Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 980820 dated May 16, 2000, for the construction of The Thistle Golf Club. This permit shall be effective from the date of issuance until May 16, 2010, and shall be subiect to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance ofthe stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina Oreneral Statutes, D-id filed with the Office of Administrative Hearings, P.O. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this permit, the Project Data Sheet. The stormwater controls, Pond 1 and Pond 2, have been designed to handle the runoff from 1,194,415 ft and 4,468,843 ft respectively, of impervious area. 3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 4. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans. 5. The golf course is proposing roads, cartpaths, streets, and 1208 multi -family units, limited to 1,500 square feet per unit. 6. All runoff from the impervious areas of the site will be treated in a non -discharging wet pond system. 7. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. Decorative spray fountains will not be allowed in the stormwater treatment system. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision, acquisition, or sale of the prof ect area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control PI i approval was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The Director may determine that other revisions to the project should require a modification to the permit. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 4 State Stormwater Management Systems Permit No. SW8 980820 12. Prior to the sale of any portion of the property, an access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion of the property. 13. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. 14. The runoff from all built -upon area on the project must be directed into the permitted stormwater control system. 15. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 16. The permittee shall notify the Division of any mailing address changes within 30 days. III. GENERAL CONDITIONS This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants. DENR Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. DEED RESTRICTIONS AND PROTECTIVE COVENANTS The following italicized deed restrictions and protective covenants are required to be recorded for all subdivisions, outparcels and future development prior to the sale of any lot. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings. 4. Built -upon area in excess of the permitted amount requires a state stormwater management permit mod cation prior to construction. 5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity and performance of the system as permitted. If there are two different drainage areas, you must provide two separate supplements, one for each pond system. As previously requested, if there are pipes that connect the two systems and allow them to act as one, please show and label them on the plans. Currently, I can see no pipes between the pond systems that will allow them to act as one. Response: The two pond systems are not connected. Two separate Wet Detention Basin Supplements have been submitted for your review. Also included with this submittal is Table 4 which provides details for the 14 individual ponds. Eight ponds are interconnected in Phase I system and six ponds are interconnected in Phase II. Pond "C" has an outfall weir at 45.82 ft MSL to control water levels in the Phase I pond system. Pond "Z" has an outfall weir at 47.59 ft MSL to control water levels in the Phase II pond system. Ponds "D", "E", "V and "V" have weirs to control the interconnected upstream pond levels. The upstream weirs are set at an elevation to provide the required storage depth above the permanent pool elevation. The Supplements include the outfall weir elevations for the pond systems. 2. Please provide the bottom elevation on the supplement. Response: The ponds were excavated to a minimum depth of 6.0 ft below the permanent water level to prevent the growth of vegetation on the pond bottom. Ponds excavated that contained quality material (sand) were excavated to depths exceeding 8.0 ft. Table 4 provides the minimum bottom elevations for each pond. 3. Sediment accumulation in the ponds must be dealt with. As the construction continues, the ponds may fill with sediment to the point that the required volume can no longer be contained. Please specify cleanout elevations for the pond on the supplement. Response: Most of the 14 ponds will have a different sediment removal elevations. Table 4 lists the sediment removal elevation for each pond. Using 2.2' above permanent pool to prove that the required storage is provided is worthless if the weirs are set at the lower 25-year storm elevations of 1.32' and 2.09' above permanent pool. The calculations need to provide the areas at those elevations to support the alternative design criteria. Please revise the supplements and calculations to support each other. Response: Pond system No. 1 has a permanent surface area of 1,393,570 f12 and a temporary 25-Year surface area of 1,431,460 ft2. Pond system No. 2 has a permanent surface area of 742,559 ft2 and a temporary 25-Year surface area of 765,120 ft2. The 2.2-ft was an arbitrary maximum elevation used in computations. The ponds have a maximum side slope of 3:1 with surface areas and volumes calculated using this assumption. The actual depths of 1.32 ft and 2.09 ft were interpolated between the calculated depths to determine surface area and storage volumes. 