The Wilmington Regional Office received a complete 8 year Stormwater Management Permit
Renewal Application for Hock Subdivision on May 30, 2013. This site was inspected on June 4,
2013 and found compliant on June 6, 2013. As noted in the enclosed inspection report the site
is currently in compliance with the terms and conditions of the current state stormwater permit.
The Division is hereby notifying you that permit SW8 960321 has been renewed on June 6,
2013, and shall be effective until May 22, 2014. The plans previously approved on May 22,
1996, in accordance with the regulations set forth in Title 15A NCAC 21-1.1000 effective
September 1, 1995, remain in full force and effect. Please attach this cover letter and permit
addendum to your High Density Permit originally issued on May 22, 1996.
Per 15A NCAC 2H.1003(h) (the stormwater rules), an application for renewal of a permit shall
be submitted 180 days prior to the expiration of a permit and must be accompanied by a
processing fee, which is currently set at $505.00. Please submit a renewal application and the
associated fee immediately and prior to November 22, 2013. Renewal applications are
available on line at: htto.//portal.ncdenr.org/web/wq/ws/su/statesw/forms docs
This permit is subject to the conditions and limitations as specified therein. Please pay special
attention to the conditions listed in this permit regarding the Operation and Maintenance of the
BMP(s), recordation of deed restrictions, procedures for changes of ownership, transferring the
permit, and renewing the permit. Failure to establish an adequate system for operation and
maintenance of the stormwater management system, to record deed restrictions, to transfer the
permit, or to renew the permit, will result in future compliance problems. .
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing by filing a written petition with the Office of
Administrative Hearings (OAH). The written petition must conform to Chapter 150E of the North
Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of
this permit. You should contact the OAH with all questions regarding the filing fee (if a filing fee
is required) and/or the details of the filing process at 6714 Mall Service Center, Raleigh, NC
27699-6714, or via telephone at 919-431-3000, or visit their website at www.NCOAH.com.
Unless such demands are made this permit shall be final and binding.

construction, operation and maintenance of a detention pond in compliance with the provisions
of 15A NCAC 2H .1000 (hereafter referred to as the "stormwaterrules') and the approved
stormwater management plans and specifications and other supporting data as attached and on
file with and approved by the Division of Water Quality and considered a part of this permit.
The permit is hereby renewed subject to the following addendums, clarifications, conditions and
limitations:
The original permit conditions contained in the permit issued on May 22, 1996
remain in full force and effect, except as amended herein. (An additional copy of this
original permit can be obtained from the Division of Water Quality, Wilmington
Regional Office.)
2. This permit shall be effective from the date of issuance until May 22, 2014.
3. The permittee shall submit a permit renewal application request at least 180 days
prior to the expiration date of this permit. The renewal request must include the
applicable documentation and the processing fee.
4. If the use of permeable pavement is desired, this permit must be modified to add the
permeable pavement conditions.

This form is to be completed by the current permit holder pursuant to Title 15A NCAC 2H.1003 IN (2). This states
that stormwater management permits, issued for projects that require the construction of engineered stormwater
control measures (High Density Permits), shall be required to submit an application to renew the permit 180 days
prior to expiration of the permit. Renewed permits are valid for a period of 8 years per Session Law 2011-398 (SB
781) Section 60. (c).
I. SUBMITTAL REQUIREMENTS
Only complete application packages will be accepted and reviewed by the North Carolina Department of
Environment and Natural Resources (NCDENR) Division of Water Quality (DWQ). A complete package
includes all of the items listed below. The complete application package should be submitted to the
appropriate DWQ Regional Office. (The appropriate office may be found by clicking on the interactive online map
at http://12ortal.ticdenr.org/web/wq/­home/­ro. Copies of the original permit can be obtained from the Regional Office
of the Division of Water Quality.)

My inspector inspected this site and found the pond and area has been maintained and is in good working
order. Also, additional review of the file has revealed that a certification was completed a number of years
ago on the pond. So the main issue is that the permit has not been renewed.
We also are in contact with Mr. Carriel Nipp who is the new point of contact for the "Stormwater Owner's
Association, Inc.". So we no longer need a transfer application from your office since the permit owner name
is NOT changing, only the name of the contact for the Association is changing.
We will be requesting a renewal of the permit from Mr. Nipp.
I would like to thank you for your time and I appreciate the information you provided to our office.

Attached is the transfer application. Please fill out item I. And IV (second check box that requires Mr. Hock's

Please send the original signed document our office in care of me. When we transfer the permit we will send
a copy of the transfer letter to Mr. Hock or you but I need a correct address to send it to.
Also, I believe you told me that the property was sold to other owners without any construction. Do you know
if the Cinema owner was the person who built the pond? Or did Mr. Hock build the pond then sell all the lots?

