Aqua North Carolina, Inc. (Aqua) offers the following response to the above -referenced Notice of Violation
and Intent to Assess Civil Penalty, which was issued for Coliform, Fecal MF, NEC Broth, daily maximum
exceeded on February 15`s 2023, BOD 5-Day (20 Deg. C) Concentration, Coliform, Fecal MF, MFC Broth,
Nitrogen, Ammonia Total (as N), Solids, Total Suspended Concentration, of frequency Violation on
February 4te 2023, Down Stream Oxygen, Dissolved (DO) of sampling location missing on February 281
2023, found in February 2023 Discharge Monitoring Report.
Auua's Response:
Monitoring Violations — BOD, Coliform Fecal, Total Nitrogen, Total Suspended Solids and
Downstream DO. All samples were collected and analyzed as required. The electronic transfer of the
lab data failed and samples that were pulled on 1/31/2023 failed to upload into the January 2023 DMR.
A revised DMR was submitted on 4/13/2023 (a copy is attached to this response). Sample results are
reported for the BOD, Total Nitrogen ,TSS and Fecal Coliform and covers the requirement for these
weekly samples. The Downstream DO reports for February also failed to upload into the DMR. A
revised DMR for February 2023 was submitted on 4/14/2023 (copy attached) and includes all required
Downstream sample results for February 2023.
Limit Exceedance Violation — Coliform, Fecal — on 2 /15/2023 Aqua exceeded the daily maximum
allowed for Fecal coliform with a result of 2,400. The ultraviolet bulbs and sleeves at Briarwood Farms
were last changed on 6/30/2022 and are well within their life expectancy range. On 2/14/2023 the UV
sleeves and bank were cleaned. On 2/15/2023 plant flow was normal, and the effluent was clear. All
other fecal samples for the month were within compliance parameters. No apparent reason for this
unusually high result was found during this investigation.

2/8/23 nitrogen flagged J/ BOD flagged + On 2/15/2023 we exceeded our daily limit for Fecal. The UV bulbs and sleeves were last changed on 6/30/2022 and are well within
their life expectancy range. On 2/14/23 the UV sleeves and bank wem cleaned. On 2/15/2023 plant flow was normal and the effluent was clear. All other fecal samples for the
month were within compliance parameters. No apparent reason for this unusually high result was found during this investigation.
