VAN DER VAART Secmlary TRACY DAVIS Dlreclar Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that any updated pages or addendums to this permit will now reference DEMLR as the Division responsible for issuance of the permit. The Wilmington Regional Office received a complete 8 year Stormwater Management Permit Renewal Application for Carolina Eye Associates on November 12, 2015. The Division is hereby notifying you that permit SW8 010314 has been renewed on December 8, 2015, and shall be effective until August 10, 2023. The renewal and reissuance of this stormwater permit does not imply that the site is currently in compliance with the terms and conditions of this state stormwater permit. The plans previously approved on August 10, 2001 will remain in full force and effect in accordance with the regulations set forth in Title 15A NCAC 2H.1000 effective September 1, 1995, Please attach this cover letter and permit addendum to your High Density Permit issued on August 1, 2001. This permit is subject to the conditions and limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, procedures for changes of ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions, to transfer the permit, or to renew the permit, will result in future compliance problems. . If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. I do not think this shows that she can sign for the company. Number one this document is 13 years old. Number two, there is nothing here that says she has legal authority to sign for the company. I think the best thing to do is to have the registered agent listed on the secretary of state sign the second page of the renewal document and send that to me. I can than proceed with the renewal. Sorry; but this has to meet our rules. Since we received the original application on August 6, 2015 Carolina Eye Associates are not out of compliance because you got the package in here before the 10`h. We accepted the package and check. So all 1 need is the correct signature, which according to the SoS is .lames R Van Camp. All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this letter (permit) references DEMLR as the Division responsible for issuance of the permit. On July 17, 2015 the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) conducted a file review of Coastal Stormwater Management Permit # SW8 010314 issued to Carolina Eye Associates for a High Density - infiltration basin project on August 10, 2001. A renewal was sent to you on June 23, 2010 which notified you that your permit was set to expire on August 10, 2011. On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010. The law extended the effective period of any stormwater permit that was set to expire during this time frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for a total of four (4) years extension. Accordingly, this permit's expiration date was adjusted to include this four year extension. This permit's new expiration date is now August 10, 2015. Per 15A NCAC 2H.1003(h) (the stormwater rules), applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. If this is still an active project please complete and submit the enclosed renewal application immediately and before August 10, 2015 or you will be out of compliance with your permit and the stormwater rules.
