T. Wooten Corp. Concrete Plant No. 21 on July 28, 2010. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 and Session Law 2008-211. We are forwarding Permit No. SW8 100410 dated August 3, 2010, for the construction of the subject project. This permit shall be effective from the date of issuance until August 3, 2020, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. Wooten Corporation S.T. Wooten Corp. Concrete Plant No. 21 1839 Highway 172, Sneads Ferry, Onslow County FOR THE construction, operation and maintenance of one wet detention pond in compliance with the provisions of 15A NCAC 2H .1000 and Session Law 2008-211 (hereafter collectively referred to as the "stormwater rules') the approved stormwater management plans and specifications and other supporting data as attached and on file with and approved by the Division of Water Quality and considered a part of this permit. This permit shall be effective from the date of issuance until August 3, 2020, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is for stormwater discharges generated on Drainage Area 1 and Drainage Area 3 only. Wastewater discharges from this facility are not covered under this permit. The wet detention pond is designed for Drainage Area 1 which totals 94,374 square feet in area and contains 65,755 square feet of impervious area. Drainage Area 2 is 15,746 square feet in area and is a wastewater system. Stormwater generated within Drainage Area 2 must be contained inside Drainage Area 2 and treated under the• appropriate wastewater permit(s). Drainage Area 3• is 81,712 square feet in area and contains 11,702 square feet of impervious area that is a historical driveway which does not require stormwater treatment under this permit. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.8 on page 3 of this permit. The stormwater control has been designed to handle the runoff from 65,7.55 square feet of impervious area which includes 2,500 square feet of future impervious area. 4. A 50' wide vegetative buffer must be •provided adjacent impounded structures, streams, rivers and tidal waters. Page 2 of 8 State Stormwater Management Systems Permit No. SW8 100410 5. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans. The built -upon area for the future development is limited to 2,500 square feet in Drainage Area 1. 6. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 7. The runoff from all built -upon area within the permitted drainage area(s) of this project must be directed into the permitted stormwater control system. 8. Classification of Water Body: "SA;HQW"* * This site drains to SA waters, but is greater than a half mile away from the named stream. II. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. Page 3 of 8 State Stormwater Management Systems Permit No. SW8 100410 3. The permittee shall at all time provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowiny and re -vegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. The facilities shall be constructed as shown on the approved plans. This permit shall become void unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 6. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 7. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 8. Access to the stormwater facilities for inspection and maintenance shall be maintained via appropriate recorded easements at all times. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further development, subdivision, acquisition, lease or sale of any, all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. Prior to the construction of any permitted future areas shown on the approved plans, the permittee shall submit final site layout and grading plans to the Division for approval. Page 4 of 8 State Stormwater Management Systems Permit No. SW8 100410 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a completed Name/Ownership Change Form signed by both parties, to the Division of Water Quality, accompanied by the supporting documentation as listed on page 2 of the form. The approval of this request will be considered on its merits and may or may not be approved. 2. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Neither the sale of the project nor the transfer of common area to a third party constitutes an approved transfer of the stormwater permit. 3. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit remains in force and effect until modified, revoked, terminated or renewed. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re - issuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 10. The permittee shall notify the Division of any name, ownership or mailing address changes at least 30 days prior to making such changes. The renewal request must include the appropriate documentation and the processing fee. Permit issued this the 3rd day of August 2010. Wooten Corporation, we are writing this letter in response to the Request for Additional Information Letter received on July 15, 2010 for the above referenced project. We understand there is additional information requested in order to proceed with the project review and subsequent approval. Listed below are NCDENR's initial comments along with our associated responses (in red). Stream: The previous application said that it drains to a UT of Mill Creek, 19-39-3-1, class SA; HQW. This application says that it is the same stream and index number but shows that it is class C. We have previously determined that this site drains to a UT and is over a half mile to a named stream, sot it will not have to be designed for SA requirements. But, the application should still note that it drains to SA. The way we will handle this is to put a note in the permit text that it is over half mile and therefore not subject to SA requirements. I will change the application to show "UT of Mill Creek, 19-39-3-1, class SA; HQW" if you authorize me to do so. Response: We concur that this UT of Mill Creek is over half mile from Mill Creek (SA waters) and is not subject to SA requirements and authorize you to make the change as noted. 