REGAN Secretary TRACY DAVIS Director On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010. The law extended the effective period of any stormwater permit that was set to expire during this time frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for a total of four (4) years extension. The permit's original expiration date of July 20, 2009, was extended to July 20, 2013. The Wilmington Regional Office received a complete 8 year Stonnwater Management Permit Renewal Application for Technology Court Subdivision on January 17, 2017 with additional information received on May 8, 2017. The Division is hereby notifying you that permit SW8 961004 has been renewed on May 10, 2017, and shall be effective until July 20, 2021. For your records, please find enclosed a renewed, updated, and re -issued permit and a copy of the renewal application. Please keep this permit on file at all times. Please note that the renewed, updated, and re -issued permit does not impose new or different terms; it merely restates some of the previous terms to provide you with a better understanding of your obligations under the permit. The renewal and i eissuance of this stormwater permit does not imply that the site is currently in compliance with the terms and conditions of this state stormwater permit. The plans originally approved on November 14, 1996, will remain in full force and effect in accordance with the regulations set forth in Title 15A NCAC 2H.1000 effective September 1, 1995. All 26 of the lots have been assigned a maximum built -upon area limit under the pennit, which has been recorded in Deed Book 2139 at Page 0758 of the New Hanover County Register of Deeds. All lots are required to adhere to this maximum BUA limit, and to collect and direct their runoff into the piped runoff collection system in the street that will convey it to one of the permitted wet detention ponds as indicated in the permit. No runoff from any lot should be directed into any of the drainage ditches. As stated above, it is the permittee for permit no. SW8 961004 that is responsible for ensuring the BIJA on all lots is not exceeded. However, there are six lots that have acquired off -site permits for their lots. It is recommended that the Association meet with all the lot owners to encourage property owners to acquire off -site permits for their lots. Having off -site permits for each lot puts the responsibility for lot BUA compliance on the lot owner while leaving the responsibility for maintenance of the overall stormwater system to the Association. The requirement for obtaining an off -site permit could be added to permit SW8 961004 if the Association gets agreement by all lot owners. This not only helps maintain a balance in compliance costs now for all lot owners, but it will help in the future when lots are sold to new owners that may want to make changes on their individual lots. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). Technology Court Subdivision New Hanover County FOR THE construction, operation and maintenance of two (2) wet detention pond(s) in compliance with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and the approved stormwater management plans and specifications and other supporting data as attached and on file with and approved by the Division of Energy, Mineral & Land Resources (hereafter referred to the Division or DEMLR) and considered a part of this permit. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.7 of this permit. The subdivision is permitted for 26 lots, each allowed a specific built -upon area as follows: Lots 42-45, 59-64, 67- 69 @18,000 square feet; Lots 46, 58, 65, 66 @36,000 square feet; Lots 48, 49, 52, 53, 55, 56 @15,500 square feet; Lot 54 @24,500 square feet, and Lot 50/51 @43,002 (total) square feet of built -upon area. 3. The runoff from all built -upon area within the permitted drainage area(s) of this project must be directed into the permitted stormwater control system. 4. The tract will be limited to a maximum of 583,742 square feet of built -upon area. The wet pond(s) designated as North and South have been designed to treat the runoff from 347,782 and 235,960 square feet of Built -Upon Area, respectively. Classification of Water Body: ..C; Sw" II. SCHEDULE OF COMPLIANCE 1. No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature (such as swales) shown on the approved plans as part of the stormwater management system without submitting a revision to the permit and receiving approval from the Division. 2. The permittee is responsible for verifying that the proposed built -upon area for the entire lot does not exceed the maximum allowed by this permit. Once the lot transfer is complete, the built -upon area may not be revised without approval from the Division, and responsibility for meeting the built -upon area limit is transferred to the individual property owner. 3. If an Architectural Review Board or Committee is required to review plans for compliance with the BUA limit, the plans reviewed must include all proposed built -upon area. Any approvals given by the Board do not relieve the homeowner of the responsibility to maintain compliance with the permitted BUA limit. 4. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 5. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. Page 4 of 10 State Stormwater Management Systems Permit No. SW8 961004 The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further development, subdivision, acquisition, or sale of any, all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. g. The construction of permeable pavement for BUA credit. 