5. The lone supplement submitted, which indicated that it is for DA-1, shows a temporary pool elevation at 1.6' above permanent pool. Should this elevation be 1.2', 1.32', or 2.2'? The narrative indicates that the elevation for DA-1 pond system should be 1.32'. Response: The revised supplements include a temporary pool elevation 1.32 feet above the permanent pool for ponds in the Phase 1 pond system. The ponds in the Phase II pond system have a temporary pool elevation 2.09 feet above the permanent pool elevation. It must be noted that the interconnected pond permanent pool elevations increase moving upstream in the system. The upstream weirs are set at an elevation to provide the required 25-Year storm storage. The plan sheets and Table 4 include the weir elevations for the outfall weirs and for the interconnected pond weirs. 6. Please indicate how you arrived at the required runoff volumes for each phase. Did you use the Rational runoff method, or Schuler's Method? Please show the numbers and assumptions. Response: The Rational Method was used to calculate the volume of runoff from the pervious and impervious areas. Detailed calculations sheets are included with this submittal. These permit numbers respectively are SW8 970135 and SW8 980820. The purpose of the submittal is to complete a Master Stormwater Plan and consolidate the aforementioned permits into a new single permit. Existing and proposed built -upon areas will be recognized to calculate an.overall low density project.. The property comprises a total of 401.26 acres, 38.85 acres of reserved wetland preservation has been removed from the total for runoff calculations. The total built -out area is 61.41 acres and the total grass area is 301.27 acres. A summary of impervious area calculations is provided in Table 1. The Golf Club property has a total impervious percentage of 16.87%. The Golf Course layout may be reviewed in Exhibit 1. The proposed stormwater runoff treatment will be non -discharging retention ponds. The ponds will hold the 8.0 inches of the 25-Year storm. Stormwater will be released from the system only above the initial 8.0 inches of rainfall. This stormwater will be used to irrigate the golf course and will dissipate by infiltration and evaporation. There are seven interconnected ponds in Phase I and six interconnected ponds in Phase II. The storage volume for each pond is listed in Table 2. The attached graphs extrapolates the storage volume to 2.2 ft above normal pool level. Runoff volume was calculated using the Rational Method with results in Table 3. The pond surface areas were digitized from the contour map in Exhibit 2. Pond side slopes were set at 3:1. The runoff volume from 8.0 inches of rainfall was calculated to be 1,870,000 cubic feet for Phase I and 1,570,000 for Phase H. Water levels in the ponds of Phase I reached 1.32 feet above normal pool level to store the 25-Year storm runoff. Water levels for ponds in Phase II increase 2.09 feet above normal pool level. Batter boards at the outfall weir of Phase I will be set 1.32 ft above the existing normal pool elevation of 44.5 ft NGVD. The batter boards at the outfall weir for Phase II will be set 2.09 ft above the normal pool elevation of 45.5 ft NGVD. As previously requested, please provide site plans for the existing Phase I Clubhouse and Maintenance areas. These areas must be reviewed to make sure the grading is appropriate and to verify built -upon area. The plans must include all required elements, as outlined in the rules, including built -upon areas, drainage areas, details, dimensions, grading, etc. This item is not to be considered superfluous to the application. Please remember that Phases I and II were approved for roads only, so none of the impervious construction on this project, other than the roads, is permitted. The proj ect is currently in violation of NCGS 143-215.1. Because you have demonstrated a willingness to cooperate, this Office has not pursued enforcement action, however, that can change. If the DWQ decides to pursue enforcement, all building permits and CO's will be withheld. These plans are required in order to obtain this permit. 2. Based on the maps provided, there are two separate pond systems, one each for Phase I and Phase H. Please provide a completed supplement for each system, or show on the plans the hydraulic connection between the two which allows them to act as one. If there are indeed two separate drainage systems, please complete three columns of the application, one for each system, and one demonstrating the overall low density of the project. The supplement also serves as the Operation and Maintenance plan, so it needs to provided. 3. Due to their clustered location on the north side of the site, the wetlands must be removed from the site area reported on the application in order to avoid creating a pocket of high density. For the orifice, please indicate that an overflow weir is provided, and report the temporary storage elevation as the weir overflow elevation. The temporary storage volume would be the total volume above permanent pool that the system can store without discharging, ie., @6" above permanent pool. The design storm would be the 25 year storm, or 8". A permit cannot be issued if the supplement is not provided. Again, this project is in violation, so you really need to get this information submitted in order to obtain the necessary permit. 5. The roads, in Phase I and Phase II were approved with side ditches, not with curb and gutter, as suggested in Ms. Gray's letter of December 17,1999. According to the road details provided on the approved plans on file, none of the roads were proposed with curb and gutter, so no treatment was required, therefore, no treatment system (including the pond system) was permitted. The concept of the non -discharging pond system was acceptable, but was not permitted at that time. 6. I have enclosed the original page 4 for initialing. Copies are not acceptable. Please return the revised original, or provide a new original. 