2. Outlet Structure: Please ensure that the outlet structure detail shows a 1.5" orifice at the permanent pool, the temporary pool elevation and a trash rack with 56" square openings. Response: Plans revised as requested. 3. Receiving Stream Location: Our 401 Unit has revised the location of the stream call per your request. If this point is on or adjacent to this project, please show this point on the plans and insert the buffer if applicable: Response: Buffer added in location specified. 4. Average Depth: Please check your average depth calculation. It is shown to be 3.5 feet, but I believe that it may be 3.16ft (which would round to 3.Oft for permitting purposes). This change should not change the overall design, but needs to be correct if it is not correct. Response: Average depth calculations revised as requested. BMP sizing calculations and Wet Pond Supplement form modified to reflect the 3' average depth calculations. 5. Vegetation Plan: Centipede is currently specified for the 1 Oft vegetated shelf. But, A Vegetation plan is specified for the pond, including slopes. Aerial Photographs: Aerial photographs from 1993 showing the existing driveway were included in the package in order to establish that it pre -dated stormwater permitting and therefore does not have to be collected and treated in the stormwater system. Stormwater permitting started in North Carolina in 1988. Please submit documentation that the driveway existing prior to the onset of stormwater permitting which began on 111/88. Response: Aerial photography was found from 1985 and 1993. The 1985 aerial shows no development on site, while the 1993 aerial, as noted, shows the driveway and completed site. According to our best available information through deed research and lease agreements, the driveway was permitted prior to January 1, 1988 and installed according to State standards for driveway access and stormwater at the time of permitting. Attached is a copy of the septic system certificate of completion for Concrete Service Company, the previous tenant of the site. The certificate is dated 4125/88, indicating that site construction was near completion in April 1988. It may be reasonably assumed that the site had been designed, permitted, and partially constructed prior to 1/1188. 7. Please remember that a change in one number may have a domino effect on other numbers. Please check all plans, calculations and forms and make changes as needed. Response: Noted. We trust that these revisions will be deemed acceptable by NCDENR and allow the project to continue through the review and subsequent approval process. But, the application should still note that it drains to SA. The way we will handle this is to put a note in the permit text that it is over a half mile and therefore not subject to SA requirements. WOOTEN CONCRETE PLANT No. 21 SNEADS FERRY, ONSLOW COUNTY, NORTH CAROLINA The ST Wooten Concrete Plant is a proposed 4.404-acre industrial development located at 1839 NC Highway 172, approximately 1/2 mile west of the intersection of NC Highway 210 and NC 172 in Onslow County, North Carolina. The site was previously used as a concrete plant but is not currently in operation. There is existing built upon area on site which has been documented in a recently completed site survey. The main entrance to the site will be located on NC 172, there is no proposed secondary entrance. The site will use an onsite well and septic system for water and sewer service. The project includes development entirely on one parcel as identified by Onslow County GIS Mapping. The Parcel Identification Numbers and acreage based on GIS property lines for the parcel are as follows. 4269.04.84.2473 (4.404 ac) Total GIS Area = 4.404 acres The site was previously developed and a survey of existing impervious areas has been completed and attached as the "existing conditions map." Existing built upon area is used to determine minimum stormwater management requirements for permitting purposes. Calculations are attached that document the increase in stormwater runoff volume between pre and post project conditions during the 1-year, 24 hour event as well as the runoff generated by 1.5 inches of rainfall. The site drains from north to south. There is a drainage ditch along the eastern property line and natural wetlands along the southern property line, adjacent to NC 172. The entire site drains to a tributary of Mill Creek, which is classified as SA, HQW from its source to Alligator Bay. The tributary is not classified. All areas of the site are within one half mile of the tributary to Mill Creek, and the entire site lies within the White Oak River basin. The proposed grading plan will maintain natural runoff patterns to the maximum extent practicable, however due to wastewater permitting requirements runoff from the industrial activity areas within the site will be recycled onsite. The owner is seeking a non -discharge wastewater recycling permit through the Aquifer Protection unit. Due to the site's distance from Mill Creek (as shown on the attached USGS Quad