10/70 Allocation Transfer Request
The purpose of this letter is to inform you that the Division of Energy, Mineral, and Land Resources
(DEMLR) has reviewed and approved the joint resolution between Moore County and the Town of
Aberdeen to transfer rights for 10/70 land area in the Drowning Creek water supply protection watershed.
The resolution involved the acceptance by the Town of Aberdeen of 300 acres within their jurisdiction
with 30 acres of allocation available for 10/70 development in the Drowning Creek watershed. DEMLR
approved the resolution and transfer in accordance with North Carolina General Statute 143-214.5 and
North Carolina Administrative Code 15A NCAC 2B .0100, .0200, .0623, and .0624.
Please be advised that the Environmental Management Commission issued a decision at their July 12,
2007 meeting to delegate approvals under the Water Supply Watershed Protection Rules, Phase II
Stormwater Program, and Universal Stormwater Management Program to the Division of Water Quality
(DWQ). On August 1, 2013, the delegation was transferred from DWQ to DEMLR. In some instances,
the Division may choose to forward an ordinance or other matter to the Water Quality Committee (WQC)
for review. In addition, a local government may request in writing to have the WQC make the approval
decision, or they may request that the WQC reconsider a decision made by the Division.
