Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Summary of Changes in Renewal Permit from Existing Permit 1) Total manganese monthly average and daily limits were added. 2) Acetone and cis-1,2 dichloroethylene quarterly monitoring were added. 3) Total zinc and pH quarterly monitoring were added. 4) Narrative condition was added to bis (2-ethylhexyl)phthalate to require minimum detection limit of 1.0 tg/l. 5) Total nitrogen monitoring was removed. 6) Total iron monitoring was reduced to quarterly. 7) Chronic toxicity special condition narrative was updated to current narrative. 8) Narrative condition restricting an oily sheen in the discharge was added. 9) Supplemental page treatment system list was updated. 10)Stream classification was changed from C, NSW to WS-IV, NSW; to reflect 2009 stream reclassification. Also, the final permit was not issued until the cation filters system was installed providing the manganese removal needed to obtain compliance. Please note that your discharge is into a receiving stream that is listed as an impaired waterbody on the North Carolina 303(d) Impaired Waters List. Addressing impaired waters is a high priority with the Division, and instream data will continue to be evaluated. If there is noncompliance with permitted effluent limits and stream impairment can be attributed to your facility, then mitigative measures may be required. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made,this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. (1)EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS) Footnotes: 1. Sample should be skimmed from liquid surface in a quiescent zone, such as from liquid surface in a holding tank,if possible. 2. A minimum detection limit of 1.0µg/1 is required. 3. Chronic Toxicity (Ceriodaphnia), P/F at 90 %, January, April, July, and October, See Special Condition A.(2). Toxicity sample to be collected at same time as monitored pollutants samples. There shall be no discharge of floating solids or visible foam in other than trace amounts. There shall be no oily sheen in the discharge or in the receiving stream traceable to the discharge. A. (2) CHRONIC TOXICITY PERMIT LIMIT (QRTRLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 90%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised-February 1998) or subsequent versions. The tests will be performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple-concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised-February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised- February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed. (2)CHRONIC TOXICITY PERMIT LIMIT(QRTRLY)) Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-opened and modified to include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently then required by this permit, the results of such monitoring shall be included in the calculation and reporting of the data submitted on the DMR and all AT Forms submitted. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. The only viable option, other than discharge to surface water, is to discharge to the City of Durham. However, the City of Durham is unwilling to accept the remediated groundwater continuing to make this permitted discharge the most economical viable option. Groundwater data from 1996 to 2000 was used to establish the original owners, Southchem, Inc., 2000 GWR permits requirements, and included 32 effluent characteristics (see Table A). In addition to solvent contaminated groundwater, samples indicate contaminates from petroleum sources. Therefore, the conditions of the general permit for groundwater remediation systems were incorporated into the original permit.The discharge is to a zero flow stream. In 2001, the ownership changed to Brenntag Southeast, Inc. A major permit modification was issued in 2004 that reduced the monitored effluent characteristics to 18 parameters (see Table A). After reviewing the DMR data and petition request, the 2005 permit renewal reduced the effluent characteristics requirements to 16 (see Table A). As these permit amendments were implemented the permit limits and monitoring frequency were also amended. Fact Sheet NPDES NC0086827 Page 1 of 5 I The 2008- 2010 DMR data including the annual EPA Method 624/625 (Full suite)was reviewed. Pollutants of interest, solvents and chlorinated compounds, were reported as no detects indicating the treatment system was performing satisfactory. No changes to the 624/625 annual monitoring requirement is recommended. The Permittee has requested removal of bis (2-ethylhexyl) phthalate monitoring. The reported values are less than values but are not consistent repeated values. The newly required Water Supply water quality standard, 1.2 µg/1, and previous Human Health water quality standard, 2.2 µg/1, could not be reconciled against the reported data. In discussions with the Permittee, it was determined that the lab inconsistency was the primary cause. The lab has agreed to provide future values following a minimum detection limit of 1.0 µg/l. Monitoring will remain unchanged in this permit with a minimum detection requirement of 1.0µg/l. An RPA was performed for iron and manganese, and all organic parameters, using 2008 - 2010 DMR data and applying the applicable water supply standards. Since iron is an action level parameter, and all the toxicity tests were passed, monitoring was reduced to quarterly. The less than detects for the monitored organics by default yielded no justification to add limits. However, 8 of the reported manganese values were above its newly defined Water Supply water quality standard so a chronic limit will be added. To be consistent with EPA policy, both a monthly and daily limit of 200 µg/1 will be applied. Since this is a new limit as a result of the stream reclassification to WS-V in 2009, the Permittee consultant was contacted about the new manganese limits. The consultant responded that a new filter canister (disposable cation media) installation would be required to meet the new limits with a June 2011 completion date. Based on comments from CG&L, no A to C required, and the anticipated effective date on the renewed permit the Division foresee on compliance concerns. A review of the latest well data, influent to the treatment works, continue to show the existing monitored organic parameters as