map) the site is not considered to be within 1/2 mile and draining to class SA waters per current Division policy. The tributary to Mill Creek is mapped as a primary nursery area as defined by the INC Division of Marine Fisheries. A site vicinity map with stream classifications is attached. The site contains natural wetlands which have been delineated and mapped. The total wetland area within the site is 0.37 acres. The wetlands are not considered coastal wetlands, and therefore no adjustment has been made to the effective site area used for stormwater calculations. S.T. WOOTEN CONCRETE PLANT No. 21 SNEADS FERRY, ONSLOW COUNTY, NORTH CAROLINA Based on the current development plan, the built upon area density of the completed site will be 48.59%. The low density threshold for projects outside of one- half mile from class SA waters is 24%. Therefore the project will be permitted as a high density project. Per the Coastal Stormwater Regulations, the site will require structural Best Management Practices (BMPs) to control and treat the runoff generated by 1.5 inches of rainfall. This rainfall depth was used to size the proposed onsite BMP. One stormwater wet pond is proposed forthe site. The wet pond is sized per Chapter io of the NC DWQ BMP Design Manual. The chapter was revised on June 16, 2009. The minimum required surface area for the pond was based on table 10-4 to achieve 9o%TSS removal in the Coastal Plain. Per current NC Coastal Stormwater regulations, a wet pond may be used to control and treat the water quality volume. Because the pond is designed for 9o%TSS removal and the site lies more than 1/2 mile from class SA waters, no secondary BMP or vegetated filter strip is required. A completed wet pond supplement form and supporting calculations for average depth, surface area requirement, and water quality volume requirements are included in this report. Due to site constraints a portion of the proposed built upon area will not drain into the proposed wet pond. The wet pond was located in an area which would allow for permanent protection of a ioo' wide wooded buffer area north of NC Highway 172. The onsite grading plan was designed to direct stormwater runoff into the wet pond to the maximum extent practicable. The untreated stormwater will be conveyed to the natural outfall using vegetated conveyances. The built upon area which is not treated by the wet pond is in the same location as an existing driveway which has been in place for many years. The runoff will also enter the natural wetland area prior to entering an existing culvert under NC Highway 172 and discharging into the tributary to Mill Creek. The driveway will be constructed in the same alignment as the existing driveway on site. The untreated runoff is generated by 12.6% of the overall built upon area proposed for the site. 71.3%of the built upon area drains into the wet pond, and the remaining 17.1% of the built upon are will drain into the onsite wastewater recycling system. The onsite industrial area also includes a dust collection system to prevent migration of airborne particulates into the wet pond and receiving waters. A submittal was made in March 2010 to the NCDWQ Wilmington regional office for an industrial wastewater permit for the site. As part of that permit application, an onsite water recycling system was designed for the industrial activities on the site in accordance with current wastewater permitting requirements. As such, a portion of the overall built upon area (17.10/-) will drain into the wastewater recycling system, resulting in no runoff from that area during storm events up to and including the 25- year 24 hour duration storm. Per comments received from NCDENR, the system will be reviewed and permitting by the Aquifer Protection section. The built upon area which is located within this drainage basin has been identified as drainage area 2 in the attached permit application. S.T. WOOTEN CONCRETE PLANT No. 21 SNEADS FERRY, ONSLOW COUNTY, NORTH CAROLINA There are no stream buffers on site. There are vegetated buffer requirements as described in the coastal stormwater rules. The site is not subject to CAMA restrictions. Preliminary soil tests have been completed by Hal Owen & Associates Inc and indicate primarily well drained soils. The seasonal high water table is close to the surface in many areas of the site. Because of the high seasonal water table, the wet pond was designed with a normal pool elevation within 6" of the seasonal high water table. No additional liner is required to maintain a normal water surface in the basin. Vincent Lewis was present during the second soil investigation as noted in the attached report. Prior to submittal of this application package, we have met numerous times with NCDWQ staff to discuss coordination of the stormwater permit and industrial wastewater permit. Staff members who have attended those meetings included Rick Shriver, Linda Willis, Ken Pickle, and Kelly Johnson. Additional conversations have been conducted with Bradley Bennett, Jennifer Jones and Georgette Scott. Wooten Concrete Plant, NC Hwy 172 Snead's Ferry Dear Mr. Werenko, A site investigation has been conducted for the above referenced property, located on the northern side of Sneads Ferry Road (NC Hwy 172), Onslow County, North Carolina. The purpose of this investigation was to provide a general characterization of the soils in the area proposed for an infiltration basin, including a determination of the depth to evidence of a seasonal high water table. All soil determinations were made in