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8
960321 to Stormwater Owner's Association, Inc. for the Hock Subdivision project on May 29,
1996. This permit expired on May 22, 2006. A letter was sent to you on July 12, 2007 requesting
that an application for renewing the permit be submitted and, at this time, a response has not
yet been received. Per 15A NCAC 2H.1003(h) (the stormwater rules), applications for permit
renewals shall be submitted 180 days prior to the expiration of a permit.
Please complete and submit the enclosed renewal application prior to June 3, 2013. The
renewal application must be accompanied by a processing fee, which is currently set at
$505.00. If you have sold the project please provide the name, mailing address and phone
number of the person or entity that is now responsible for this permit. Enclosed is a form for
change of ownership, which should be completed and submitted if the property has changed
hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
stormwater treatment system, a certification of completion be submitted to the Division from an
appropriate designer for the type of system installed. This is to certify that the permitted facility
has been installed in accordance with the permit, the approved plans, specifications and
supporting documentation. If you have not already provided a Designer's Certification to our
office, please include a copy with your permit renewal request and processing fee. A copy of the
certification form is enclosed for your convenience.
You should be aware that the operation of a stormwater treatment facility without a valid permit
is a violation of NC General Statute 143-215.1 and may result in appropriate enforcement action
including the assessment of civil penalties of up to $25,000 per day.

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number
SW8960321 to Stormwater Owner's Association, Inc. for a High Density pond to serve Hock
Subdivision on 5/22/1996. This permit expired on 5/22/2006. Section .1003(h) of 15 A NCAC
2H .1000 (the stormwater rules) requires that applications for permit renewals shall be
submitted 180 days prior to the expiration of a permit and must be accompanied by a
processing fee, which is currently set at $420.00. If this is still an active project please
complete and submit the enclosed renewal application in a timely manner. If this project has
not been constructed and a permit is no longer needed, please submit a request to have the
permit rescinded. If you have sold the project, or are no longer the permittee, please provide
the name, mailing address and phone number of the person or entity that is now responsible
for this permit. Enclosed is a form for change of ownership, which should be completed and
submitted if the property has changed hands.

The Wilmington Regional Office received a complete Stormwater Management Permit
Application for Allstar Day Care on August 9, 2005. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the
Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit
No. SW8 050612, dated August 10, 2005, for the construction of the subject project.
This permit shall be effective from the date of issuance until rescinded and shall be subject
to the conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this permit are unacceptable, you
have the right to request an adjudicatory hearing upon written request within thirty (30)
days following receipt of this permit. This request must be in the form of a written petittion,

1. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. The runoff associated with this project has been approved to be discharged into a
stormwater management system permitted under SW8 960321, as described in
Section 1.7 on page 3 of this permit.
3. The built -upon area allotted to this development by Stormwater Management Permit
No. SW8 960321, is 32,025 square feet (90% of the total lot area). This project
proposes 17,237 square feet.
4. Approved plans and specifications for this project are incorporated by reference and
are enforceable parts of the permit.
5. All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.
6. The runoff from the permitted built -upon area must be directed into the permitted
stormwater system.

IL SCHEDULE OF COMPLIANCE
1. The offsite stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any built -
upon surface associated with this project.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
3. The permittee is responsible for keeping the stormwater collection system on the lot
clear of debris, and keeping the site stabilized in accordance with the requirements of
the NC Erosion and Sediment Control Design Manual.
4. G. V Hock, shall, at all times, provide the operation and maintenance necessary to
assure the permitted stormwater management system functions at optimum efficiency.
The approved Operation and Maintenance Plan must be followed in its entirety and
maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
c. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.

e. Maintenance of side slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins
and piping.
g. Access to the outlet structure must be available at all times.
5. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Anyrevision to the approved plans, regardless of size.
b. Project name change.
c. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision, acquisition or selling of the for
area. The project area is
defined as all property owned by the permittee, for which Sedimentation and
Erosion Control Plan approval or a CAMA Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
6. The Director may determine that other revisions to the project should require a
modification to the permit.
7. G. M. Hock, must keep records of maintenance activities and make them available
upon request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
8. This permit shall become voidable unless the facilities are constructed in accordance
with the conditions of this permit, the approved plans and specifications, and other
supporting data.
9. G. M. Hock, is responsible for providing, prior to issuance of a Certificate of
Occupancy, and prior to operation of the permitted stormwater management facility, a
certification from an appropriate designer for the system installed, certifying that the
permitted facility has been installed in accordance with Stormwater Permit No. SW8
960321, the approved plans and specifications, and other supporting documentation.
Any deviations from the approved plans and specifications must be noted on the
Certification.
10. A copy of the approved plans and specifications shall be maintained on file by the
Permiylee for a minimum of ten years from the date of the completion of construction.
11. This lot is limited to the amount of built -upon area indicated in the supporting
calculations and per approved plans. The project must have a built -upon area less
than or equal to the amount permitted under tormwater Permit No. SW8 960321.
Additional built -upon area will require a modification to the overall Permit.
12. G. M. Hock, must record any deed restrictions as required by their permit and they
must verify that the proposed built -upon area does not exceed the allowable built -upon
area. Once the lot transfer is complete, the built -upon area may not be revised without
approval from the permittee, and responsibility for meeting the built -upon area limit is
transferred to the individual property owner.
13. The drainage features shown as a part of the stormwater management system on the
approved plan shall not be filled in, altered, or piped by any party without first
submitting a revision to the permit and receiving approval from the Division.
14. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been
made.