7. The Director may determine that other revisions to the project should require a modification to the permit. 8. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 3. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 4. Permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 13. The permittee shall at all times provide the operation and maintenance necessary to assure that all components of the permitted stormwater system function at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal C. Mowing and re -vegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of structures, orifice, catch basins and piping. g. Access to all components of the system must be available at all times. Page 5 of 10 State Stormwater Management Systems Permit No. SW8 961004 14. Records of maintenance activities must be kept and made available upon request to authorized personnel of DEMLR. The records will indicate the date, activity, name of person performing the work and what actions were taken. 15. The facilities shall be constructed, operated and maintained in accordance with the provisions of this permit, the approved plans and specifications, and the supporting documents attached to this permit and on file with the Division. 16. Prior to the sale of any lot, the following deed restrictions must be recorded: a. "The maximum built -upon area for each lot is as follows: Lots 42-45, 59-64, 67-69 @18,000 square feet; Lots 46, 58, 65-66 @36,000 square feet; Lots 48, 49, 52, 53, 55, 56 @15,500 square feet, Lot 54 @24,500; and the combined Lot 50/51 @43,002 (total) square feet. This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, and coquina, but does not include raised, open wood decking, or the surface of swimming pools." b. "The covenants pertaining to stormwater regulations may not be changed or deleted without concurrence of the State." C. "Alteration of the drainage as shown on the approved plan may not take place without the concurrence of the State." d. "All runoff on the lot must drain into the permitted system. This may be accomplished through providing roof drain gutters which drain to the street, grading the lot to drain toward the street, or grading perimeter swales and directing them into the pond or street. Lots that naturally drain into the system are not required to provide these measures." 17. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of recording the plat, and prior to selling lots. The recorded copy must contain all of the statements above, the signature of the Permittee, the deed book number and page, and the stamp/signature of the Register of Deeds. 18. Prior to transfer of the permit, the stormwater facilities will be inspected by DEMLR personnel. The facility must be in compliance with all permit conditions. Any items not in compliance must be repaired or replaced to design condition prior to the transfer. Records of maintenance activities performed to date will be required. 19. If the use of permeable pavement for BUA credit within the lot is desired, the permittee shall direct the lot owner to submit an application with all supporting documentation and the application fee to the Division and receive a permit prior to construction of the permeable pavement. 20. Decorative spray fountains will be allowed in the stormwater treatment system, subject to the following criteria: a. The fountain must draw its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. c. The falling water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for the fountain's pump is based on the permanent pool volume. The maximum pump power for a fountain in the North Pond is 1/3 hp and for the South pond is 1/6 hp. Page 6 of 10 State Stormwater Management Systems Permit No. SW8 961004 III. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed a rie Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy; d. Foreclosure, subject to the requirements of Session Law 2013-121; e. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2- 01(e) and NCGS 57D-6-07; f. A name change of the current permittee; gg A name change of the project; h. A mailing address change of the permittee; 2. The permittee is responsible for compliance with all terms and conditions of this permit until such time as the Director approves the transfer request. Neither the sale of the project nor the transfer of common area to a third party constitutes legal transfer of the stormwater permit. 3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 4. Any individual or entity found to be in noncompliance with the provisions of this stormwater management permit or the requirements of the Stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. 5. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal), which have jurisdiction. 6. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the, construction of additional or replacement stormwater management systems. 7. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 8. The Permittee grants permission to staff of the DEMLR to access the property for the purposes of inspecting the stormwater facilities during normal business hours. 9. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 10. The permittee shall submit a permit renewal application request at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate documentation and the processing fee. All slopes are grassed with permanent vegetation. 9. Vegetated slopes are no steeper than 3:1. 10. The inlets are located per the approved plans and do not cause short- circuiting of the system. 