accordance with the "North Carolina Stormwater Best Management Practice Manual" and Administrative Code Section: 15A NCAC 2H .1000. The materials at the site were described in accordance with the USDA Field Book for Describing and Sampling Soils. This report represents my professional opinion as a Licensed Soil Scientist. A soil profile description was collected at the site at the location indicated in Figure 1, using a hand powered soil auger. Observations more in the central part of the proposed stormwater management facility were not obtainable due to the presence of large amounts of concrete that has been deposited at the site. Soil morphological characteristics indicating a seasonal high water table (SHWT) were observed at approximately 24 inches below surface. A dense clay layer was observed at 42 inches below surface. This layer has very slow permeability and is perching water above it. Free water in the auger boring was measured to be at a depth of 30 inches after two hours. These consist chiefly of soils having a layer that impedes the downward movement of water or soils of moderately fine texture or fine texture. These soils have a slow rate of water transmission. Group D. Soils having a very slow infiltration rate (high runoff potential) when thoroughly wet. These consist chiefly of clays that have a high shrink -swell potential, soils that have a high water table, soils that have a claypan or clay layer at or near the surface, and soils that are shallow over nearly impervious material. These soils have a very slow rate of water transmission. If a soil is assigned to a dual hydrologic group (A/D, B/D, or C/D), the first letter is for drained areas and the second is for undrained areas. The purpose of this meeting was to evaluate the soils in the area proposed for stormwater management devices, including a determination of the depth to evidence of a seasonal high water table. All soil determinations were made in accordance with the "North Carolina Stormwater Best Management Practice Manual" and Administrative Code Section: 15A NCAC 2H .1000. The materials at the site were described in accordance with the USDA Field Book for Describing and Sampling Soils. This report represents my professional opinion as a Licensed Soil Scientist. Observations were made at each of the three indicated areas shown at Figure 1. The Onslow County Soil Survey indicates the site to be underlain by soils of the Leon series, which are poorly drained soils on uplands. These sandy textured soils with weakly cemented subsoils were verified at the site. However, indicators of a seasonal high water table at observation point #1 were found to be at or near the surface. Indicators of a seasonal high water table at observation points #2 and # 3 were found to be in the 6 to 12 inch zone below surface. The map at Figure 1 shows an area in which these better drained soils can be expected. However, the topography at observation point #1 is very flat, if not somewhat concave. East of observation point #1, the topography becomes more convex (although the extremely dense vegetation made visual observations difficult). It is likely that some additional area of the better drained soils can be found east of observation point #1 and south of the area indicated on the attached map. DWQ Stormwater rules as well as the specific language in the stormwater permits clearly limit the use of engineered systems for the treatment of "stormwater runoff" Response: Noted. ii: DWQ does not object to a stormwater discharge from the proposed site and will support the NDPES Permit (NCG14000) for stormwater discharges only. Response: Noted. b. Wastewater: i. Water Quality Standards applicable to Mill Creek (Class SA waters) prohibit the Division's ability to approve an NPDES discharge for wastewater. Response: While we believe this project discharges to an unnamed tributary to Mill Creek per stream classification guidelines outlined by NCDWQ in 15A NCAC 02B .0301, and that this unnamed tributary is properly classified as "C" waters per 15A NCAC 02B .0301 (i) (1) (B), we are pursuing a recycle system permit for non -discharge wastewater through DWQ Aquifer Protection as requested. ii: The proposed wastewater recycle system will not be permitted for discharge. Response: There is an existing driveway in this location as evidenced by historical aerials. The existing driveway alignment and location will be used for the new development. Through discussions and concurrence with staff, no additional BMP's are required to treat this BUA prior to entering the wetlands. Copies of the archived aerial photos are included in the Stormwater Management Plan. b. Wastewater i. DA2 (wastewater system): 13850 sf 1. Please integrate the wastewater guidance specified above into this design. Response: Noted. We have separated the wastewater flows from the stormwater as shown on the plans and have designed accordingly as requested. 2. Please delineate this drainage area on the drainage area map on Sheet 5. Response: Wastewater drainage area outlined on Sheet 5 as requested. 3. Please show how the wastewater drainage area will be separated from the stormwater drainage area using a permanent physical barrier to prevent mixing. Please provide a narrative regarding how the permanent physical barrier will be able to separate the wastewater and stormwater. Response: A raised concrete lip has been added along the stormwater/wastewater boundary limits to prevent wastewater/stormwater commingling. Details have been added to Sheet 3 showing the locations. A design narrative has been added to Sheet 3 as requested. 