway (6' x 138'), pier (6' x 463'), t-head platform (6' x 56') and two (2) boatlifts (14' x 14'). The walkway, pier, platfrom and boatlifts have been constructed and the applicant is currently applying under the CAMA Major Permit process for the addition of four (4) finger piers and seven (7) boatlifts. The Wilmington -New Hanover County Land Use Plan classifies the area as Conservation. The waters of the Cape Fear River are classified SC, by the Division of Water Quality. The area is designated as a Primary Nursery Area (PNA), by the Division of Marine Fisheries and is CLOSESD to the taking of shellfish. PROPOSED PROJECT: The applicant is proposing to add four (4) finger piers (6' x 25'), two (2) located on the northern side and two (2) located on the southern side of the existing pier, near the terminal end. Additionally, the applicant is proposing the installation of seven (7) additional boatlifts (all 14' x 14'), bringing the total number of potential boat slips to nine (9). Water depths in the areas surrounding the proposed boatlifts and finger piers would average approximately 2.0 to 2.6' of water at Normal Low Water (NLW). ANTICIPATED IMPACTS: The construction of the proposed finger piers and boatlifts would incorporate approximately 1,972 sq. ft. of estuarine waters and public trust area. Any permit issued should include the following conditions: 1. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the established pierhead line. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 5. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 6. This permit does not authorize the interference with any existing or proposed Federal project, and, the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit.