11. The permitted amounts of surface area and/or volume have been provided. 12. Required drawdown devices are correctly sized per the approved plans. 13. All required design depths are provided. 14. All required parts of the system are provided, such as a vegetated shelf, a forebay, and the vegetated filter. 15. Seay and Pope: Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified, transferred, or renewed. Please note that this letter references DLMLR as the Division responsible for issuance of the permit. On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010. The law extended the effective period of any stormwater permit that was set to expire during this time frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for a total of four (4) years extension. The permit's original expiration date of July 20, 2009, was extended to July 20, 2013. The Division attempted to notify the president of the Association, Mr. Gary Pope, of the new expiration date via four separate letters dated May 18, 2009, December 1, 2009, September 2, 2011 and March 7, 2013 (copies enclosed). These letters also required that a renewal application be submitted at least 180 days prior to the July 20, 2013 expiration date. As of this date, the Division has not received any acknowledgment of those letters or the required renewal application from Mr. Pope. This puts all of the individual lot owners copied on this letter at risk of being in violation of the stormwater rules. There are 26 lots covered under this permit, which utilize and rely on the 2 permitted wet detention ponds under SW8 961004 to treat their runoff as required by NCAC 0211. 1000. Failure to renew the permit can result in several possible violations including: 1) the lots are discharging their runoff to a facility that no longer holds a permit to discharge to waters of the state; 2) if the permit is not renewed. the Division may require that the Association apply for a new permit which may impose more stringent design standards including average depth and a 1.5" design storm; and 3) if the permit is not renewed, the Division may require each lot to retro-fit suitable stormwater treatment measures designed to treat the runoff from their lot(s) at the current design storm level. State Stormwater Management Permit HSW8 961004 for the subdivision previously known as 'technology Court (now ,rechnology Drive) was last issued on July 22, 1999 to Gary Pope, President of Technology Court Owners Association, Inc. and expired on July 20, 2013, as noted above. Since this is still an active project, you must complete and submit a renewal application immediately to avoid further enforcement action from the Division for failing to renew the permit in a timely'manner, for operating a treatment system without a permit, and for discharging to surface waters without a permit. An inspection of the project and the stormwater facilities will be conducted in the near future. The Association and each lot owner, will be provided with a copy of the inspection report listing any observed compliance issues that will need to be addressed. All lots are required to adhere to this maximum BUA limit; and to collect and direct their runoff into the piped runoff collection system in the street that will convey it to one of the permitted wet detention ponds as indicated in the permit No runoff from any lot should be directed into any of the drainage ditches. All developed and undeveloped lots will need to apply for a separate stormwater management permit under any one of the following triggers: 1) construction of more than 10,000 square feet of built -upon area; or 2) cumulative disturbance of 1 acre or more that requires a grading permit from New Hanover County; or 3) development that requires a CAMA Major permit. Please note that since issuance of the original master permit on November 14, 1996, Technology Court was apparently renamed as Technology Drive. References on the approved plans and in the permit to Technology Court should be considered as references to Technology Drive. The Technology Court Owners Association, Inc. is still listed as a current and active non-profit corporation with the NCSOS. No paperwork has been filed since 1997 to provide a current mailing address for the president of the Association. Please be advised that the Association is required to comply with the terms, conditions and limitations of the Stormwater Management Permit issued under Title 15A North Carolina Administrative Code 2H .1000 and North Carolina General Statute 143-214.7. This lot was excluded from the permitted drainage area associated with Technology Court's master stormwater permit #SW8 961004. There are 5 such lots fronting on Enterprise Drive (41, 47, 57, 70 and 71 )that were not part of the drainage area for Technology Court's two stormwater ponds. The notes or the November 14, 1996 approved plan for 961004 clearly state that the runoff from those 5 lots cannot drain into the collection system for Technology Court. There is no state stormwater permit for Lot 41. 1 assume that the original construction on lot 41 disturbed less than 1 acre, and therefore, did not require a grading permit from the county, and therefore, did not trigger a stormwater permit. However, under the 2008 stormwater rules, the construction of >10000 sf of new built -upon area will require a stormwater permit. As long as the new building addition and associated parking, sidewalks, etc., totals less than 10000, and the runoff is not directed into Technology Court, no state stormwater permit is required.
