The womington Regional Office received a complete Stormwater Management Permit Application for Marine
Vdarchousc on August 15, 2000. Staff review of the plans and specifications has determined that the project. as
proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 21-1.1000. We are forwarding
Permit No. SW8 980708M0D dated November 21, 2000, for the construction of Marine Warehouse.
This permit shall be effective from the date of issuance until November 21, 2010, and shall be subject to the
conditions and limitations as specified therein. ]'lease pay special attention to the Operation and Maintenance
requirements in this permit. Pailureto establish an adequate system foroperation and maintenance of the stormwater
management system will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
ad judicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must
be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed
with the Office of Administrative Hearings; P.O. Drawer 27447, Raleigh, NC 2761 1-7447. Unless such demands
are made this permit shall be final and binding.

LDESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the
application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described on page
3 of this permit, the Project Data Sheet. The stormwater control has been designed to handle the runoff from
73,191 square feet of impervious area.
3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts
of the permit.
4. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per
approved plans.

11. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in it's entirety, vegetated and operational for its
intended use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired
immediately.
The permitter shall at all times provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must
he followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited
to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
C. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon request to authorized personnel
of DWQ. The records will indicate the date, activity, name of person performing the work and what actions
were taken.
5. Decorative spray fountains will not be allowed in the stormwater treatment system.
6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless
the facilities are constructed in accordance with the conditions of this permit, the approved plans and
specifications, and other supporting data.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of
this permitted facility, a certification must be received from an appropriate designer for the system installed
certifying that the permitted facility has been installed in accordance with this permit, the approved plans
and specifications, and other supporting documentation. Any deviations from the approved plans and
specifications must be noted on the Certification.
8. 1 fthe stormwater system was used as an Erosion Control device, it must be restored to design condition prior
to operation as a stormwater treatment device, and prior to occupancy of the facility.

10. The Director may determine that other revisions to the project should require a modification to the permit.
IL . A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum
often years from the date of the completion of construction.

12. Prior to the sale of any portion of the property, an access/maintenance casement to the stormwater facilities
shall be granted in favor of the permitter if access to the stormwater facilities will be restricted by the sale
of any portion of the property.
13. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable
built -upon area.
14. The runoff from all built -upon area on the project must be directed into the permitted stormwater control
system.
15. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements ofthe permit. Within the time frame specified in the notice, the permittee shall submit a written
time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall
provide copies ofrevised plans and certification in writing to the Director that the changes have been made.
16. The permittee shall notify the Division of any mailing address changes within 30 days.
Ill. GENERAL CONDITIONS
']'his permit is not transferable. In the event there is a desire for the facilities to change ownership, or there
is a name change of the Permittee, a formal permit request must be submitted to the Division of Water
Quality accompanied by an application fee, documentation from the parties involved, and other supporting
materials as may be appropriate. The approval of this request will be considered on its merits and may or
may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute
143-215.6A to 143-215.6C.
3. 'rhe issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal)
which havejurisdiction.
4. hi the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action, including those as may be required by this Division,
such as the construction of additional or replacement stormwater management systems.
5. "rhe permittee grants DENR Staff permission to enter the property for the purpose of inspecting all
components of the permitted stormwater management facility.
6. "rhe permit may be modified, revoked and reissued or terminated for cause. "rhe filing of.a request for a
permit modification, revocation and reissuance or termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the
guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual.

1. The top elevation of the berm between the forebay and the permanent pool has been
increased to elevation 45.00. The spillway between the pond and forebay has been
moved to the side away from the pond outlet. This will provide a longer flow path for the
water from the culvert outlet into the pond to the pond outlet structure.
2. The forebay has been resized. The forebay volume is now 2,064 cf.
3. The volume calculations for the pond have been revised. The rim elevation of the outlet
box has been raised 0.05 feet. The rim elevation of the outlet box is now elevation
45.00 instead of elevation 44.95. The detail for the outlet structure has been revised.