7. The pond design calculations must be based on the proposed total build -out of 61.14 acres, not the current 16.87 acres. If the Division has a maximum amount of built -upon area to begin with, permitting and tracking of future projects becomes faster and easier. We simply subtract the proposed BUA for the individual project from the overall permitted. 8. As far as stormwater treatment is concerned, there are few guidelines for this type of system, but, if it is proposed as a non -discharging, you need to demonstrate that the 25 year storm can be caught and contained in the pond system. Please provide the surface area for each pond at 6" above the permanent pool, and calculate the storage provided at 6". The pond information currently submitted only goes up to 0.2' above permanent pool, but the narrative indicates that storage up to 6" is provided. I cannot verify the claim that sufficient storage for the 25 year storm exists without the data to back it up. Simply saying you have it is not good enough. Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to February 26, 2000, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. It seemed that I needed to expand the stormwater narrative to help understand the project design concept. Please provide site plans for the existing Clubhouse and Maintenance areas. The plans should include all required elements as listed in the rules, including dimension, grading, drainage, details, a supplement form for the wet pond or other engineered control that will treat the runoff, and calculations which cover the required and provided surface areas, depth, elevations, volumes, etc. The clubhouse and maintenance facilities are shown to drain to one of the 32 acres of golf course ponds. The calculations show that 0.13' (2") of storage above the normal pool will provide the required storage of stormwater run-off. Since the weirs are actually 6" above the normal pool this is ample storage. This system provides equal or better stormwater control, provides 85% tss at a minimum and the pre and post development discharge rates are managed. The site plan provided conforms to what was approved through Brunswick County's review boards. I would expect if market demands change the development concept will change. In either case restrictive covenants will dictate the built -upon limits. 3. The typical road section detail incorrectly shows each lane width as 10', including the curb and gutter. I believe the dimension arrow needs to be relocated to exclude the 2' curb and gutter section. You are correct and the puns have been modified. 4. Does the site area reported include the wetlands? Yes the project site area includes 38.85 acres of wetlands. If you subtract this the revised impervious coverage equates to 5.8% overall. 5. Locate each pond in a recorded access/drainage easement. Each pond will be located in a drainage easement. 6. Please initial page 4 of 4 of the application. This has been done and the page is attached. 7. Since the roads are curb and gutter, you will need to provide 100' long, 5:1 side slope curb outlet swales at regular intervals along the roads, for those portions of the road not collected and treated in an engineered facility. The purpose of this submittal is to complete a Master Stormwater Plan and consolidate the aforementioned permits into a new single permit. Existing and proposed built -upon areas will be recognized to calculate an overall low density project. This immediate request is for the cart paths to serve a 27-hole golf course, course restrooms to serve a 27-hole golf course, golf pro -shop / cart storage and parking, the maintenance facility and some ancillary structures. This project portion is a low density concept with enhanced treatment via golf course pond storage. Please refer to the water quality storage calculations. These calculations actually take into account the entire design concept, not just the impervious amounts for the features listed above. Consequently the proposed build -out of the development with a built -upon of 16.87 acres is effectively treated in the 32 acres of golf course ponds. It is shown that these collective golf course ponds provide equal or better stormwater control, provide a minimum 85% tss and discharge rates for pre and post development conditions are managed. The depth of required storage for project build -out is 0.13 feet above normal pool. Sheet 2 of 2 illustrates that we have an average of 0.5 feet based on weir elevations. By and large the water never leaves the site. This satisfies an innovative system meeting or exceeding the alternative design criteria. The applications show total development, but since no specific design was shown, Greg chose to permit the roads only and require all future development to submit an application. We can redo the two permits into a single Master Plan. The application provide all future BUA, including lots, roads recreation.facilites, clubhouse, cartpaths, etc. , the number of lots for each future area must be specified, the BUA per lot must be assigned, and the way each future area will be treated must be decided, ie., low density or an engineered system. This method will require that final development plans be submitted. Separate applications for each future area must be submitted only if they differ from what was approved under the Master Plan. We can also continue as two permits, and make modifications as each future area develops. This will require that the permit application submitted include all development permitted to date.