4. If a physical barrier is not provided, then the entire site will be covered by the NPDES permit. Response: Noted. A permanent concrete lip has been added as a barrier. See Response #3 above. 3. Buffer: a. State Stormwater Buffer: The site drains to a UT to Mill Creek (SA; HQW) but is over''/I mile to the named stream. Joanne Steenhuis, 401 staff in Wilmington Region, has made a stream call for the stream to start at the location shown below, and flow along the lot line and under Hwy 172. Please show the top of bank on the plans as well as the 50 ft buffer measured from the TOB. A 50 ft buffer is required for new projects. If you intend to claim to be a redevelopment project such that you required only a 30 ft buffer, please summarize reasons supporting that claim in your response and provide a copy of the site survey of the built upon area that you refer to in your narrative. Response: Withers & Ravenel met onsite with Ms. Steenhuis on May 21, 2010 to review the ditch along the eastern property boundary and discuss the stream determination made by DWQ. Based on the additional site review and review of historical aerials provided by W&R, Ms. Steenhuis determined that the ditch was not a stream (Waters of the State), and was in fact a man-made ditch. Since Ms. Steenhuis determined that the feature was not a stream (Waters of the State), the feature is not subject to the 50' buffers. I will include the historical site information with the revised submittal. Troy Beasley is meeting Joanne on site on the 21" to discuss the stream/ditch and determine if it should be buffered. If it is buffered, the coastal regulations state that wet ponds are not permitted in the buffer. Per your request during our first scoping meeting, we had changed the proposed design from a constructed wetland to a wet pond. The Tidal Salt Water Quality Standards (15A NCAC 02B.0221) apply for this receiving stream. 15A NCAC 02B.0221(3)(a) specifically states; Floating solids, settleable solids, or sludge deposits: none attributable to sewage, industrial wastes or other wastes. The plans and specifications propose to divert all wastewater generated in the aggregate materials storage area, admix (concrete additives) containment area, cement silo area and truck washdown area to a wastewater recycle system. The recycle settling basin will be designed for the 24 hour 25 year storm event, or an eight inch rain. The proposed recycle settling basin is designed to discharge wastewater if a storm event producing more than eight inches of rain occurs. The overflow would leave the first cell in the recycle system settling basin and discharge to the ground on the facility where stormwater is collected for treatment in the State Stormwater Pond. The Division of Water Quality has not allowed discharges of wastewater to SA waters of the State given the quality standards applicable to Class SA waters, therefore an NPDES permit for the wastewater recycle system cannot be issued. The company will forego drum rinse -out at this facility, and will rinse out drums at another location. Consequently the large concrete settling chambers will be receiving only the weak wastewaters from: aggregate irrigation (although with no pH correction provisions, this aggregate irrigation may have an elevated pH meaning that it may be a 'weak' wastewater wrt TSS, but perhaps not wrt pH), under the silos wash down, and cosmetic truck rinse -off. According to Dale, this was the arrangement that was discussed conceptually with WIRO at a recent meeting that the CO-SPU did not attend — recycle of the wastewater as truck rinse water, and no discharge of wastewaters under design conditions. Effectively WIRO would not agree to permit the facility with any wastewater discharges into these SA PNA waters. Considering the no -discharge under design conditions (25yr-24hr storm) provisions, and the semi -categorization of wastewaters generated on site as 'weak' wastewater due to no drum rinse -out wastewaters, this is a fine resolution of the permitting problems, it seems to me. The developer is responsible for the control of sediment on -site. If the approved erosion and sedimentation control measures prove insufficient, the developer must take those additional steps necessary to slop sediment from leaving this site. Each sediment storage device must be inspected after each storm event. Maintenance and/or clean out is necessary anytime the device is at 50% capacity. 4. The developer is responsible for obtaining any and all permits and approvals necessary for the development of this project prior to the commencement of this land disturbing activity. If that relocation presents a problem or contradicts any requirements of either DWQ, the Corps, or the EPA, it is the responsibility of the developer to inform the Land Quality Section regional office so that an adequate contingency plan can be made to assure sufficient erosion control remains on site. This permit allows for a land disturbance, as called for on the application plan, not to exceed — 3.4 acres. Exceeding that acreage will be a violation of this permit and would require a revised plan and additional application fee. Any addition in impervious surface, over that already noted on the approved plan, would also require a revised plan to verify the appropriateness of the erosion control measures and stormwater retention measures. 8: The construction detail for the proposed silt fence requires reinforcing wire and steel posts a maximum of eight (8) feet apart.