Dear Ms. Horton:
The Wilmington Regional Office received a Stormwater Management Permit Application for
Marine Warehouse Center on June 14, 2000. A preliminary review of that information has determined that
the application is not complete. The following information is needed to continue the stormwater review:
Please provide in the design of the pond the required 3:1, L: W ratio. Due to probable site
constraints, the use of baffles could be recommended.
The forebay should be designed to have approximately 20% of the entire permanent pool
volume, as submitted the forebay is only 15%.
By my calculations the required storage volume of the pond is not being met. As required
for the amount of impervious coverage 5,852 cubic feet of storage volume is required. Only
5,596 cubic feet of volume is being provided by my calculations, and only 5,563 cubic feet
of volume is being provided by Mr. Hargrove's calculations. An error was found in the
amount of storage volume between elevations 44.80 and 44.95. The average of the surface
areas (6255.5sq.ft.) between these two elevations was not multiplied by the difference of the
two elevations (.15), but by 0.20 as in the previous calculations. Therefore the difference in
storage volume is 938cf and not the given 1,251 cf. Please verify and provide more volume
if necessary.

requested information should be received by this Office prior to August 25, 2000, or the application will be
returned as incomplete. The return of a project will necessitate resubmittal of all required items, including
the application fee.
If you need additional time to submit the information, please mail or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The request must
indicate the date by which you expect to submit the required information. The Division is allowed 90
days from the receipt of a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action
pursuant to NCGS 143-215.6A.
Please reference the State assigned project number on all correspondence. Any original documents
that need to be revised have been sent to the engineer or agent. All original documents must be returned or
new originals must be provided. Copies are not acceptable. If you have any questions concerning this

As authorized by the New Hanover County Erosion and Sedimentation Control Ordinance
This permit issued to Nancy S. Horton authorizes the development of 1.9 acres of land at Market Street for the
Marine Warehouse in New Hanover County. This permit issued on August 4, 1998 is subject to compliance with the
application and site drawings, all applicable regulations and special conditions and notes set forth below. Any plan modifications must
be approved by this office prior to field changes.
It is understood by the applicant that a representative of New Hanover County's Engineering Department may inspect the site
at any time following the issuance of this Permit. A copy of the approved Soil Erosion Plan and this permit must be available at all times
at the site.
Failure to execute the provisions of this permit and the approved Soil Erosion Plan, or any other provisions of the New Hanover
County Soil Erosion and Sedimentation Control Ordinance, shall result in immediate legal action by the County to the limits prescribed
by the Ordinance. If the measures outlined on the approved Soil Erosion Plan and this; Permit prove insufficient, additional Erosion
Control measures can and will be required which in turn will be considered provisions of this Permit. This Permit does not preclude
any other permits or approvals necessary for beginning or completing this development. It is the Permittee's responsibility to obtain
all necessary permits and approvals.
SPECIAL CONDITIONS
(THESE CONDITIONS MUST BE FOLLOWED IN ADDITION TO THE PLANS AND SPECIFICATIONS)
*All the soil erosion control measures will be installed as the site is cleared and maintained throughout construction. These
include the 3 construction entrances, silt fences, inlet protection, a rock check dam and immediate construction and
stabilization of the detention pond, its slopes and the outlet structure. This permit includes clearing of the south ditch. **If
any area other than the driveway and associated piping is disturbed at Market Street, additional erosion control measures
may be required and the plan revised.
*No sediment shall leave the site. *All County and State drainage requirements will be adhered to.
*This permit does not preclude any permits or approvals which may be necessary such as DEM Water Quality, C.A.M.A.,
the Corps of Engineers, DEM Solid Waste, EPA or any other agencies.
*If plan revisions are necessary you must submit a copy to this office for approval prior to any field changes.
*If soil is removed from the site, it must be taken to an approved or permitted site to be identified to this offices to
removal from the site.
*If these measures fail to adequately control erosion, more restrictive measures will be required.
*If any phase of grading ceases for more than 30 working days, the site will be temporarily stabilized.
*All slopes will be stabilized within 15 days of cease of any activity.
*The developer is responsible for obtaining any and all permits and approvals necessary for the development of this project
prior to the commencement of this land disturbing activity. This could include agencies such as the Division of Water
Quality's stormwater regulations, their enforcement requirements within Section 401 of the Clean Water Act, the U.S. Army
Corps of Engineers' jurisdiction of Section 404 of the Clean Water Act, the Division of Coastal Management's CAMA
requirements, the Division of Solid Waste Management's landfill regulations, the State's Division of Land Quality's Mining
Regulations, local County or Municipalities' ordinances, or others that may be required. This approval cannot supersede
any other permit or approval; however, in the case of a Cease and Desist Order from the Corp of Engineers, that Order
would only apply to wetland areas. All highland would still have to be in compliance with the N.C. Sedimentation Pollution
Control Act.