III. GENERAL CONDITIONS
1. This permit is not transferable except after notice to and approval by the Director. In
the event there is a desire for the facilities to change ownership, or there is a name
change of the Permittee, a formal permit request must be submitted to the Division of
Water Quality accompanied by an application fee, documentation from the parties
involved, and other supporting materials as may be appropriate. The approval of this
request will be considered on its meats and may or may not be approved. The
permittee is responsible for compliance with all terms and conditions of this permit
until such time as the Director approves the permit transfer.
2. Failure to abide by the conditions and limitations contained in this permit may subject
the Permittee to enforcement action by the Division of Water Quality, in accordance
with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from comp)ying with any
and all statutes, rules, regulations, or ordinances which may be imposed by other
government agencies (local, state, and federal) which have jurisdiction.
4. In the event that the offsite stormwater facilities fail to perform satisfactorily, including
the creation of nuisance conditions, G. M. Hock is responsible for taking immediate
corrective action, including those as may be required by this Division, such as the
construction of additional or replacement stormwater management systems.
The permittee grants permission for DENR Staff to enter the property for the purpose
of inspecting all components of the permitted stormwater management facility.
The permit may be modified, revoked and reissued or terminated for cause. The filing
of a request for a permit modification, revocation and reissuance or termination does
not stay any permit condition.
7. The permittee shall notify the Division of any name, ownership or mailing address
changes within 30 days.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table
listing each lot number, size and the allowable built -upon area for each lot must be provided as an attachment.
1. The following covenants are intended [o ensure ongoing compliance with state stormwater management permit number
i l R ` (7 :�, as issued by the Division of Water Quality. These covenants may not be
changed or deleted without the consent of the State.
Z. No more than f� t / square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area In excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.
By your signature below, you certify that the recorded deed restrictions and protective covenants for this project
shall include all the applicable items required above, that the covenants will be binding on all parties and persons
claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted
without concurrence from the State, and that they will be recorded prior to the sale of any lot.

Only complete application packages will be accepted and reviewed by the Division of Water Quality (DWQ).
A complete package includes all of the items listed below. The complete application package should be
submitted to the appropriate DWQ Regional Office.

A complete stormwater management plan submittal includes a stormwater management permit application, an
off site system supplement for each off -site stormwater treatment system, appropriate supplement forms for any

IV. STORMWATER COLLECTION SYSTEM MAINTENANCE REQUIREMENTS
1. Mowing will be accomplished as needed according to the season. Grass height will not exceed six inches
at any time.
2. Accumulated sediment and trash will be removed from the collection system as necessary. Swales and
ditches will be reseeded or sodded following sediment removal.
3. Eroded areas of swales and ditches will be repaired and reseeded. Swales and ditches will be revegetated as
needed based on monthly inspections.
4. The collection system, including catch basins, curb cuts, velocity reduction devices, and piping, will be
inspected monthly or after every significant runoff producing rainfall event. Trash and debris will be
cleared away from grates, curb cuts, velocity reduction devices, and piping.
5. The collection system may not be altered in any way without prior approval from NCDENR Division of
Water Quality.

system in accordance with the five maintenance procedures listed above. 1 agree to notify DWQ of any
problems with the system or prior to any changes to the system or responsible party.

On May 29, 1996, the Division of Water Quality issued a Stormwater Management Permit for Hock
Subdivision. Stormwater Regulation 15A NCAC 2H.10080) stipulates the following:
"Upon completion of construction, the designer for the type of Stormwater system
installed must certify that the system was inspected during construction, was
constructed in substantial conformity with plans and specifications reviewed by the
Division, and complies with the requirements of this Section prior to issuance of the
certificate of occupancy."
As of this date, our records indicate the required engineer's certification has not been received.
Operation of the stormwater system prior to submission of the required certification is in violation of
NCAC 2H.10080) in accordance with NCGS 143-215.6. The facility has been constructed and placed in
operation. Please submit the required certification (attached) immediately. Construction is considered
complete at the time the project is occupied by an owner or tenant for its intended use.

No. SW8 960321, was issued to Mr. G.M. Hock on May 29, 1996, and provided a detention pond to treat
the runoff from the lots in the subdivision, with each lot limited to a built -upon area equal to 90% of its site
area. According to the plan submitted by John Klein, P.E., the All in One Services development proposes
14,901 square feet of built -upon area, or 68.4% of its available site area, which complies with the permit
requirements. Please bear in mind that once the lot transfer is complete, All in One Services, Inc. is
responsible for verifying that the built -upon area meets the permit conditions.
