Environmental Quality April 6, 2023 Subject: Town of Siler City Chatham County 10/70 Allocation Transfer Request The purpose of this letter is to inform you that the Division of Energy, Mineral, and Land Resources (DEMLR) has reviewed and approved the joint resolution between Chatham County and the Town of Siler City to transfer rights for 10/70 land area in the Rocky River water supply protection watershed. The resolution involved the acceptance by the Town of Siler City of 874 acres of unused allocation in the Rocky River watershed. DEMLR approved the resolution and transfer in accordance with North Carolina General Statute 143-214.5 and North Carolina Administrative Code 15A NCAC 2B .0100, .0200, .0623, and .0624. Please be advised that the Environmental Management Commission issued a decision at their July 12, 2007 meeting to delegate approvals under the Water Supply Watershed Protection Rules, Phase II Stormwater Program, and Universal Stormwater Management Program to the Division of Water Quality (DWQ). On. August 1, 2013, the delegation was transferred from DWQ to DEMLR. In some instances, the Division may choose to forward an ordinance or other matter to the Water Quality Committee (WQC) for review. In addition, a local government may request in writing to have the WQC make the approval decision, or they may request that the WQC reconsider a decision made by the Division.