*If any area on site falls within the jurisdiction of Section 401 or 404 of the Clean Water Act, the developer is responsible
for compliance with the requirements of the Division of Water Quality or the Corps of Engineers respectively. Any erosion
control measures that fall within jurisdictional wetland area must be approved by the aforementioned agencies prior to
installation and the County's Land Quality Section must be notified of a relocation of the measures in question to the
transition point between the wetlands and the highlands to assure that the migration of sediment will not occur. If that
relocation presents a problem or contradicts any requirements of either agency, it is the responsibility of the developer to
inform the County's Land Quality Section regional office so that an adequate contingency plan can be made to assure
sufficient erosion control remains on site. Failure to do so will be considered a violation of this approval.
*Approval of the erosion control plan is conditional on the applicant's compliance with Federal and State Water Quality
laws, regulations and rules.
* Revision 41 includes pond outlet changes approved 6/15/99.
* Revision #2 includes a revision to the rear warehouse with additional silt fence approved 4/3/00.
* Revision #3 includes .59 additional acres with silt fence inlet protection and 1 sediment trap 6' x 5' x 3' with a wash
stone and rock filter. An additional filter may be required adjacent to the new bypass pipe if the area above the
pipe is disturbed.
This Permit will expire one year from date of issue
if no construction activity begin on site. This permit
may not be amended or transferred to another party
without approval of this office.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all

1. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
as issued by the Division of water Quality. These covenants may not be
changed or deleted without the consent of the State.
2. No more than square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
flecking or the water surface of swimming pools.
3. Swales shall riot be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted storm water control
system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity
and perlbrmance of the system as permitted.

On April 24, 2000, the Wilmington Regional Office was notified that you had applied for a Sedimentation
Erosion Control Plan for the site revisions at Marine Warehouse. The North Carolina Administrative Code requires any
project that must receive either Sedimentation and Erosion Control Plan approval and/or a CAMA Major permit to apply
for and receive a Stormwater Management Permit by the Division of Water Quality. Any construction on the subject
site, prior to receipt of the required permit, will constitute a violation of 15A NCAC 2H.1000 and may result in
appropriate enforcement action by this Office.
On October 6, 1999, a modification to the permit was received and additional information was requested on
November 23, 1999.No response to that request has been received, and the revisions shown on the SEC plan are different
from what was submitted on October 6.
Either a Stormwater Permit Application Package including 2 sets of plans, completed application form, fee,
and supporting documentation, or a written response regarding the status of this project and the expected submittal date
must be received in this Office no later than May 26, 2000. Failure to respond to this request may result in the initiation
of enforcement action, and construction may experience a subsequent delay.
The NPDES 010000 Federal Stormwater Permit that accompanies the Erosion Control Plan approval letter must
NOT be considered the Coastal Stormwater Management Permit, which will be signed by the Water Quality Supervisor.

Per your letter dated September 9, 1999 1 have enclosed two (2) copies of the revised plans
which show the site changes. The main retail sales building is the only building that has
currently been constructed along with parking and some on -site storage. The owner has
decided to scale down the size of the storage buildings and make a cul-de-sac at the end of
the gravel access road for vehicles to turn around. Please note that the total impervious area
has not changed, but it has been reallocated to different uses. There are only 12,800 sf of
buildings and 31,201 sf of on -site parking and storage proposed on the site. Before there
were 17,200 sf of buildings and 26,801 sf of on -site parking and storage proposed. The
pond shape was modified slightly and calculations are provided showing the pond is of
sufficient size. If a revised permit application is required please let me know.