the pollutants of concern. No changes are recommended for the existing organic parameters monitoring. Two additional organic parameters, not previously monitored in the effluent, and in significant excess above water quality standards in the well data were noted, acetone and cis-1,2dichloroethlyene. However, acetone and cis-1,2 dichloroethylene should be easily reduced to below WQS by the current treatment process so quarterly monitoring will be added to the permit as validation. To be consistent with EPA policy, TSS will receive both a monthly and daily limit of 30 mg/1. Based on the current NSW Jordan Rules this facility is not required to monitor nutrients so Total Nitrogen monitoring will be removed. Oil and Grease monitoring will continue and a new narrative statement about oily sheen in the discharge will be added. Quarterly pH monitoring will be added to validate no issues. The receiving stream is impaired for zinc so quarterly zinc monitoring will be added. TOXICITY TESTING: Since 2005 the Permittee has conducted 19 chronic toxicity tests and had no failures. No changes are recommended. The narrative will be updated to the current version. For the manganese, prior to issuing the final permit I will send you a draft of the special condition text with a compliance date we will add to the permit. one thing to remember is to include time to obtain an Authorization to Construct from the DWQ Construction Grants and Loans section. I assume there is no additional waste streams being generated as the CG-8 resin will be replaced once spent. The bis (2-ethylhexyl) phthalate issue is ultimately going to be addressed by the lab ability to 1) provide viable data demonstrating no effluent exceedance of the limit or to 2) provide viable data demonstrating problems with measuring this parameter or to 3) provide viable data demonstrating effluent exceedance of the limit. In any case, we can not wait until the manganese treatment system is in place. Is there some concern about interaction from the treatment system? If there is an analytical problem then we need the lab to advise you on the cause and possible solution which in turn we will require formal documentation. If you have any questions let me know. GWR NPDES Permit - NC00868272nd reply website, we understand that Third Fork creek was reclassified to a water supply (Ws) stream (actual classification being WS-IV) on August 11, 2009. The classification of WS-iv applies to Third Fork Creek from its source to a point 2.0 miles upstream of N.c. Highway 54. Because of this reclassification a Surface Water Quality Standard of 200 micrograms per liter (pg/L) now applies for manganese for surface water in Third Fork Creek and its tributaries. The treated groundwater for the groundwater remediation system at the Brenntag Durham facility currently discharges to an unnamed tributary to Third Fork Creek; therefore, it appears that our new NPDES Permit will stipulate a discharge limit of 200 pg/L for manganese. Since activation of our groundwater remediation system in 2002, we have detected concentrations of manganese in our discharge at concentrations ranging from a high of around 3,000 pg/L to a low of <50 pg/L. The typical manganese concentration range that we have seen over the past 2 years has been <50 pg/L to 380 pg/L. Because the potential exists for our discharge to exceed the 200 pg/L limit for manganese that will be imposed in the new NPDES Permit, we will need to modify our current water treatment system to address manganese. we have engaged in discussions with one of our subcontractors regarding the type of equipment that would be best suited for removal of manganese from our effluent discharge. We supplied the subcontractor with a data summary table that lists the concentrations of manganese that have been detected in the effluent samples for the past several years. Based on our conversation with the subcontractor, they recommend using a strong acid cation resin called CG-8. Reportedly this type of resin is specifically designed to treat metals. To incorporate this technology we would add another vessel for the CG-8 resin after the two granular activated carbon (GAC) vessels. we are working with our subcontractor right now to determine how much resin we would need and how often it would need to be replaced. I anticipate having this data in the next week or so. we would like to have approximately a 3 month timeframe to purchase the new equipment, have it installed, and test it. so I think a realistic timeframe for having this additional equipment up and running is June 30. 2) Reporting limit and NPDES discharge limit for bis (2-ethylhexyl) phthalate As discussed above, it is understood that Third Fork creek and its headwater tributaries were reclassified to a water supply stream (WS-Iv) in 2009. Because of this reclassification a Surface Water Quality standard of 1.2 pg/L now applies for bis (2-ethylhexyl) phthalate. It is our understanding that our new NPDES Permit will stipulate a discharge limit of 1.2 pg/L for bis (2- ethylhexyl) phthalate. GWR NPDES Permit - N000868272nd reply to analyze for bis (2-ethylhexyl) phthalate since we first started effluent sampling in 2002 provides a reporting limit (RL) of 10 Ng/L; therefore, we will need to utilize a different analytical procedure for testing for bis (2-ethylhexyl) phthalate that will provide a RL of 1.0 pg/L. The analytical laboratory that we utilize on this project (Test America) has indicated that they can provide a consistent RL of 1.0 pg/L for bis (2-ethylhexyl) phthalate using Method 8270 Low Level (LL). Test America will use the full liter of water collected for the analysis, concentrate it to 0.5 milliliters and analyze that extract. This will provide a RL of 1 pg/L. The new NPDES Permit will need to stipulate use of EPA Method 8270 Low Level for analysis of bis (2-ethylhexyl) phthalate. Please note that because of the ubiquitous nature of bis (2-ethylhexyl) phthalate in all things made of plastic, there is a concern that detections of bis (2-ethylhexyl) phthalate could be associated with plastic piping associated with the groundwater extraction and treatment system. we would like to wait to implement this change in analytical procedures following completion of our installation and testing of the strong acid cation resin unit for treatment of manganese.
